Q WHY DO I PAY AN ANNUAL ASSESSMENT? A. An annual assessment is attached to each property according to the deed restrictions that were in place by the developers prior to the creation of AVPOA. The purpose of these assessments is to maintain and improve common areas including insurance, labor, utilities, equipment, operations and paying property taxes.
Q WHY DO I PAY EXTRA FEES INCLUDING THE FITNESS CENTER, BOATS, CAMPING, DOCKING AND OTHER AREAS DEFINED AS COMMON PROPERTY?
A. The developers within the deed restrictions created the right of the association to charge fees for the usage of common properties. During the annual budgeting process by the finance committee and finance subcommittee the cost to operate is evaluated and the fees are reviewed. As part of the budgeting process, a yearly fee schedule is developed.
Q DO I HAVE TO PAY FOR AN ACCESS CARD WHEN I PAY FOR MY ASSESSMENTS?
A.The association’s goal is to allow access to members without AVPOA staff. This effort is not new to the Association and was started in the late 2000’s with the Club House and Floral Valley, and later the Marina gate was added. This year we are adding gates at Campers Village and the beaches to continue to provide safety.
Q IS THERE A COST TO ME?
A. In order to drive through an access gate when it is closed, you must have an access card. The cost that was set during the budgeting process is a yearly fee of $15. If you purchase a fitness pass for $90, an access card in included.
Announcing Candidates for AVPOA Board Petitions to run for the AVPOA Board of Directors have been turned in and verified. The candidates (in alphabetical order) will be Mark Fritz, Barry S. George MD, Robert McLaughlin, Greg Tunis. A questionnaire and resume will be submitted by each candidate to be published in the May 2023 Cider Press.. Election process explained on page 19
Apple Valley’s Annual Clean-up Campaign scheduled for the weekend of April 17-23, 2023 We are asking all residents to help Apple Valley get off to a great spring by volunteering a couple of hours of your time to clean up road-side litter on the week of April 17-23. We need you and your neighbors to volunteer to clean up all or part of your street. As in past years, we hope to have several groups and residents volunteering to assist in our clean-up of Apple Valley Drive. Groups, as well as resident volunteers can pick up garbage bags at the Administration Building on Hasbrouck Circle near the main entrance April 17-20 from 8:30 AM - 4:30 PM. Bags collected during the clean-up should be placed on Apple Valley Drive to be collected by Apple Valley maintenance. Residents should place their filled litter bags at the intersection of Apple Valley Drive. The timing of our clean-up coincides with a Knox County-wide effort that same day. The unsightly and unsanitary litter accumulates all year ‘round, however the spring clean up is a good time because weeds and grass haven’t yet grown up to cover the litter. Another ongoing approach when going for a walk is to take along a plastic bag in which to collect litter. Here are the details of the Apple Valley Clean-up activity: Clean-Up Day Date: Monday April 17th- Sunday April 23rd Bags available at 113 Hasbrouck Circle from 8:30 AM-4:30 PM, April 17-20.

SAFE WATERCRAFT OPERATION
Definitions Used: “Idle speed” means the slowest possible speed needed to maintain steerage or maneuverability. “No Wake” has the same meaning as “idle speed” A. No wake areas: 1. Within eighty feet (80’) of any shoreline. 2. Within fifty feet (50’) of any designated swimming areas. 3. Within fifty feet (50’) from watercraft engaged in fishing. 4. Within fifty feet (50’) of any downed skier or like individual engaging in a towed activity. B. No wake hours for the entire lake are between sunset and sunrise. C. All watercraft will travel in a counter clock-wise pattern around the Lake, except at no wake speeds. D. No “rooster-tail” devices on any watercraft except personal watercraft (PWC). E. Scuba diving from boats is permitted only in no wake areas. F. Swimming outside of designated areas is at your own risk.

MUDDY WATER REMINDER
Sediment buildup on the lake bottom is the cause of one of the most expensive items in your AVPOA budget. Every time it rains, muddy water runs into the lake and the resulting silt build up causes shallowing with its attendant navigational problems as well nutrient overload which chokes shallow areas with weeds and algae. At some point, removal (dredging) is necessary and expensive. Fortunately, farmers in our watershed are doing their part to reduce sediment runoff by planting buffer strips and using other ecological practices as advised by the Knox County Farm Services Administration, Knox County Soil and Water Conservation District, Ohio State University Extension, and Natural Resources Conservation Services. AVPOA property owners are asked and advised to do their part by planting buffer strip vegetation along the lakefront and feeder streams and using silt fences any time the soil is disturbed.

The Knox County Sheriff ’s Office in conjunction with the ODNR Watercraft will be offering a FREE Ohio Boating Education Course at Floral Valley in Apple Valley located at 850 Crestrose Dr, Howard, OH 43028 from 8 am - 5 pm on Saturday, April 29, 2023. The class covers the fundamentals of state and federal laws concerning safe boating: state-required equipment, watercraft laws, navigation Rules of the Road, basic safety and risk management, and aids to navigation. Tree Removal, Bylaw 17.4. To minimize adverse environmental impacts and maintain the natural appearance of the area, cutting or clearing of trees on lots for commercial sale or other purposes is prohibited without the prior written approval of the Architectural Control Committee. Removal of trees shall be limited solely to that necessary for approved construction projects and elimination of safety hazards. [email protected]) All Knox County voters will vote at a single location for the May 2, 2023, special election. The Knox County Board of Elections office, on the first floor of 104 East Sugar Street in Mount Vernon, will be the only Election Day polling place for all of the county’s 53 precincts. All registered voters will receive a postcard notifying them of the change in polling place for the May 2 election. The change in polling place is the result of a unanimous vote by the members of the bipartisan Knox County Board of Elections. The Board of Elections office also serves as the county’s early voting location and will serve as the early voting location again this year, with the early voting period beginning on Tuesday, April 4, 2023 through Sunday April 30th. Voters are encouraged to take advantage of the multiple methods for casting ballots in the May special election: ● Absentee by mail- To obtain an absentee ballot please go to VOTEOHIO.GOV or stop by the Knox County Board of Elections to re-
quest a ballot. All absentee ballot applications must be received by the Board of Elections no later than 8:30 p.m. on April 25. Completed ballots can be returned by mail and postmarked no later than May 1, or dropped off at the Board of Elections outside ballot box or at our offices, no later than 7:30 p.m. on May 2. ● Early- Vote early at the Board of Elections office. Apple Core met March 9th at the Farmer’s Daughter Restaurant in downtown Mount Vernon where we were served our choice of delicious breakfast selections. The owner, Allison, shared with the club members her history in Knox County and how she came to the decision to open the restaurant and boutique. The members perused the boutique and admired the vast selection of clothes for ages from toddlers through adults. The store also has accessories and jewelry for women. After the business meeting, the members toured the Woodward Opera House with an explanation of its versatility for various productions, such as concerts, dinner theater, shows, and dances. The seating options were described. The art gallery on display in the hallway was also viewed by the members. Knox County is fortunate to have such a resource available in Mount Vernon. Next month’s meeting will be April 13, 2023, and will be a trip to the Behalt museum in Berlin. Admission is $9, followed by a buffet luncheon at the Farmstead restaurant. RED HATS Happy Spring Everyone! The Apple Valley Red Hatters have had some fun this winter of 2023, but we did have to postpone our January meeting due to weather. Though it was a very mild winter, it's all about the timing of the storms and January's storm was timed perfectly well with our meeting, so we decided to stay inside and be safe and warm. We postponed that meeting until March 22. We did get to go to French Ridge Winery in February. Scott and Kathy Buente are the owners of this winery and there is never a dull moment there. With 23 acres, 23 thousand grape vines, 13 different grape types and 22 different wine varietals, they are busy busy busy. Such a beautiful place to visit and such nice people. We shared pizzas and drank some wine and had a great time! Oh and we were greeted by their St Bernard at the door. He's so big and so very friendly. Mary Dozier hosted this party with the help of Sue, since she knows the owners. The weather this past week made it possible for us to reschedule our Snowflake party to March 22. Sue Caudill was our hostess and did a splendid job of walking us through her she-shed where she creates all kinds of beautiful art pieces made mostly of rocks that she collected and then tumbled to smooth out their surfaces. We made ice trees. So fun! Thank you Sue! Sue will be having a booth at the April 1 Spring Fling at Troyer's opening at 10:00am. In April, we will be going to Westerville for lunch and a possible tour of the fire station. Sandy Kitzmiller will be our hostess. More information will be sent via email as we get closer to the date. And in May, we are going to Canton to tour the First Ladies museum and have lunch of course. The 2022 count, the 123rd count, numbers are not available ye In this year’s Christmas count, the Minards counted three eagles on Gilchrist Road and one at Pleasant Hill Lake, as well as the eight they saw on AV Lake. A few days after count week, they found the third nest at Pleasant Hill, one of five they’ve found so far this year. Jon had searched for one of those new nests, in the Howard-Millwood area, ever since he started monitoring eagle nests 22 years ago. Debbie married Jon in 2013 and turned her birdwatching and wildlife photography skills to eagles.

Debbie named the two young eagles “Howard” and “Millie”. Besides the Howard-Millsville nest, they found new Knox nests in Amity and Bangs. The other new nests are the latest find in Pleasant Hill in Richland County and one between Sparta and Marengo in Morrow County. Jon says that eagles are incubating eggs on 13 of the nests, earlier than usual. They usually start incubating eggs by February 19. This could mean spring will come a week earlier than usual. Eagles emerge from the eggs in 35 days and take flight from mid- March to April. The Minards report their nest findings to the Ohio Department of Natural Resources (ODNR), but only when they see an eagle in the nest to confirm it is an eagle nest and not a hawk nest. Even better when they see the eagles bringing sticks to build the nest. Jon explains the math behind the eagle population explosion locally: at least 19 nests, 38 parents, and usually two chicks born every year, with some of the nests having been active for decades. Sadly, a local couple recently found 5 dead bald eagles in Holmes County. ODNR had autopsies done and and ruled out avian flu and hunting as causes but found a small amount of poison in one carcass. Eagles can die from eating lead pellets from shotgun shells and lead fishing sinkers or poisoned animals. Jon has heard that some Holmes County residents put out poison to reduce a burgeoning population of raccoons to protect their chickens. Up to the late 1970s, the only eagle I had ever seen in the wild was a dead bald eagle floating in a lake in far northern Canada, around 1970. My only sightings of live eagles were around 1976, in cages at the U.S. Fish and Wildlife Service (USFWS) Patuxent Wildlife Center where injured eagles that could not survive in the wild were being fed DDT to study the effects. But before the decade was over, I watched a very healthy bald eagle fishing in northern Virginia. By the 1990s, I was watching eagles in a nest about a mile from my house in a suburb of Washington, DC. I also got to watch a USFWS employee climb the tree the nest was in. He lowered one baby eagle by rope tied to a burlap sack while he banded the other, inviting onlookers to take turns holding the eaglet. I declined the offer, not wanting to hurt a bald eagle! In 2007, the bald eagle was removed from the USFWS endangered and threatened species list. And within two weeks after moving to Apple Valley, on May 31, 2012, I got to watch another pair of eagles in a nest at Small’s Quarry, courtesy of Jon and his large spotting scope. In fact, that day, we were lucky enough to see an eagle chick take its

first flight. The Minards also recently discovered seven to nine great blue herons building a new rookery or herony at the north end of Apple Valley, near the marina. Flocks of herons build nests near each other in rookeries. Jon says the biggest rookery in Knox is on Killduff Road, where the herons have built 22 to 24 nests around the tree the eagles are nesting in, for protection. He says there is one in Holmes County with 65 nests. I’ve seen one in Maryland with about 20 heron nests. Approaching the rookery unknowingly, for an Audubon CBC decades ago, startled us as the 40 or so heron parents squawked warnings that sounded like we were approaching Jurassic Park! The Audubon Christmas bird counts began in 1900 with 25 surveys in the U.S. and Canada. Today there are about 2,100 active CBC count circles across the U.S., Canada, and several Latin American and Caribbean countries as well as Pacific islands. Adding in the sites where people chose to count birds visiting home feeders, the recent count number rises to 2,621 sites total. For the field counts, volunteersfollow specified routes through a designated 15-mile diameter circle, counting every bird they see or hear. The count day can be any day from December 14 to January 5, with local count organizers choosing one day for their circle. Volunteers can also submit counts for “count week”, during the three days before and after count day, but these counts are designated as count week data, separate from count day data. This gives a chance to record species that may not have been visible on count day, due to weather or other circumstances, For example, local count compiler Ray Heithaus, wrote in an e-maIl count summary: “A warmer day at the beginning of count week yielded unusual sightings of two great egrets and four sandhill cranes near Fredericktown. Frozen water on count day appeared to send these birds to more hospitable areas.” Outside of the count, Ben Miller photographed the two golden eagles that have been seen in Holmes County for three years in a row. Jon submitted Debby’s photo of the golden eagles to Ohio Birders and they confirmed the species. The eagles were also confirmed by Howard Gratz, another expert bird watcher. Jon explains that it takes a lot of documentation for sightings of golden eagles because in the juvenile stage, bald eagles and golden eagles can look alike. Juvenile bald eagles lack the white head that easily distinguishes the bald eagle from the golden eagle. He says if the sun hits it right, a yellow band on the back of a golden eagle’s neck shines like a gold bar, giving the golden eagle its name. Also a golden eagle is not likely to

be mixed in with bald eagles. For one reason, Jon says their food and nesting needs are different. Golden eagles hunt mammals and likely don’t eat fish, which is an important part of a bald eagle’s diet. So golden eagles don’t need to be near water as bald eagles do. Another difference is that golden eagles tend to nest on cliffsides, not in trees as bald eagles do. There were a total of 13 waterfowl species reported on count day, including 9 duck species. The count also included 71 hawks belonging to 6 hawk species and 2 hawks of unknown species, two great horned owls and one barred owl, 209 woodpeckers representing all 7 of Ohio’s common woodpecker species, 111 bluebirds, 91 goldfinches, and 10 cedar waxwings. In Knox County, the count is organized by Noelle Jordan, manager of
the Brown Family Environmental Center (BFEC) in Gambier. Ray Heithaus, Kenyon College professor emeritus of biology and environmental studies and BFEC co-founder, compiles the data for submission to Audubon. In a recent e-mail, Ray wrote that, “The BFEC count circle was established in 2008. I set up the circle at that time and handled the initial logistics with the Audubon Society. The BFEC has managed it since 2008. Jason Larson did the data compiling the first year, then I picked up data compiling in 2009 after Jason left to take another job.” With this data collection now in its 15th year, volunteers in Knox County are doing their part to help numerous bird species reverse their decline as eagles have, while maintaining the eagles conservation success.

GARDEN CLUB Presumably winter is behind us now, and Mother Nature doesn’t have any early April surprises in store. We’ll see! But for sure, we’re enjoying the spring flowers and trees that either have leafed out or are almost there. Apple Valley Garden Club members will be busy in their yard, finishing spring clean up and getting ready to plant. But we also have SO much going on this month: hosting the various Knox County garden clubs early in the month and hosting a Regional meeting at the end. In between we’ll enjoy our own meeting, April 19, 9:30 a.m. at the AV Clubhouse. More on that in a moment. But first, here’s a big thank you to member Robin Rapp for teaching us all about lasagna gardening. Instead of layering noodles, pasta sauce, ricotta, and mozzarella, we placed flowering bulbs at various depths. Form bottom to top, we planted tulips, hyacinths, daffodils and crocuses. Hopefully our pots of soil will blossom beautifully into mini gardens of spring flowers! Ok, back to April 19. We’ll host Kim Frye, from the non-profit Community Roots. Her program will be on therapeutic horticulture, which relates to using gardening-related activities as therapy. Instinctively, we know how getting out in the garden makes us feel, so it will be interesting to learn about this broader application. Finally, here is a heads up for May. The Garden Club plans to hold the annual spring plant sale on May 6, in the parking area near the recycling bins. Signs will be posted to remind residents of the date and time. AVPOA Election Process
Bylaw 9.4.4. One ballot for each lot shall be distributed to members entitled to vote. Where more than one person owns an interest in a lot, the ballot shall be sent to one of the co-owners, as selected by the Secretary. 9.4.5. After voting, ballots shall be placed in the envelope marked “Ballot.” Each “Ballot” envelope shall then be placed in a sealed outer envelope which will bear on its face the name of the member and the account number as shown on the membership certificate, and such other information as the Board may determine will serve to establish the right to cast the vote or votes presented on the ballot or ballots contained therein. Ballots shall be returned to the Secretary of the Association or the Election Committee at such address as the Board may determine no later than a date established by the Board prior to the Annual Meeting. 9.4.6. Upon receipt of each ballot, the Secretary or designee shall immediately place it in a safe or other locked place until the time
