I.

AMENDMENTS From time to time, minor or technical revisions are made to the Guidelines. Rather than reissue the entire Design Guidelines (DG) document, those revisions are approved by the Board of Directors and posted in an Amendments Chapter at the end of this document until such time as the Modifications Committee recommends and the Board of Directors approves an update to the entire manual. Owners should always consult the Amendments in conjunction with use of this manual. II.

INTRODUCTION Sun City Carolina Lakes is a premier community and lifestyle for active adults. The look and feel of all elements of the physical community - neighborhoods, amenities, and common open space (COS) – were designed to respect the visual character of its natural site, minimize negative environmental impacts, and maximize water and energy conservation principles. In order to preserve and enhance the harmony of the entire community, the Design Guidelines were established to define certain specific standards of the look and feel of each element yet allow the look and feel of the community to evolve to meet buyer expectations over time. The Design Guidelines include minimum standards for the design, size, location, style, structure, materials, color, mode of architecture, mode of landscaping, and relevant criteria for the construction or addition of improvements of any nature. They also establish a process for judicious review of proposed changes within the Community. The Design Guidelines have been adopted by the Board of Directors of the Sun City Carolina Lakes Community Association (hereinafter the “Community Association” or “CA”) pursuant to the Declaration of Covenants, Conditions and Restrictions of Sun City Carolina Lakes (CC&Rs) that were recorded with the Lancaster County Register of Deeds (the “Declaration”), to which all buyers agree in their purchase. The Design Guidelines will be adhered to by the Modifications Committee (hereinafter the “MC”) established under Article IX of the Declaration. All proposed changes to these Guidelines shall be reviewed and evaluated by the MC which shall provide its recommendation to the Board for final review and approval in session. To the extent that any government ordinance, building code, or regulation requires a more restrictive standard than that found in these Design Guidelines or the Declaration,

the government standards shall prevail. To the extent that the local ordinance is less restrictive than these Design Guidelines, any standard contained therein, or the Declaration, these Design Guidelines and the Declaration shall prevail.

III.

MODIFICATIONS PROCESS A. General All changes to the exterior and landscape of any unit in Sun City Carolina Lakes must be approved in advance of any work being done. Applications for Modifications are reviewed for compliance with the Design Guidelines by the MC. (See also “Fast Track” Article III.H)

B. Requirements Unit owners are required to submit an application accompanied by plans (described below) and receive written approval from the MC prior to performing (1) additions, alterations, or modifications to the exterior of existing homes, (2) exterior painting, unless using the same colors as originally used at construction, (3) planting of plants, trees, shrubs, perennials, (4) landscaping, (5) installing of pools and spas, walls and/or fences, (6) any exception to, or deviation from the Design Guidelines, or (7) any concrete work, ancillary equipment, signage, and any and all other on-site improvements not listed in the Design Guidelines. Applications for all modifications to existing homes will not be acted upon by the MC if there are outstanding violations of these Design Guidelines. Notice of any such violations must have been delivered in writing to the Homeowner by the Association. Plans for any modification must otherwise be in conformance with the provisions of the Design Guidelines and contain acceptable plantings and materials. The MC, in its sole discretion, may consider the following criteria when reviewing a request hereunder: 1. The impact the improvements will have on views, both on and off the subject lot. 2. The impact the improvements will have for purposes of future maintenance of the areas affected by said improvements, and 3. Whether the modification will detract from or enhance the overall appearance of the neighborhood or the community. The MC shall have the express right to specify the location of any such improvements.

C. Maintenance & Compliance The Homeowner is always responsible for maintenance of the property and compliance with the guidelines.

D. Changes to Structures For changes to or additions affecting the exterior of the unit, the Homeowner shall submit a plat plus plans showing proposed changes to the footprint, frame, or finish of the house. The Homeowner shall provide drawings and/or photos (color where possible) or other pictures showing the proposed changes or additions to the exterior elevation. If the Homeowner has a photograph of another house or picture out of a magazine which will assist the reviewer, such photo should also be submitted. The application must include a description of the materials to be used. (See Article V for specific permitted structure modifications.)

E. Changes to Landscaping and Plantings For changes to plantings and/or landscaping, the Homeowner shall submit a plat plus a landscaping plan. The plan must include a description of all varieties and sizes of trees and shrubs with the location of each tree and shrub clearly delineated on the plan. Color coding or otherwise providing a legend or key to the proposed plantings will facilitate review. The layout of any hardscape, including but not limited to brick, masonry, wood trim, concrete, rocks or other inert material, shall be clearly marked on the landscape plan and a legend should be provided. Lots have been designed and graded to provide positive drainage from the lot and to protect environmental conditions in compliance with original storm water construction permits issued by the Army Corps of Engineers. The Homeowner's plan may not alter the grade of the lot. The location of all drainage elements and the direction and slope of flow must be indicated on the plan. Homeowners will be responsible for any damage caused by any change to drainage by themselves or hired landscapers.

F. Lancaster County Permits Homeowners are advised that Lancaster County requires certain permits, depending on the proposed change, alteration, or addition. The Homeowner is responsible for complying with permit requirements. Homeowners should contact the Lancaster County Building Department for further information. Any permit or approval issued by Lancaster County shall in no manner whatsoever bind the MC with respect to approval or denial of any application for items Sun City Carolina Lakes Design Guidelines: Approved: December 21, 2021

submitted for consideration; the MC shall be fully independent of and shall have full authority for approval or denial of any such matters. If the plans submitted by a Homeowner require a building permit, the approval by the MC is not a guarantee that such plans will be approved by Lancaster County. If Lancaster County requires modification to such plans, such modifications must also be approved by the MC for the Homeowner to remain in compliance with these guidelines.

G. Submissions for All Changes and Additions 1. Application

The Homeowner shall submit a Modification Review Request as provided in Appendix “B” showing the plans for the proposed additions, improvements or alterations. For reconsideration of a modification request cancelled by the homeowner or denied by the committee, a Modification Review Request must be submitted as if it was a new request, including the administrative fee. 2. Review(s)

The MC shall assign a reviewer member of the Committee to your application. The reviewer will visit your property to personally inspect your proposed modification(s). The reviewer will report the findings of his/her visit to your property and propose that your modification request does or does not comply with the Design Guidelines. The Committee reviews such submissions at its regularly scheduled meetings. Homeowners may attend these open meetings. A letter shall be mailed to the Homeowner advising the results of the MC’s decision. 3. Decision(s)

Upon completion of review by the MC, a letter indicating the MC’s decision shall be rendered in one (1) of the following three (3) forms: “Approved” – The entire submitted application, including any noted revisions, is approved in total. “Denied” – The entire document submitted is not approved and no work may commence. “Conditional” – The application submitted for approval is not approvable under current guidelines however, because the change was made by previous owner, the request is approved with conditions. owner is allowed to keep the submitted change until the house is sold or further change is made involving the item in this application at which time the property must be brought into compliance with current guidelines. An application may be tabled, if in the opinion of the Committee, additional definition or understanding of the work is necessary. Once an application has been formally approved, the work may begin. Owners are advised that ALL modifications will be inspected in a re-check. If work is performed beyond or materially different than that approved in the application, the re-check reviewers will find it and report it to the Committee. Upon agreement by the Committee, a violation notice will be issued. 4. Remedies

Failure by Homeowners to secure prior approval from the MC for any project may cause that project to be subsequently disallowed by the MC. In such instances, Homeowners may be required to remove non-complying changes or otherwise amend their plan based on the requirements of these Design Guidelines and the Declaration, Article IX, Section 9.3, “Guidelines and Procedures”. The Homeowner shall also be responsible for any costs, liabilities, damages, or causes of action arising out of such unapproved modifications. Any subsequent modification(s) request will not be considered until any assessed penalties are paid.

H. Fast Track Many common modifications have been designated as “Fast Track” modifications that do not require an advance inspection of your property. These applications will be reviewed and approved without formal Committee action if the application is in compliance. The list of Fast Track modifications can be found in Appendix “I”. Owners are cautioned that all modifications, including Fast Track, will be inspected for compliance with the specifications of these Design Guidelines and conformance with this process.

I. Fees Formal review of all applications and all landscaping plans may be subject to a nominal fee payable to the Sun City Carolina Lakes Community Association to cover administrative costs.

J. Temporary Sanitary Facilities During the time of construction of new homes or building additions, repairs or renovations of existing homes or amenities in SCCL, temporary sanitary facilities (“porta-potty”) may be provided by the contractor doing the work with the following considerations: In the case of renovations and repairs, the unit will be placed on the driveway or other such area as close to the building as possible while allowing for service access. In the case of new construction, the unit will be placed so as to be as inconspicuous as possible while still allowing for service access. The unit may only be on site when actual work is being performed. If there is a temporary stoppage of work for more than 7 consecutive days, the unit shall be removed. In all cases the unit must be removed from the site as soon as practicable.

K. Work Area and Staging of Supplies Homeowners are responsible for all clean-up of their project(s). All construction debris, sod, soil, plant overgrowth, etc. must be removed and hauled to the proper waste sites, outside of the community. Dumping waste in open space, any common area, storm drains, or golf course is prohibited. All staging for vendors performing work on a property must be done on the Homeowner’s lot. At no time may the road be utilized for any staging or storage of any materials. Homeowners are responsible for any damage resulting from any staging.

L. Damage to Neighboring Properties If any project causes damage (including diversion or disturbance of storm water drainage) to neighboring property, common area, or golf course, the Homeowner is responsible for any necessary repairs or restoration. (See Articles V.B.1.d and VI.B)

M. Contents of Applications All modification submissions require a copy of the property survey/plat that was originally filed with the Lancaster County Register of Deeds be included with the application along with all appropriate forms and details of the project. a) Modification requests proposing modifications to the structure must include a plan with all relevant dimensions and descriptors, including but not limited to: 1. Elevations to indicate window/door placement, 2. Siding and gable treatment,

3. Trim, fascia and gutter details, including color, 4. Verification of planned roof pitch, and 5. Additional information as may be reasonably requested by the MC during its review. b) Modification requests proposing changes to the plantings, landscape, or hardscape must indicate: 1) the location of the proposed modification(s) on the required plat; 2) a larger drawing showing dimensions for patios, deck, pergola, and other facilities proposed, including a description (name, color, and size) of all materials to be used; 3) specifications for water features such as ponds, fountains, and waterfalls; 4) a planting plan indicating the location(s) and number of each plant to be installed 5) a plant material list and 6) color photo(s) of materials to be added or otherwise modified. The signature does not indicate approval of or objection to the proposed modification. The MC, in its sole discretion, shall have the right to waive the requirement for signatures of all contiguous Homeowners where those Homeowners refuse to acknowledge the request or are otherwise unable to sign. If a contiguous Homeowner objects to the proposal, that Homeowner is required to file an objection with the MC prior to the next scheduled committee meeting. A photograph of the home and the relationship of the proposed feature to the existing structure or landscape may accompany the submission to further explain the proposal. Contractors often help owners by preparing a modification request application. However, the owner of the property is responsible for the accuracy and completeness of all modification request applications. To avoid misunderstandings and delays, owners should review their modification request application to ensure they understand it and it is in compliance with these guidelines. Any application that is incomplete, lacking details, or illegible will be denied. The Committee is eager and willing to assist any owner who needs help in the modification application process. Once requests have been submitted and approved by the MC and modification has commenced, any subsequent changes to the Design Guidelines shall not affect or delay the approved project.

N. NON-LIABILITY FOR APPROVAL OF PLANS Article IX, Section 9.7 of the Declaration of CC&Rs contains a disclaimer by the Community Association and the MC of liability or responsibility for the approval of plans and specifications contained in any request by a Homeowner. None of the Association, its officers, the MC, the Board of Directors, the Association management agent, or any member of the foregoing shall be held liable for any injury, damages, or loss arising out of the manner or quality of approved construction on or modifications to any lot. In all matters, the MC and its members shall be indemnified by the Association, as provided in the By-laws, to the maximum extent permitted under South Carolina law.

V.

RESIDENTIAL DESIGN GUIDELINES: STRUCTURE A. Architectural Character The intent of the Design Guidelines is to provide a clear, detailed list of modifications that an owner may choose to make to his/her dwelling unit while not detracting from the market value of his/her neighborhood or the community as a whole. After extensive study of the development of Sun City Carolina Lakes and the surrounding market, the Board of Directors concluded that the maximum market value of a neighborhood consists of a certain “look and feel” that can best be described in six characteristics: 1. Clean, clear, simple sightlines from all viewpoints within the neighborhood. 2. Clear, well-maintained landscaping utilizing a consistent compatible collection of shrubbery, turf, and trees. 3. Houses of similar size that utilize a consistent general design across the neighborhood: gabled rooflines of a consistent pitch, indented (not horizontally flat faced) fronts and façades, consistent door and window

types and placement of those windows within the walls, two car garages with a single door. 4. Carefully defined color schemes that allow variations from house to house within the neighborhood but assure harmony of the house itself with the neighborhood. 5. Materials (e.g., siding, stone, and brick) that work together to produce a professionally done appearance. 6. When a visitor or other potential buyer drives down a street, he/she sees an impression of clear, universal design with small differentiating variations from house to house, but no single house that stands out as being significantly different from the overall neighborhood.

B. Structure: Footprint, Frame, and Finishes 1. Structure: 1 Footprint a)

Setbacks

Setbacks are invisible lines drawn relative to the property boundaries. They define legal limitations about what may be done on the property. Setbacks were defined in the original Planned Development District (PDD-18) and are listed in Appendix “A” of this document. b)

Rear Private Area

The Private Area of each lot is defined as the area in the rear of the dwelling unit between lines projected from the primary side walls of the dwelling toward the rear of the property line, terminating six (6) feet in front of the rear property line. c)

Alterations, Additions, or Renovations

No addition, alteration or renovation shall be permitted if it is determined to have an adverse/material impact upon neighboring properties and/or the community. The size of any structure modification shall be determined by the available space per lot within the Private Area. The MC reserves the right to limit the size and location of certain modifications.

Each Homeowner is responsible for removing or otherwise correcting, at his/her expense, non-complying and/or unapproved modifications. In the event of a resale, property shall be brought into conformance with these Design Guidelines prior to closing title. d)

Storm Water System Highly Regulated

Owners are hereby cautioned that the storm water drainage of all of Sun City Carolina Lakes was designed to comply with the EPA Clean Waters act which forbids movement of soils into waters of the United States. The Association is the holder of the permits and responsible for compliance with the permit terms. Violations of the terms of the permits can lead to Federal and/or State Administrative penalties which can run into 1,000’s of dollars per day. Each house lot is a contributing part of the entire storm water system. Changes to a house or lot can affect performance of the system. When any additions, alterations, or renovations are performed to an existing dwelling unit, the established lot drainage shall not be altered. Any Homeowner who changes or allows to be changed, the existing grading or drainage shall be liable for all costs and expenses of repairing such changes and any costs, liabilities, damages, or causes of action arising out of such changes. e)

Additions

All additions to homes shall be built within the rear Private Area of the lot and within building setback lines originally established for Sun City Carolina Lakes or as modified by the developer with the requisite approval of Lancaster County, regardless of any more lenient requirements of any local governmental authority. These building setbacks are copied in part in Appendix “A” and are contained in detail in PDD-18, adopted as Lancaster County Ordinance 631 on August 2, 2004, as amended in Ordinance 691 on January 9, 2006. The height of any addition to an existing dwelling unit shall not be higher than the original ridgeline. No alterations or improvements shall be approved if the proposed roof pitch varies from the original constructed pitch of the roof. existing gable on the rear of the house, then the roof pitch of the addition shall match that of the existing gable. The roof must be constructed of solid material designed to be shingled in materials that match the existing house and neighborhood. No shed or gabled screen roofs are permitted. Shingles, siding, and trim must match the existing house. The existing front footprint may not be changed. Additional air conditioning must conform to Article V.B.1.k.1 of these guidelines. Windows in the addition must conform to Article V.B.2.d and following subsections of these guidelines. Additional entry door(s) as part of any structure addition must open within the Private Area. Storm water drainage from the addition will replace, not add to the storm water load per square foot. However, the roof of the addition may add to concentration of the flow. Steps must be taken (e.g. a pop up drain in the yard) to avoid overloading and damaging the current ground level drainage system. f)

Wood, Wood Composites and Their Treatments

Many landscaping and architectural features throughout the community use wood or wood composites. These include arbors, decks, pergolas, trellises, and privacy screens. Following are the guidelines: 1. Pressure treated lumber, cedar, and exotic woods such as mahogany, tiger wood, or teak as well as composite or synthetic wood replacements such as TREX may be used. 2. Pressure treated lumber must be painted or stained. The exact color or treatment required is dependent on the structure being constructed and will be detailed in the appropriate section of these Design Guidelines. 3. Cedar and the exotic woods may be left natural, painted, stained or oiled as is appropriate for the species of wood being used. Sun City Carolina Lakes Design Guidelines: Approved: December 21, 2021

g)

Decks, Patios, and Seat-walls

Decks should be designed in harmony with the architecture of the home. All rails, rim joists, stringers, spindles and any other vertical member shall be constructed of treated lumber, composite, vinyl, glass, cable, aluminum, cedar, or other exotic woods such as teak or mahogany. Decks with a permanent component seventytwo (72) inches or greater above original ground may encroach five (5) feet into the setback area upon review and approval by the MC per Lancaster County Ordinance 1027 adopted on April 26, 2010, modifying PDD# 18. Construction of decks that conflict with the established drainage pattern of the lot will not be permitted. Extensions or modifications that have been determined to have an adverse material impact upon neighboring properties and/or the community shall not be approved. The size of decks and patios shall be determined by the available space per lot, within the Private Area. The MC has the right to limit the size and location of decks and patios. Deck railings will normally be painted or otherwise finished similar in color to the deck or trim of the home. Deck railings may also be black aluminum with aluminum spindles, tempered safety glass panes or stainless-steel cable to meet Lancaster County code. In no case shall deck rails exceed forty-eight (48) inches in height from the decking. Rear elevation rails must be associated with surfaces intended for foot traffic, must conform to local building codes as to size, member spacing, and strength, and must be constructed of vinyl or aluminum with a smooth top, in white or black. Patios and seat-walls should be designed in harmony with the architecture of the home. No patio or seat-wall that is in conflict with the drainage pattern as established for the lot may be constructed. h)

Deck Skirting

The understructure of decks, not over a walk out basement, may be screened with lattice or solid skirting, subject to approval of the Sun City Carolina Lakes Design Guidelines: Approved: December 21, 2021

MC. Lattice may be either white vinyl or pre-treated wood, painted white or stained to match the deck. Solid skirting, either vertical or horizontal may be used. Vertical skirting must be of the same material as the deck. Horizontal skirting will be of the same material as the house siding. In the case of solid skirting, the material used must be painted or stained to match deck color, house siding color or white to match house trim. If using solid skirting, consideration should be given to providing ventilation to the understructure of the deck. i)

Awnings and Shade Devices

Man-made screens and shade devices other than umbrellas must appear as an integral part of the building elevation. Materials must complement the home and the neighborhood. Roof-mount installation is prohibited. Awnings or similar shading devices are permitted on the rear Private Area of the home only. Awnings and shade devices must be consistent in color and material with the house, the community-wide standard, and approved by the MC. No advertising or logos are allowed on awnings. All awnings must be retractable and must be retracted when not in use. j)

Pergolas

One (1) pergola may be installed. Pergolas must be attached to the house using a header. They must be within the sight lines of the sides of the house. Additions to an existing pergola must match the existing one in style, color, material, and elevations. All pergolas must be constructed of white vinyl, treated wood, aluminum, or cedar. A pergola constructed of pressure treated wood must be stained a natural color (not including red or orange) or may be primed and painted white or the color of the house siding. Detailed construction drawings, including elevations and details, must be submitted for all pergola applications. Pergolas must be constructed within the Private Area of the lot and may not be placed or extend outside the lines projected along the primary side walls of the dwelling unit. The Homeowner is responsible for all local permits required to construct a pergola and, if such permits are required, the permits shall be obtained before construction commences. Pergolas and shade structures must be structurally sound and anchored in accordance with local codes. Cross-bracing shall not be utilized on any side of the structure. When framed, the highest point of the pergola or shade structure may not exceed the eave height of the home. Please see Appendix “D” for an example of a typical pergola. Permanent covers on top of a pergola are not allowed. Adjustable louvered roofs are allowed, as are shade fabrics that may be extended or retracted as desired. Shade fabrics must be neutral, black, or match the existing home siding color. If approved, all such fabrics shall be retractable and installed in accordance with manufacturer’s recommendations. Installation on top of the pergola is not permitted. The Homeowner is responsible for the maintenance of the pergola and removal of any accumulated debris on or around it. The Homeowner is required to always maintain the fabric in good condition and any damage, tears, frays, or deterioration, including fading, is to be repaired or replaced promptly. Rigid covers such as those of fiberglass, plastic, or metal, whether permanent or temporary are prohibited on pergolas. k)

Miscellaneous Elements

1.

All additional ground mounted mechanical equipment (equipment in addition to the originally installed HVAC equipment) must be installed within the Private Area, unless required by local codes to be installed elsewhere. Any additional HVAC equipment shall be placed behind the builder installed HVAC equipment. In the case of a mini-split system where the location of the compressor unit behind the builder installed HVAC equipment would result in an inefficiently operating system, the compressor/ condenser unit may be placed in the rear private area. All types of additionally installed equipment except HVAC units shall be screened from street view and neighboring property by plantings where possible.

Radon mitigation systems are allowed with an approved Fast Track request. Ideally, the fan motor will be mounted

in the home’s attic and vented through the roof. In cases where that installation is not feasible, the system should be installed to vent through the rear private area of the home or as far to the rear of the house as is practical so as to be as unobtrusive and non-impactful on neighbors as possible. 3.

With the exception of satellite dishes, power vents for attic fans, radon mitigation vents, and approved lightning protection devices, other roof-mounted or window-mounted equipment (including mechanical, air conditioning, solar electrical power panels, and solar heating equipment) is not permitted. Skylights and solar tubes should be installed on the rear side of the Residential Unit whenever possible. See Appendix “J” for details on lightning protection installations.

4.

Antennas, satellite dishes or other devices for the transmission/reception of television or radio (including amateur or ham radios) and weather stations are to be installed on the rear corner of the roof. Antennas, satellite dishes and weather stations may be no greater than 39” in height. Amateur and ham radio antennas will be considered on a case-by-case basis. All cables and conduit must be installed and maintained in a professional manner.

5.

All portable play equipment, garden equipment, and lawn furniture must be stored nightly within the rear Private Area and shall not be left on other portions of the lot which would impede mowing and maintenance activities. Nonportable hose reels may be stored on the sides or rear of the dwelling unit, but not in any front bed.

6.

Roof decorations such as weathervanes, windmills, flags etc. are not permitted.

7.

Tankless water heaters must be installed inside the garage.

8.

Hose Holders (storage boxes, decorative pots, attached holders, free standing holders and portable hose reels) shall be allowed on the side and rear of the homes. Hose holders attached to the home must be approved. Hose holders on the sides of the home can be no closer than 10 feet from the

corner of the house. Decorative pots may be used to store hoses in landscape beds anywhere on the property. (A decorative pot used in this manner is counted towards the total number of pots allowed in the front of the home). 2. Structure: Frame a) Garage Doors

Builder installed garage doors may be replaced with either a direct replacement double car width, roll up, four row, eight column raised panel door or a double car width carriage style door. See Appendix “E”. A replacement carriage style door must be commercially made and sold as a carriage style door. No DIY retrofits, stencils, painted, or glue on appliques will be approved. Color must be white only. The top row of panels in multi-panel doors may contain windows as specified in Fast Track. b) Garage Door Screens

Garage door screens mounted entirely within the garage will be considered. Such screens must be either black or white in color and shall not contain any decoration, logos or similar adornment. c) Garage Service Door

One exterior service door opening into the garage on the garage long side of the house may be installed to allow entry and exit from the garage without opening the garage door. The door must be of exterior quality, white, and either solid six panel or partial glass. The door may be no larger than 36” by 80”. If installed, a weather guard should overhang the full width of the opening or as limited by current building code. The guard should be shingled or covered in metal that matches the house. If desired, a landing pad of concrete or pavers may be installed extending no more than 18” from the foundation and no wider than the door opening. The elevation of the surface of the pad must not impede lawnmowers. d) Windows

Double hung windows with full screens may be used to replace single hung windows throughout the house.

Existing windows in the rear of a detached house may be replaced with doors or multiple windows with sliding doors. Windows may be single or double hung. Grids are not required in rear windows. Additional basement windows and doors are prohibited, unless deemed necessary per county building code. Additional windows, single or double hung, may be installed on the sides of the house. Horizontal or awing type windows may be installed as a “transom” type installation. Fit and finish (vinyl clad, white trim, etc.) must match the existing house as closely as possible. Casement, horizontal slider, single or double hung with full screens, multi-track, and awning windows are permitted in converted or add-on sunrooms. Special precaution must be taken if the use of casement or awning type windows would present a hazard to people moving outside the windows. Arched top frames/transom windows will be considered in the rear of the house on a case-by-case basis. To ensure structural integrity, a building permit will usually be required for this type of modification (check with the Lancaster County Building Department). The MC may impose additional requirements and restrictions on a case-by-case basis. Other than Bay or Bow replacements (see following), no additional windows will be permitted in the front of the house. e) Bay Windows

A bay or bow window may be installed in the front of the house to replace a group of existing single or double hung windows. Such windows must be sized and installed to fit within the outer dimensions of the existing window group. All sections of the replacement window must contain mullions and/or grids similar to the windows being replaced. Trim (fit and finish) must match the house. f) Picture Windows

Picture windows up to 90” W by 72” H may be installed on sides and rear of the house. Potential privacy issues created by installing a picture window will be evaluated on a case-by-case basis.

g) Front Doors, Transom, Sidelights

Front door, transom and sidelight glass may be changed. A photograph or picture of the design is required with the application form. Glass in front doors, side, and transom shall not be colored. Glass designs must be approved by the MC. Front doors may be painted. Color must be from the approved color palette contained in Appendix “F” and in the “Door Book” kept at the front desk at the Lodge or in the Exterior Color Scheme found on the MC Library page of community website: OurSCCL.Com h) Storm Doors

All storm door additions must be full view or full view self-storing. Storm doors must match the color of the doorframe trim or the front door. Security doors with visible metal bars of any type are prohibited. i) Shutters

Shutter installation is subject to review by the MC. All approved shutters must match the existing builder style and color and must blend in with the existing home color. See Fast Track list in Appendix “I”. j)

Gutters, Downspouts and Gutter Guards

Gutters and downspouts may be replaced with larger sized elements but must be of the same color and material as the originals installed on the house. Anti-clog or leaf filtering devices may be added to gutters or used as a replacement for the original, K-style guttering. Gutter and downspout replacement is considered a Fast Track item. Fast Track applications must be accompanied by a plat map indicating the locations of all downspouts with flow direction. A request to change the locations or flow direction of downspouts requires a full Modification Review request.

k) Front Carriage Lights and Address Plate

Original equipment replacement front carriage lights are available in two styles: Kilcher Chesapeake 17” part # 49225 BK and Seagull Lighting Winfield part # 88200-12. Replacement lights shall match the originally installed fixture. The direct replacement address plate is Seagull Lighting part # 9600-12. Please note that number plates for the address plate must be ordered separately. All the lights listed here are available directly from the manufacturer and from other online resellers.

3. Structure: Finishes a) Style or Scheme Collections

The Community look and feel was defined by the developer to include choices of a wide variety of siding materials, siding colors, siding texture, shingle style and color, and various masonry elements. In order to ensure a harmonious look among those elements and yet allow choices, the elements were grouped by experts in real estate and architecture into “scheme collections”. See Appendix “K” for an example. After development was concluded, the MC was charged with the go forward responsibility of periodically reviewing the scheme collections to ensure the elements remain current and competitive with the surrounding market for active adult housing. A separate book of the schemes is kept by the Modifications office and is available as a digital file. When an owner wishes to change the exterior of their house, the changes must be from within one scheme. b) General Rules

Your application for modification of the exterior finishes must contain an elevation sheet or a photograph of another house, including its street address, that you are using as a model. • When completed, all elements of finish must be from a scheme that was available for that model. • When completed, all elements of finish must be from within the same design scheme (no mixing). • The completed finishes may not match the house on either side nor the house across the street from yours. c) Siding Changes

Definitions: • “Primary siding” is the siding used on the back and outermost sides of the unit. • “Accent siding” is the other forms of siding such as shakes and board and batten used in some portions of the front and entryway areas. Rules: 1. All the primary siding must be the same material, color, texture, and reveal wherever it is used. 2. Accent siding may be used only on the front and entryway areas of the house. 3. The primary siding, accent siding, and decorative elements such as shutters and brick or masonry must conform to the scheme and color palette approved for the house. 4. Reveal of the replacement siding – including fiber cement board must be nominally the same as the reveal of the siding being replaced. 5. Builder installed brick or stone on a façade may be continued around the corners onto the sides using the same material as original. 6. Siding color may be changed using colors from the approved scheme collection. All materials on all sides of the house must conform to those associated with the chosen color from the scheme. d) Front Elevation Railings

walking or navigating any horizontal surface such as walkways or steps. Guardrails must be associated with surfaces intended for foot traffic, must conform to local building codes as to size, member spacing, and strength, and must be constructed of vinyl or aluminum with a smooth top, in white. Handrails in front walkways must be constructed of vinyl or aluminum, with a smooth handgrip top, in either black or white. Handrails and guardrails shall have smooth straight pickets. No scroll work, twists, or logos are permitted. e) Shingles

Shingles shall be architectural style and either Driftwood or Weathered Wood as was originally installed on the home. Replacing the entire roof requires Fast Track approval. See Appendix “I” for the Fast Track form. Adding or removing metal roofing is considered a façade change and requires a full modification request.

VI.

RESIDENTIAL DESIGN GUIDELINES: LANDSCAPING A.

Landscaping – all lots Landscaping modifications permitted or restricted on all lots are as follows: 1.

Definitions:

“Landscaping” as used in these guidelines refers to performing any alteration of the plants, turf, or existing beds of a property. The term “Hardscape” as used in these guidelines refers to patios, walls, or sitting walls of any material including brick, concrete, composite materials or stone. Pressure treated lumber, railroad ties and other wood products shall not be used as hardscape materials. Bed edging is not considered hardscape. (See Article VI.C.1.b, “edging”).

Encroaching on Retaining Wall Easements

Any modification request, including landscape planting beds and fences deeper than 6” that encroach within twenty (20) feet of a retaining wall, must be accompanied by an engineer’s certification from an engineer licensed by the state of SC. The certification must state under his/her seal that the design, construction, and installation of said project would have no adverse impact on the structural integrity of the adjacent retaining wall. 3.

Use of Hardscape

Hardscapes are permitted only in the rear of the dwelling between lines projected from the two primary side walls of the dwelling terminating six (6) feet in front of the rear property line or three feet from the center line of a swale. Exceptions to this rule may be allowed as mitigation to otherwise unsolvable erosion problems involving a swale. See Article VI.B.2, “Swales”. 4.

Plantings

Plantings of trees, shrubs, groundcovers, perennials, grasses, and vines shall take into account future growth, be at a reasonable distance from foundation walls, and be maintained in accordance with maintenance standards outlined in Article VI. D, Maintenance. Side beds on all lot types may be expanded with MC approval. Side beds shall be no closer than three (3) feet from the centerline of a swale and three (3) feet from the property line. On corner lots, beds shall be no closer than five (5) feet from the owner side of the sidewalk. Planting beds at the rear of the property not abutting COS shall be no closer than six (6) feet from the rear property line. Planting beds adjoining COS may abut but not intrude into COS space. No planting may intrude on the original traffic control sight lines approved in the original Planned Development District site plans and as indicated on homeowner’s plat. Installation of plant(s) or a single trellis to screen the ground mounted HVAC is permitted (See following sections “Landscaping on pie-shaped Sun City Carolina Lakes Design Guidelines: Approved: December 21, 2021

lots or Landscaping on corner lots” for exceptions.) By way of example, permitted plants include, but are not limited to, Otto Lykan Laurel, Compacta Holly, Needlepoint Holly or Indian Hawthorne or plants with similar mature size. All plants shall be located a minimum of two (2) feet from the equipment to allow for adequate air circulation around the equipment; however, it may not encroach or trespass onto neighboring property. No fencing of any type is permitted around the HVAC unit. One additional tree outside of the builder installed beds in the front of the house is permitted as long as it complies with other guidelines. The planting bed at this tree may be up to six (6) feet in diameter and may contain up to five (5) low growing shrubs (mature height of three (3) feet). The front edge of the planting bed must be no closer than six (6) feet from the owner side of the sidewalk.

B. Drainage 1.

General

All roof drainage and sump pump ejector lines shall drain to the ground solely within the deeded lot area and may not be discharged closer than five (5) feet from any neighboring property. Drain lines, which direct roof drainage or sump pump water must be approved by the MC and must comply with the following standards: a) A drain line plan with discharge locations and emitters must be submitted on a plot plan of the property to the MC for consideration. b) No discharges of stormwater not originally installed by the developer may be closer than five (5) feet to any neighboring property. c) An air break must be provided between downspouts, sump pump ejector lines and drain line extensions. d) Drain line extensions may not discharge water directly perpendicular to a neighboring property or an existing drainage flowline. Drain line alignments shall be set so that discharge water flows in the same basic direction as existing flowlines on the lot. Emitters, water disbursement, and/or erosion control measures must be provided to eliminate erosion of the soil on the lot.

e) Roof drain downspouts, sump pump ejector lines, or any surface runoff or groundwater shall never be connected directly or indirectly to any public sanitary sewer system. f) Additions which increase storm water runoff concentration must include downspout location and discharge direction. 2.

Swales and Erosion Control

Drainage swales exist between and behind many homes in SCCL. The Property Management Company (PMC) receives work orders from many homeowners citing problems with swales. Correction of drainage issues on the homeowner property is the responsibility of the homeowner. Note: adjacent homeowners may share a swale and, therefore the cost of remediation. In shared problem areas remediation plans must be submitted by both homeowners. If a homeowner has drainage issues, they should develop a remediation plan. Remediation may involve; piping downspouts to front or rear of property as slope of the land dictates, French drains, catch basins, bringing in fill dirt, regrading to provide adequate slope, and reseeding or sodding as warranted. If required, each home shall have its own downspout piping. Such piping between houses may use a common trench. Any such plans require MC approval prior to any work being done. In order to prevent drainage issues; Site drainage must be considered when designing landscaping and must be indicated on the landscape plan when submitted. No landscaping or hardscaping is allowed within three (3) feet of the centerline of a swale. Any remediation work must be approved by the MC prior to any work being done. When completed, swale(s) must be sodded or seeded and leveled to grade.

C. Landscaping Requirements and Guidelines 1.

Homeowner Responsibility

The developer installed a “landscape package” on each residential lot. The Homeowner shall remain ultimately responsible for all landscape Sun City Carolina Lakes Design Guidelines: Approved: December 21, 2021

replacement including any additions made by the Homeowner. Landscaping replacement by homeowners shall be in accordance with the maintenance standards comprising the Community-wide Standard described in Article V. A and in conformance with the following requirements: a) Plantings and Turf

The plantings prohibited in Sun City Carolina Lakes were selected after consideration of many factors. A list of the prohibited plantings, accompanied with minimum and maximum size information, is set forth in Appendix “H”. Individual plantings of vegetables cannot exceed forty-eight (48) inches in height. All such plantings are to be within the Private Area. One planting bed, up to a maximum of thirty-two (32) square feet may be installed. Raised beds are not permitted. Protective non-metallic netting of a color consistent with the background may be used to protect plants in the rear Private Area from destructive animals and birds. Protective netting may not be used as a protective fence. The ground surfaces of all portions of the lot are to be covered with either turf or approved ground cover. Where turf is used, Bermuda grass is preferred. However, recognizing that Bermuda does not grow well in shade, Zoysia may be used to sod areas that were originally Bermuda. Zenith and Zeon are acceptable varieties of Zoysia which may be planted. Installation of Zoysia is a Fast Track item. NOTE: Bermuda grass was designated in the original design plans approved by the Army Corps of Engineers as the only ground cover that could withstand the aggressive flows of water from the 10-year maximum storm runoff as required in EPA regulations. Landscape planting beds, other than exceptions described below in Article VI. D, are prohibited between the front yard twenty (20) foot setback and the front property line. b) Edging

All edging must be approved by the MC. Acceptable edging materials include stack stone, heavy duty powder coat steel in brown or green, Sun City Carolina Lakes Design Guidelines: Approved: December 21, 2021

architectural blocks, concrete, and bricks. Wood, plastic, and rubber are unacceptable. If steel is used, no more than two and a half (2½) inches shall be above ground level. If poured in place concrete is used, it must include reinforcing fiber and an earth toned base color within the concrete. Expansion joints must be used to control cracking. Only one type of edging may be used in an individual planting bed. All front bed edging must of the same material, style, and color. The height of bed edging shall not exceed eight (8) inches at the walkway. It may then step up or down to accommodate the grade of the lawn. Edging around utility plantings may not exceed eight (8) inches above turf level. Bed edging in the rear of the home shall not exceed eight (8) inches above grade level when measured from the highest point of the lawn adjacent to the bed. It may then step up or down to accommodate the grade of the lawn. Any edging of more than one layer must be mortared or cemented in place, or interlocking blocks. c) Decorative Stone/Rock

The use of stones, rocks and pavers, regardless of purpose, requires MC approval. Decorative stone or rock shall be permitted as a ground cover only as a last resort to control storm water erosion and only with an approved modification request. Where stone or rock meets the turf, an approved edging must be used to prevent intrusion of stones into the turf. Stones used as erosion control shall be river jacks (typically 1-5 inch diameter, smooth stones). Ground cover or inert material shall not be used to spell out words, emblems, geometric patterns or any other communication. Steppingstones in turf areas are not permitted. Steppingstones may be used in any planting bed. The number of large stones or boulders used as decoration in a landscape is limited to three (3) per bed. These shall be no larger than what is commonly referred to as a “huggable,” (one a person could put their arms around). Stones or pavers may be used in the small planting bed between the walkway edge and the wall of the house or garage. Stones or pavers may be installed extending from the front edge of the front landing to the front edge of the garage. The semi-circular planting beds in front of the garage are to be mulched. A stone or pebble pathway, with or without pavers may be allowed in the rear private area. The pathway must be in a planting bed and must

terminate with approved edging to prevent stones or pebbles from intruding on turf. All stones and rocks shall be earth tones. White marble or granite is not acceptable. d) Walkway Addition to Driveway

In contrast to sidewalks which front the houses along a street, walkways provide hard surfaces on which pedestrians can walk, usually expanding the effective width of a driveway or from a driveway to a house. Additional walking area(s) (walkways) may be constructed of formed concrete, stamped concrete, or pavers. Approval of any proposed walkway will depend on lot size and design. Color samples must be submitted. The dominant allowed colors are grays and earth-tones. Other colors adding character or style must be minimal and will be approved on a case by case basis. Walkways connected to driveways

Driveway walkways may be set adjacent to the driveway extending the overall driveway width a maximum of two (2) feet per side. They may not 1) extend past the overall width of the garage, 2) must be attached to the driveway, 3) run in a straight line and not flair out at the curb and, 4) may not alter drainage. If pavers or stamped concrete are used, concrete for stamping may be applied on one or both sides. The same material must be used on both sides of the driveway. Pavers are not permitted anywhere in the middle of the driveway. Concrete may not be demolished to install pavers. Entrance Walkways leading from driveways If pavers are to replace a builder supplied concrete walkway, the concrete must be demolished and replaced by the pavers. Where pavers already exist in either the entrance walkway or a driveway walkway, the pavers of both areas must match (no second color.) 2.

Common Open Space (COS)

Certain areas have been designated as open space, wetland or preserve on neighborhood plats and shall be maintained as required by regulatory Sun City Carolina Lakes Design Guidelines: Approved: December 21, 2021

authorities and as described in specific permit conditions and in the Declaration. On Common Open Space designated for regular maintenance, as shown on the pod maps found on the SCCL website under Resources Center, COS Pod Maps, a homeowner may be allowed to replace a dead or dying plant on adjacent COS, at the homeowner’s expense. The homeowner must first consult with the Association’s grounds manager to determine if a replacement is warranted. The homeowner will then submit a Modification Review request, with a letter from the grounds manager, and agree to the following: • The plant must be the same as the one to be replaced. • A suitable substitute plant may be allowed if the original plant is on the List of Prohibited Plantings in the Design Guidelines or if the grounds manager suggests a substitute plant. The homeowner will bear all costs associated with the replacement of the plant and agrees to maintain the plant for a period of one year, at which time the Association will assume responsibility for the plant. No Homeowner or resident may plant, mow, clear, fertilize, apply pesticides to maintain, alter or modify any area not owned by the Homeowner - including areas set aside as open space or preserve - without prior approval of a written modification application. Without limiting the foregoing, residents are reminded that certain portions of the Common Area are subject to restrictive covenants as required by the U.S. Army Corps of Engineers, and such covenants prohibit clearing, trimming and other forms of disturbance of the natural vegetation and grade. These prohibitions are carried through in the Declaration, and residents must abide by these provisions and applicable law.

D. Lawn and Property Maintenance 1. General Maintenance

The use of solid plastic sheeting or polyethylene over ground areas is not permitted. If landscape fabric is used, it must allow the free flow of water, air, and gases to and from the soil. Homeowners are responsible for mowing and maintenance of all turf and landscaping within any Private Fenced Area. for maintaining their fenced in areas in a neat and orderly manner so as not to create an unsightly or unsafe condition of any kind. In addition, Homeowners are responsible for the maintenance of all hardscape, plants and planting beds added to their property. The Community-wide Standard for landscape maintenance is described in the following paragraphs. If a Homeowner fails to adhere to these standards, the Community Association may assume the landscape maintenance (including watering from the Homeowner’s external hose bib) and charge the Homeowner for this maintenance through a Benefitted Assessment, and such other remedies as the Community Association may pursue. Mowing of turf within the fenced area of the property shall be conducted by the Homeowner as needed. In the spring and fall months, increased mowing is recommended at a shorter length to reduce stress on the grass. Walks within fenced areas must be swept or blown free of grass clippings and kept free of weeds. Walkways, and planting beds within fenced areas shall be kept edged and weed free to maintain a neat appearance. 2. Mulch

Homeowners may replace pine straw with brown double hammered hardwood mulch in all planting beds. 3. Irrigation

Watering, aeration and lime are not included with the general maintenance. Irrigation systems not installed at the time of original house construction require modification approval. 4. Pruning

Pruning of trees must be in accordance with nursery standards. Tree topping, which leaves limbs and branches greater than one-half (1/2) inch in diameter exposed, is not permitted. Trees should be spot pruned during the growing season to promote shaping, thinning and to remove branches that interfere with nearby improvements or pedestrian traffic. Trees within the property lines of a dwelling unit should be pruned to remove dead, damaged or crossing branches in an effort to develop the natural form of the tree. Dead or diseased trees must be removed or trimmed as soon as discovered to protect against the spread of disease. Sun City Carolina Lakes Design Guidelines: Approved: December 21, 2021

5. Additional Tree Regulations

Trees that have been removed may be replaced to maintain the appearance of the lot as approved by the MC. A Homeowner may not cut down or remove any tree that is greater than six (6) inches in diameter [measured twelve (12) inches from the ground] without the approval of the MC. Shade trees must have at least two (2) inch caliper when planted. 6. Additional Planting Bed Requirements

Modification requests shall be submitted for approval for the planting of all trees, whether in new or existing planting beds. Annuals, perennials and shrubs may be planted in existing planting beds without a Modification Request, providing no species are on the ‘LIST OF PROHIBITED PLANTINGS’ (Appendix “H”), and comply with all other provisions in these guidelines. Plants in front of windows may be no higher than four feet. Crepe Myrtles are considered to be trees, not bushes. Trees and shrubs proposed for planting beds near property lines or adjacent to a dwelling unit must be no closer than half the diameter of the mature spread of the plant material. If a tree will spread to twenty (20) feet, it must be ten (10) feet from the house or property line. Trees will be no taller than thirty (30) feet at maturity. If the lot size and shape permit, trees that will exceed thirty (30) feet in height may be proposed as long as the spread of the tree does not extend beyond the property lines. Beds on the side of all yards may be expanded but shall be no closer than five (5) feet from the side property line or three (3) feet from the centerline of a swale, whichever is less. Landscape planting beds between the garage and the front entry walk may be expanded to include all the area enclosed by the walkway. Front planting beds installed by the developer on the “outside” of the entry walk shall not be expanded. Landscape modifications including hardscape, benches, and fences are prohibited in the front yard. Planting beds may be placed around utility boxes in the front yard of a dwelling but the center line of plants must be no closer than three (3) feet from the box(es). A Homeowner can only request plantings on their side of the property line. The Homeowner who planted the material is

responsible for the maintenance and replacement if disturbed by the utility company accessing the box. Plantings are prohibited at streetlight poles, mailboxes and street trees.

E.

Accessories The MC reserves the right to limit the number of decorative elements (as defined below) on homeowner property. 1. Fountains, Water Features and Gas Fireplaces

Fountains, water features and gas fireplaces require MC approval. Fountains and water features shall be permitted in the front beds and the rear private area and gas fireplaces shall be permitted only within the Rear Private Area. One (1) fountain or water feature shall be allowed in front beds and shall be limited in height to four (4) feet. Fountains and water features in the rear private area are limited to up to four (4) feet in height. Any fountain shall be of natural material, color and design, compatible with the overall architectural theme of Sun City Carolina Lakes. The Homeowner is responsible for maintaining any water feature or fountain in such a way as to prevent the buildup of stagnant, odiferous, or mosquito infested water at all times. Gas fireplaces shall be limited in height to eight (8) feet above the natural grade of the lot. Wood burning fires and fire pits are prohibited. 2. Decorative Components

As used herein, decorative components shall be items not of landscaping or planting material. Decorative components shall include, but not be limited to, clay, masonry, metal, or wooden objects including birdbaths, animals, gnomes, cutout objects. Unless mounted on a pole or post, artifacts may not exceed four (4) feet in height. Artifacts do not include flowerpots, which are described in Sub-Section 3 below. Decorative components in both the front and rear of the dwelling unit, such as statues and artifacts, shall be limited two (2) feet by four (4) feet in width and depth and a height of four (4) feet above the natural grade of the lot at the proposed location of the component. Decorative components are allowed in planting beds, on decks, patios and porches.

Unless specifically restricted below, the Homeowner is allowed three (3) decorative components in the front and five (5) in the rear Private Area. Decorative components located on a covered outdoor space or a covered front entryway are not included in the allowed number of items. Homeowners are allowed one (1) small decorative garden flag within the front planting bed in addition to the allotted number of decorative components. A “garden flag” is defined as a decorative fabric displayed on a frame, staked into the ground, in the planting bed of a residence nearest the front door. Garden flags shall not exceed twelve (12) by eighteen (18) inches. The design of the garden flag is limited to floral or seasonal themes, religious or national holidays, military branch, team logo, or the U.S. Flag as defined in the U.S. Flag code. No other messages or designs are acceptable. Plastic statuary and yard ornamentation, except for holiday decorations, will not be allowed. One wind chime per property shall be allowed. Inflatable decorations are not allowed. Statues and artifacts will be allowed specifically as described below: No ornaments or statuary shall be attached to the home without the prior written authorization of the MC. Exception: seasonal decorations as outlined in Article VI.E.6. All decorative components shall be in good taste. No offensive items will be allowed, including, but not limited to, items that are sexual or violent in nature, or that present a safety hazard. The MC reserves the right to determine if statues and artifacts are contrary to good taste and consistent with general community standards, and the MC may order the removal or prohibit the installation of statues or artifacts found to be contrary to these Guidelines. There shall be no stand-alone flagpoles allowed on residential lots. For the purpose of this section, an “American Flag” shall refer to the national flag of the United States of America as defined in the U.S. Flag Code. One (1) flag mount may be attached to the face of the residential structure if the mount is secured to a wooden stud or anchored in masonry. No part of the flag may extend four (4) feet beyond any eave. The only flag that may be displayed on the flag mount is the American flag, except for Sun City Carolina Lakes Design Guidelines: Approved: December 21, 2021

college and professional team flags on game day. Proper flag etiquette should be observed when flying the American flag. 3. Pots and Planter Boxes

Up to three (3) pots and/or planter boxes compatible with the overall architectural theme of the home will be permitted in the front of the home. Pots/planter boxes located on a porch or front entryway are not included in the allowed number. Private Areas in the rear of the lot may contain up to five (5) additional pots and/or planter boxes. If the open patio area has been increased to at least 200 square feet, a total of nine (9) pots and/or planter boxes are allowed. Planter boxes are limited in size to four (4) feet long by two (2) feet wide by two (2) feet high. Potted plants may not exceed forty-eight (48) inches in height from the planting medium to the top of the plant. Pots should be similar in color and shape. Pots and/or planter boxes are not to be placed in turfed areas. Note: Prior written approval for the placement of pots is not required. However, the MC reserves the right to exercise the authority granted by the governing documents to refuse non-permitted types of pots or pot placement. 4. Feeders and Bird Houses

Up to one (1) bird house/feeder not exceeding the roof eave in height may be permitted in the front yard area. No more than two (2) bird houses/feeders are permitted in the Rear Private Area. The number of bird houses on any lot may not exceed three (3). Bird houses/feeders may be mounted on posts or poles; installation on perimeter walls and under/on house eaves is not permitted. Multiple bird dwellings, e.g., bird coops, are not permitted. Bird house posts and poles must be placed in a mulch bed. 5. Posts and Poles

Poles and posts may be used to display artifacts decorative items, flower pots, bird feeders and bird houses. Up to two (2) posts and/or poles may be mounted in the rear Private Area of the lot. One post or pole may be mounted in the front bed of the dwelling unit. Posts and poles may be of wood, fiberglass or metal either straight or similar to a shepherd’s hook design. Pressure treated posts shall be painted white or stained a natural color. Metal poles may be left “as built”. The height may not exceed eighty-four (84) inches from the ground to the top of post or pole or the Sun City Carolina Lakes Design Guidelines: Approved: December 21, 2021

top of the item mounted. Post and poles may not exceed 2-inch diameter for metal or 4 inches by 4 inches for wood. Any flowerpots hung from a pole or post will be included in the total number of pots allowed. All poles and posts must be located in a planting bed and properly maintained, cleaned, painted and in good condition. 6. Seasonal Décor

Seasonal statues, artifacts, lighting and other decorative landscaping items may be allowed within thirty (30) days prior to, and fifteen (15) days after a holiday season. At the sole discretion of the MC, this time period may be extended due to extreme weather conditions. During such extended period, lighting may not be illuminated. Inflatable decorations are not allowed. 7. Mailbox

There shall be no landscaping or yard art at the mailbox at any time. No permanent decorating or ornamentation of mailboxes is allowed. The only permitted items at the mailbox are the landscape service designation flag(s). Replacement numbers must be of the same style and color as the original. Replacement mailbox assemblies (Carolina style) can be obtained from Ornamental Specialties (704-821-9154When replacing the mailbox assembly, the USPS recommends the box be 41” to 45” from the road surface to the floor of the mailbox and the box should be set back six (6) to eight (8) inches from the curb. From time to time, the CA may approve participation in awareness campaigns to raise money for certain charitable organizations. During the one-month period of these drives, bows and/or ribbons may be purchased and displayed on mailboxes to show support. At the end of the one-month period of the campaign, all bows and ribbons must be removed. Mailboxes may be decorated in a holiday theme during a time period consisting of thirty (30) days prior to and fifteen (15) days after the holiday season.

F.

Yard Fences and Gates 1. Placement and Installation

If not provided by the developer, fences shall be allowed solely within the rear yard portion of the Private Area that is: a) in lines extended from the Sun City Carolina Lakes Design Guidelines: Approved: December 21, 2021

two (2) predominant outermost side walls of the home as originally constructed and b) no less than six (6) feet from the rear of the Private property line. No fences are permitted in front or side yard areas. No fence may exceed forty-eight (48) inches in height. Side fences must run parallel to the extended sides of the house. Right angles at corners are preferred, but other angles will be considered where the rear property line or a dominant feature such as a retaining wall run at a different bearing than the rear face of the house. The rear fence line must be a straight line from corner post to corner post. Fences must be placed at least three feet from and not cross any swale. No wall or fence may be constructed that is in conflict with the established drainage pattern for the lot. On sloping terrain, the top and bottom rails of all fence sections shall be parallel with the slope. The bottom of the pickets of any fence must be no more than two (2) inches above the finish grade of the lot. See Appendix “C” for examples. Fences proposed for placement within twenty (20) feet of a retaining wall must be certified by a professional engineer as required at Article VI.A.1 Fences are not permitted around HVAC units. Homeowners are responsible for all maintenance of the yard within the fenced area. Lawn maintenance and pet clean up, where applicable, must be performed at least once a week. All yard fences must be of approved black aluminum tubular design conforming to Appendix “C”. “Puppy” fencing (double picket spacing on lower portion of fence) is allowed. No scroll work, twists, or logos are permitted. A site plan showing fence alignments must be submitted for approval prior to construction in accordance with the review procedures hereof. Landscape plans that have the effect of creating a “living fence” (e.g., hedges) outside the area eligible for walls or fencing as described above are not permitted. 2. Gates

Fenced areas in the rear yard may contain no more than 2 gates. Gates must be the same style in material and appearance of the fence. Arch style gates are permitted. See Appendix “C” for examples of acceptable gates.

3. Invisible Fencing

Invisible fencing may be used for the restraint of pets. All wiring must be buried no less than eighteen (18) inches inside the Homeowner’s property line. No alterations of the yard grade shall be permitted for the installation of such system. The Community Association shall not be responsible for repair to any system that is damaged by normal maintenance of the yard by the Community Association or their designee. Regardless of the method of restraint used, pet owners must conform to Lancaster County leash laws and are responsible for assuring that their pets do not run free. Pet owners are liable for any damage to persons or property caused by their pets.

G.

Walls 1. General Specifications

Walls shall be allowed solely within the rear yard portion of the Private Area. Walls must be between the two predominant outermost sidewalls of the home as originally constructed. No wall may exceed thirty-six (36) inches height. Attached structure (columns) may be up to 48”. If the wall is on sloping ground, the measurement is taken from the uppermost surface, i.e., patio or planting bed, to the top of the wall. A site plan showing wall details, elevations, alignments and materials (including color) must be submitted for approval prior to construction in accordance with the review procedure hereof. Walls and fence locations will be reviewed by the MC on a case-by-case basis. 2. No Alterations to Original Walls

No alterations, changes, or additions will be allowed to walls and/or fences provided by the developer for any Dwelling Unit or Common Area. No wall or fence shall be constructed that is in conflict with the established drainage pattern for the lot. 3. Height

On sloping terrain, the top of all sections shall be level. The wall segments must step down in equal increments not to exceed eight (8) inches per segment, adjusting to the changing grade.

4. Materials

Approved material for walls includes brick, cultured/natural stone, or faced/finished masonry block. No wall shall be constructed that interferes with existing drainage patterns. All walls must consist of mortared, cemented, or interlocking blocks. Natural stone or masonry may be utilized to contain and raise plant material in areas where this will not impact the drainage. It is subject to review by the MC. Mortar or other outdoor adhesive shall be used.

H.

Screens 1. Privacy Screens

If not provided by the developer at the time of construction, privacy screens will be allowed solely within the Rear Private Area. Privacy screening may enclose a maximum of two sides of a deck or patio area. No privacy screen shall be allowed in front or side yard area. No privacy screen may exceed seventy-two (72) inches in height. All privacy screens must have ninety-degree (90º) corners and run parallel as well as perpendicular to the primary wall surfaces of the home as originally constructed. On sloping terrain, the top and bottom sections shall be level. The privacy screen segments must step down in equal increments per segment, adjusting to the changing grade. The bottom of a privacy screen must be no more than two (2) inches above finished grade of the lot. A privacy screen shall not be constructed if it conflicts with the established drainage pattern for the lot. Note: Privacy screens must be free standing and a maximum of two pieces in a straight line, not to exceed twelve (12) feet, when not abutting a deck or patio. Approved materials for a privacy screen are white vinyl, cedar, or treated wood. Refer to Article V.B.1.f. for standards for wood. Wood privacy screens may be painted white or left natural and maintained. Refer to Article V.B.1.g, “Decks, Patios, and Seat Walls” for guidance on privacy screens on those elements. 2. Netting on Golf Course

For homes located on or near the golf course, protective netting is prohibited.

I.

Trellises and Arbors 1. Trellises

Trellises consist of a frame of latticework used as a screen or as a support for climbing plants. See Appendix “D” exhibits 3 and 4 for examples. Approved materials for trellises are powder coated steel, vinyl, treated wood, cedar or aluminum. Trellises in front of house must be either black or white. Trellises in the rear private area may be white, black or earth tones. An unpainted cedar trellis may be used only in the rear private area of the home. Refer to Article V. B.1.f.. One (1) or more trellises may be installed within an approved planting bed. Trellises may be placed on the sides of dwelling units, or within a planting bed between the front walkway and side of the garage. They may not be placed in the front bed facing the dwelling unit’s street. The location of each trellis must be submitted to the MC for all trellis applications. Each section of trellis must be separated by a gap, at a minimum distance of not less than two (2) feet. The total width of these trellises may not exceed eight (8) feet. Each trellis must be designed to support plant or vine growth. Trellises must remain plumb, level, and structurally sound. Trellises may not be used as substitutes for a fence. Please see Appendix “D” for an example of a typical trellis. A trellis may be used to screen a deck or patio. If so, the height may be greater than six (6) feet, but may not extend above the eaves. 2. Arbors

One (1) arbor may be installed in the rear Private Area and must be structurally sound and in accordance with local building codes. Arbors may not be attached to the home nor exceed eight (8) feet in height, four (4) feet in width, and four (4) feet in depth. The arbor must be designed to support plant or vine growth. All arbors are different; approval will be on a case-by-case basis by the MC. Please see Appendix “D” for an example of a typical arbor. No covers of any type are permitted on arbors.

Trash Containers Only containers for trash or recyclable materials originally furnished at the time of purchase of the home or provided by the waste management company servicing the properties within SCCL are permitted. No other trash containers are permitted. All trash containers shall be covered containers and shall be stored in the garage of each unit. Bags other than large paper bags made for recycling yard waste at the curb are not allowed. Boxes shall be broken down for pick up. Care shall be taken to ensure that all contents are secure when placed at the curb to prevent any items or content from being displaced or moved out of the recycling container. Trash containers may be left out for collection at dusk on the day prior to collection and must be returned to storage in the garage by dusk on the day of collection.

K.

Signage (Residences) Per the CC&Rs, Sec. 10.1, Signs “no signs shall be erected, placed or displayed within the Properties”, except those required by law and specifically referenced below. “No Soliciting”, electronic dog fence, and security/alarm notifications are limited to placards or stickers not to exceed eight by nine (8x9) inches in size, placed on the front door or door frame or in a window near the front door, or within the mulch bed nearest the front door of the residence. All such signs must be maintained in good condition. Directional “For Sale” street signs, not to exceed 36” x 24”, may be placed either on accommodating residents or common space property during each day of a SCCLCA sponsored “Community Open House” which is defined as the planned collaborative efforts of SCCL Chartered Committee personnel and realtors with active listings at SCCL. During open house days, realtors and residents attempting to sell their house may place directional signs two hours prior to the beginning of open house hours and removed no later than one hour after the end of the open house period. Signs that are clearly part of a holiday display, that contain no social or political commentary, are allowed. Refer to Article VI.E.6. (See also Table IX.H describing a uniform standard for the construction and display of signage on Association property for Association situations.)

L. Exterior Lighting All changes or additions to exterior lighting are considered modifications and require a modification application. Changes or replacement of exterior light fixtures should conform to the original architectural designs as closely as possible. Low voltage and decorative lighting are allowed only within the Private Area and planting beds of residential lots. Junction boxes and other lighting hardware shall be installed in a planting bed, placed below grade, or screened by landscape material to minimize daytime visibility. 1. Low Voltage and/or Solar Lighting

Low voltage and/or solar light fixtures may be used for low level path lighting, up lighting, down lighting and landscape architectural accent lighting. Path lights should be of the same general shape, color, size, and style and installed uniformly. (See Appendix “M” for examples.) Treemounted down lights shall be shielded from the street and neighbors’ view. Fixtures must be black, silver, or brushed bronze and blend in with the landscaping of the home. Lighting shall be installed in planting beds, not in sodded areas. Fixtures may not exceed eighteen (18) inches in height and spaced no less than three (3) feet apart. Fixtures shall be located and aimed carefully and shall not constitute a nuisance or hazard to any Homeowner or neighboring resident. The light emitted must be constant, solid light; no blinking or flashing lights. Colored lamps and bulbs are not permitted. A lighting layout plan for low voltage/solar fixtures shall be submitted to the MC for review and approval. The submission shall include a plan of existing landscaping and hard surface locations, proposed light fixture locations, and manufacturer and light type. 2. Decorative Lighting

Exterior fence, building or deck mounted lighting fixtures, including spotlights, floodlights, lantern lights and stair lights shall conform to the architecture of the home. Light fixtures shall be designed to enclose the lamp bulb. No lighting shall be permitted that constitutes a nuisance or hazard to any Homeowner or neighboring resident. Security lights, spotlights, and floodlights may be installed above the garage door or in the rear private area only. position. Lighting cannot encroach into neighboring property, creating a hazard or nuisance. Installation of automatically operated security lights, spotlights, and floodlights shall include the additional ability to operate them manually. Colored lights are not allowed. Seasonal lighting is permitted for illumination during a time period consisting of thirty (30) days prior to and fifteen (15) days after the holiday season. Seasonal lights may be installed between November 15 and January 15 but may only be illuminated as stated above. Should extreme weather conditions become a factor in removal of seasonal lights within the designated time frame, the MC shall have sole discretion to grant an extension of the allowable time period for removal. Seasonal lighting and electrical cords shall be located so as to not interfere with driveway snowplowing or sidewalk snow removal operations. Only battery-operated luminaries are permitted. Wax candle luminaries are prohibited.

M.

Swimming Pools and Spas Swimming pools and spas shall be of the in-ground type with the exception of above ground spas not exceeding three (3) feet in height above the existing grade level at the location of the pool or spa. Such spa must be adequately screened from street view and the view of any neighboring property, common areas and the golf course. All swimming pool and spa equipment shall be screened from street view and view from neighboring property. Swimming pools and spas must be constructed entirely within the Rear Private Area. All swimming pools and spas shall be fenced for safety as required by applicable law and installed according to Lancaster County ordinances. The MC may require additional plant materials to be planted to screen the swimming pool or spa from neighboring properties. Homeowner is responsible for maintenance of planting materials for screening of pools and spas. Please refer to Miscellaneous Elements, Article V.B.1.k. for equipment screening requirements. Swimming pool and spas must drain into the sanitary sewer. No swimming pools or spas may be drained onto the golf course, open space or any other property. Note: Lancaster County requires that prior to draining, all water treatment chemicals must be neutralized.

Barbecues/Grills Built-in and portable barbecue or grill units shall be for cooking only and must be located within the Rear Private Area. Location must be carefully planned to minimize smoke or odors affecting neighboring properties. All barbecues/grills must be located at least four (4) feet from any wall of the residence. All outdoor barbecues/grills must be natural gas, liquid propane, or charcoal. Outdoor wood burning is prohibited except at approved Community events.

O. Prohibited Structures Pursuant to the Declaration and/or these Design Guidelines, the following structures shall be prohibited from use in Sun City Carolina Lakes: • • • • • • • • • • • • • •

Video Cameras/Surveillance Equipment The installation of video cameras/surveillance equipment and motion lights is considered an alteration of the exterior of the buildings. Approval for installation of video cameras, surveillance equipment and motion lights will only be given upon consideration of its effect on neighbors’ right to privacy and quiet use and enjoyment of their property. Whenever possible the cameras and lights shall be placed in the least intrusive or visible location. Applications for installation of cameras and lights must include a plot plan showing the location of cameras and lights in relation to neighboring structures;

specify the size, shape, angle of view; and include a photograph and/or drawing of the camera(s) and light(s) prepared by the manufacturer. A doorbell camera may be installed without modification approval on the front door but only as a replacement for the front doorbell button. Any other use or location of a doorbell camera requires MC approval.

VII. VILLAS A.

Overview The Villas at Sun City Carolina Lakes are homes constructed and sold by the original developer to satisfy the desire of some 55+ active adults to live in Sun City without the concerns of maintaining a detached single-family home. The Villas were constructed in groups of buildings, sharing common walls, with the objective of requiring minimal maintenance by the buyer. The purchase terms of the Villas include maintenance of much of the ‘outsides’ of the building by the Sun City Carolina Lakes Community Association (the CA). The terms of the services are spelled out in the Villas Supplements to the Declaration of Covenants, Conditions, and Restrictions (“CC&Rs”). Alterations may be allowed to Dwelling units at the Villas with the approval of the MC. A Homeowner requesting an alteration assumes responsibility for any maintenance and/or repairs that may arise as a result of the alteration. These Villa Design Guidelines are a supplement to the Master Association Guidelines, contain separate, additional rules and regulations relating specifically to the Villas. Only exceptions to the Master Association Guidelines are contained herein.

B.

Alterations to Dwelling Units Any changes to the exterior of a Dwelling Unit are subject to prior MC approval. Roof vents, radon mitigation systems, light tubes, and penetration of the siding for stove vents or utility access will be considered on a case-by-case basis. A homeowner requesting such alterations must be aware that the homeowner assumes responsibility for any maintenance and/or repairs that may arise as a result of the alteration. Radon mitigation systems may be Fast Tracked. Mitigation systems must be installed by a certified radon mitigation company and the system placed in the garage. End units should be vented out the side, on the rear half of the unit, where possible, and interior units through the roof, whenever possible.

Patios Patio extensions are subject to review by the Modifications Committee (“MC”). Once an application has been received, the MC will make a determination as to how far the patio may be extended. This may vary based on existing landscaping, lot size, and lot grading. Pavers and concrete patio extensions cannot extend beyond the partition fence line.

D.

Driveways and Sidewalks Driveways and sidewalks may not be altered in any way from the original constructed design. This includes but is not limited to painting, staining and or pavers.

E.

Plantings within the front planting bed Replacement of the developer-installed plants is the responsibility of the Villa owner. These plants may be replaced on a one-for-one basis without a modification request, using the plants listed below. Plantings of other shrubs or perennials require a modification request. No plants shall exceed three feet in height at maturity. Annual flowers may be installed without a modification request. Plantings on the side of the Villa Planting on the side of a Villa is reviewed by the MC on a case-by-case basis. Allowable plantings will be governed by the amount of available space and mowing access. End Villas may submit a request if they border common open space.

H.

Mulch in Villas The only mulch allowed in any bed not in COS in the Villa neighborhoods shall be brown shredded hardwood mulch.

I.

Satellite Dish Satellite Dishes must be installed on the roof or under the eave on the back corner of the home depending on the type of dish. Additional information is listed on the satellite installation form. The form should be completed and returned to the property management company within 10 days of the date the satellite dish was installed. The installer must sign the installation form. Any roofing damage within the area where the satellite dish was installed is the sole responsibility of the Villa owner.

J.

Screen Rooms/ Sunrooms/Lanai The addition of screens and/or windows to the existing covered lanai is allowable, subject to approval of the MC. In allowing a screen room to be enclosed, the CA will no longer be responsible for the maintenance of the siding within your sunroom. A lanai cannot be added to any Villa.

K.

Railings Railings within the Villa neighborhood are subject to review and approval by the MC. Railings may be installed on the back-patio slab or around a deck and must blend in with the existing product.

L.

Yard Art Yard art is defined as any man-made item. One piece of yard art is permitted within the front planting bed only. A small decorative garden flag is not considered yard art and is not counted as a piece of yard art. See Master Association Guidelines for size limitations.

M.

Edging Edging is not allowed in the bed between garages.

N.

Hose Holders in Villas Hose holders are allowed on the home adjacent to the hose bib as long as the holder is attached in the small “L” shaped area next to the garage where the bib is typically located. Such installation does require modification approval.

Unit Owner Responsibilities Repairs to and replacement of exterior light fixtures, windows, doors (including garage doors) and screening on a Dwelling Unit are the responsibility of the Homeowner. Replacement of any of the above components is subject to prior approval of the MC.

VIII. CARRIAGE HOMES A. Overview The Carriage Homes at Sun City Carolina Lakes are condominium homes constructed and sold by the original developer to satisfy the desire of some 55+ active adults to live in Sun City without the concerns of maintaining a detached single-family home. The Carriage Homes were constructed in groups of buildings on two floors, sharing common walls, with the objective of requiring minimal or no exterior maintenance by the buyer. The master deed terms of the Carriage Homes include maintenance of the physical “insides” (structure) of a unit by the Carriage Homes Condominium Owners’ Association (“COA”), the legal entity that holds title to and operates the property on behalf of its owners. The ‘outsides’ of the buildings and neighborhood are governed by the Sun City Carolina Lakes Community Association (the “CA”). The Master Association Design Guidelines, approved from time to time by the Board, contain extensive information about restrictions applicable to all dwelling units on the properties. These Carriage Homes Design Guidelines, also developed by the Board of Directors of the Association as a supplement to the Master Associate Guidelines, contain separate, additional rules and regulations relating specifically to the Carriage Homes.

B. Architectural Character Article 4 of the Master Deed of Carriage Homes at Sun City Carolina Lakes Horizontal Property Regime defines each unit to include that part of the building which lies within the following boundaries: •

Horizontal (Upper and Lower) Boundaries - the horizontal boundaries of each Unit shall be the planes formed by the unfinished interior surfaces of the floors and ceilings of the Unit.



Vertical Boundaries - the parametrical or vertical boundaries of each Unit shall be the planes formed by the unfinished interior surfaces of the perimeter and interior load bearing walls of the Unit.

Common Elements consist of all portions of the Condominium not located within the boundaries of a Unit. It is important to note that each Owner and the Association may use the Common Elements for the purposes for which they are intended, but no such use shall hinder or encroach upon the lawful rights of the other Owners. As noted in the Master Deed, Unit Owners and the Association have the right to control the use and enjoyment of the Common Elements as provided by the terms of this Master Deed. C. Architectural Control Article 13.1 of the Carriage Homes Master Deed gives the Master Association sole and exclusive architectural control, power and jurisdiction over the exteriors of the buildings, structures, or improvements. The Carriage Homes Association, and not any Unit Owner or Owners, shall have the right and power to request approval of proposed changes, or additions to the Building exteriors which includes all portions of each Building that can be seen from any point outside the building, including those portions of the Building which may be seen through windows or other openings, as well as parts and components of the Building structure which will or may affect the exterior appearance of the Building if altered or modified. Article 13.2 of the Master Deed gives the Carriage Homes Association certain architectural authority and standards. No owner, occupant or any other person may make any encroachment onto the Common Elements or Limited Common Elements, or make any addition or change, alteration, or construction on or to any of the Common Elements, or any portion of the Unit which provides any structured support to or for any other Unit or any portion of the Common Elements without first obtaining the written approval of the Board. Written approval shall be required in every case. Any and all modifications to the Common or Limited Common Elements require a modification approval be submitted to the Master Association Modifications Committee (MC).

D. Court Yards Pots/urns made from traditional garden materials are encouraged. Up to five (5) pots and/or planters may be placed in the Courtyard. Potted plants, including any stands, may not exceed the height of the black aluminum fence. Pots must be similar in size, color and shape. Plantings shall not overhang the sidewalk. Other items that may be placed in the Courtyard include: • •

One (1) piece of natural art, not to exceed the height of the black aluminum fence. One (1) bench, maximum length no greater than four (4) feet OR one (1) table and two (2) chair ensemble. G. Flag Rules The only flag to be flown is the American flag, except for team flags on game day. For the purpose of this section, an “American Flag” shall refer to the national flag of the United States of America as defined in the U.S. Flag Code • • • •

In ground plantings of any type. Lights in turf areas. Wind chimes, birdbaths, or bird feeders Fountains and/or decorative accessory requiring electrical or solar source to operate. Hanging baskets or other decorative accessory appended to, placed on or hanging from any common area (gates, brick columns, siding or fences between courtyards). Plastic or other artificial flowers (except for door wreath or door decoration). Vegetable or fruit plantings of any kind with the exception of herbs. Accessory additions or vines that are permitted to climb, affix or lean against any building, siding or wall in the courtyard. Painting of any concrete entryway or walkway.

I. Other Responsibilities of a Unit Owner Each Unit Owner assumes complete responsibility for maintaining any additions, including but not limited to water of any plantings, pruning, removal of dead plants, and maintaining the area in a neat condition. All items placed in court yards or along the sidewalks of end units MUST be removed at the time of a sale of the Unit.

All hoses and watering devices must be neatly coiled AND contained when not in use and stored indoors from December through February. Personal property may not be stored in the courtyard. Carriage Homes Appendix A – Vertical 4-Track Windows For owner-installed limited common elements, the owner of the unit served is responsible for maintenance and all costs of the improvement. (Master Deed, Sec. 17.1.) Thus, if an owner installs a Vertical 4-Track Window, that owner is responsible for ensuring that they are installed correctly, and for any maintenance costs associated with the installation or ongoing maintenance. If the installation damages the building or damages another owner’s unit, then the installing owner is responsible for the costs. The Master Association, Sun City Carolina Lakes Community Association (SCCLCA), has architectural approval rights over the exterior of the Carriage Homes. The Carriage Home Board of Directors must seek approval from the SCCLCA Master Board of Directors before any exterior improvements are made to the Carriage Homes. The sale/transfer of title of a unit the EZ Breeze would either have to be removed or a signed "agreement" that all liability/responsibilities would transfer to the new owner.

IX.

COMMUNITY ASSOCIATION COMMON AREAS & AMENITY FACILITIES GUIDELINES The following Guidelines govern the maintenance and operation of the Common Area (including Limited Common Area), Neighborhood Facilities, and Recreation Facilities, including the amenities centers.

A.

Architectural Character The physical structures constructed by the developer and conveyed to the Community Association shall be maintained and/or replaced by the Community Association utilizing the same or similar design size, location, style structure, materials, color and architecture.

B.

Landscaping 1. Association Responsibility

The Community Association shall be responsible for the maintenance of the landscape corridors, medians, and other common area. The Community Association shall maintain the landscaping required to be maintained by the Community Association under any Supplemental Declaration which may be adopted by the Board of Directors of the Community Association creating a Limited Common Area Expense or Neighborhood Expense without materially changing from the original design. 2. Common Areas

All Common Areas at build out, where not built upon or paved (and unless included in a wetland or other natural area) will be landscaped. Landscaping shall extend to the back of the curb on all adjacent street sides of the site. 3. Density of Plant Material

The minimum density of plant material shall depend upon the size of the site and the extent of the landscaped area. There shall be an appropriate amount of specimen sized trees (at maturity) and shrubs. Ground shall be covered with a combination of inert and living materials. Inert materials shall include the materials described in Appendix “G” of these Design Guidelines.

4. Paved Areas

All areas paved for pedestrian traffic such as walkways, plazas, and courts shall be a hard surface material with limited vertical irregularities. 5. Prohibited Plantings

The plantings allowed in Sun City Carolina Lakes were selected after consideration of several factors. A list of the prohibited plantings is set forth in Appendix “H”. 6. Non-obstruction of Views

All landscaping shall be designed and maintained so as not to interfere with the view of any ground signs on the site or adjacent properties, and not to obstruct the view of traffic entering, exiting, or passing by the site. 7. Transition from Adjoining Area

Where the landscaping of a new project is to adjoin an existing landscaped area, the new landscaping shall include an appropriate transition between the two areas.

C.

Ancillary Equipment All community heating, ventilation, and air conditioning equipment, ancillary mechanical equipment, radio and television transmitting and receiving antennas, trash receptacles, and similar appurtenances shall be screened from general view from neighboring properties, all residential areas, pathways, open areas, golf courses, parks, and streets. Roof-mounted units are permitted with screening where the screen is integral with the building forms and materials.

D. Site Development 1. Fences and Walls.

Fences up to six (6) feet in height (or higher if required by Lancaster County or a utility) may be used to screen and create privacy between the commercial or institutional developments, streetscape and the residential areas of the Community. Such fences must be constructed of materials described in Appendix “C”.

2. Building Setbacks.

All building setbacks shall conform to the criteria set forth in Paragraph 1 of Appendix “A”. 3. Drainage.

Site drainage will conform to the drainage analysis performed for the platted property.

E. Lighting All lighting installed by the developer on Common Areas, or installed by the Community Association, shall comply with any applicable local, state or federal law. No lighting which causes unreasonable glare to neighboring owners, neighborhoods, or the Common Area will be permitted; provided, however, the Community Association may maintain lighting on, in or around tennis courts, bocce courts, pickle ball courts, parking lots, Recreation Centers, Common Areas, Limited Common Areas, Neighborhood Areas, and other areas where such lighting is necessary or appropriate for the use and enjoyment of the community or for health and safety reasons.

F. Temporary Facilities Temporary structures shall be allowed to be placed on Common Areas by or with the permission of the Community Association. There shall be no other temporary private facilities on Common Areas.

G. Flagpoles The Community Association may install flagpoles and flags at the Amenity Centers, the entrances to the community, and on any other Common Area. American Flags flown or displayed anywhere on Association property must be as defined in U.S. Flag Code. The POW-MIA flag and the South Carolina State may be flown from Association flag poles.

H. Signage (Association Property) The Association shall be allowed to install any sign(s) necessary or desirable for purposes connected with Association activities. I. U.S. Flags at Pod Entrances Up to two U.S. Flags, as defined in the U.S. Flag Code, may be displayed from a pole(s) in a bracket(s) mounted on the post of the pod name sign. Brackets shall be similar to those used to mount a flag on a house. Bracket may be either single or double holder. Poles shall be no more than five (5) feet in length and the dimensions of the flag shall be approximately 2 and one half (2.5) feet by four (4) feet. Flags may be flown at any time in keeping with proper flag etiquette. Flags and brackets are the responsibility of the pod. One flagpole up to 20 feet in height may be installed at a pod entrance on national holidays when a flag would typically be flown (July 4, Memorial Day, Labor Day, etc.). The pole shall be aluminum, with a plain ball top and silver in color. The pole shall be mounted in a concrete base three (3) feet deep and one (1) to two (2) feet wide. The concrete base shall be flush with ground level so as not to impede mowing and the hole must be capped when not in use. Utilities must be marked prior to digging for the base installation. The ONLY flag allowed to be flown shall be the U.S. Flag, as defined in the U.S. Flag Code. This flag shall be between 3 X 5 feet and 4 X 6 feet in size. The flagpole and attached flag may only be displayed on the holiday. It shall be erected the morning of and removed at sunset of the holiday. An approved modification request is required prior to any work on the base being done. The person submitting the request shall be the point of contact and shall be responsible for maintaining the flag and pole in good condition as well as any other issues that may arise regarding the flagpole.

ENFORCEMENT OF INSTRUMENTS Article IX of the Declaration describes the scope of authority of the Community Association, including the review and determination of alleged violations of Homeowners and Residents, execution of certain remedies, and recommendations to the Board of Directors of the Community Association for further action. The Community Association may execute certain remedies as provided for in Article IX of the Declaration. The Modifications Committee is not an enforcement agent. It makes recommendations to the Board of Directors on alleged non-compliance with the Guidelines. The following paragraphs are provided for information purposes.

A. Non-compliance by Homeowner Article IX, Section 8 of the Declaration describes the Community Association’s right to require the Homeowner to remedy any instance of non-compliance. The specifics of the remedies and timeline for correction are found in the Community Enforcement Policy (CEP). The CEP can be found on the Covenants Committee page of the SCCLA website. All costs incurred by the Association to bring the noncomplying Homeowner into compliance, including the cost of the work and interest, shall be charged to the Homeowner as a Benefitted Assessment. Homeowners in violation of the flag, signage and inflatable decoration guidelines, including signs or flags found to be offensive, that create a safety hazard or that adversely portray SCCL will be notified by email and/or in writing. Management will contact the owner by phone and/or email if the owner’s contact information is on file, as well as by mailing a copy of a non-compliance letter. The notification shall alert the owner of the flag/signage/inflatables violation and ask the owner to remove the flag/sign/inflatable within 48 hours from the time of email or letter notification, whichever is earlier. Should the owner not comply with the removal in the 48-hour window, the Association reserves the right, through its managing agent, to enter the property and take down the flag/sign/inflatable pursuant to Article IX, Section 9.8 of the Declaration. The items removed will be stored at the association office for the owner to collect. If not collected in 30 days, the sign/flag/inflatable will be destroyed.

A homeowner shall be penalized $200 for any modification completed without approval after January 1, 2019. For a modification completed prior to January 2019, which would have been approvable, or had no guidelines at the time the work was done, but is no longer approvable, or for unapproved items not reported on the presale inspection, the homeowner will receive a letter indicating that change; will Sun City Carolina Lakes Design Guidelines Approved: December 21, 2021

be allowed to remain until such time; as the change in question is repaired or replaced or until the property is sold, at which time the property must be brought into compliance with current guidelines. Any modification completed without approval, which the Modifications Committee deems to be unapprovable, will be forwarded to Compliance for further action. Any amounts invoiced to the Homeowner pursuant to this paragraph or pursuant to the Declaration as Benefitted Assessments shall be due and payable within thirty (30) days of receipt of such invoice by Homeowner. The failure of the Homeowner to pay a Benefitted Assessment levied against Homeowner is a default and could subject a Homeowner to suspension of his voting rights and the Homeowner’s or lessee of the Homeowner’s dwelling unit, rights to use the Common area(s) and the Recreation Center and such additional remedies as provided in the Declaration. The decision to suspend a Homeowner/Lessee’s rights to use such facilities will be made by the Board of Directors of the Community Association.

B. Appeal of Decision Any Homeowner, lessee, or other resident aggrieved by a decision of the MC may appeal such decision to the Board of Directors. Such appeal must be done in writing to the Community Association and can be delivered to the CA office in person or sent via E-mail. The appeal will then be considered by the Board of Directors at their scheduled meeting. The Homeowner will have the opportunity at this hearing to discuss their appeal. Once an appeal has been heard and a decision rendered, it will not be reconsidered by the MC. The final outcome will be determined by the Board of Directors. The Homeowner filing the appeal will be notified in writing of the final decision within two business days of the hearing. The Board of Directors may overrule the MC and its findings upon appeal by the Homeowner and/or owners of contiguous properties. Such overturning of the MC’s findings by the Board should be noticed to the MC as soon as possible, as an overturning of the MC’s conclusions may necessitate revision of the Design Guidelines.

XI.

CHANGES AND AMENDMENTS TO THE DESIGN GUIDELINES These Design Guidelines may be amended as follows: Changes to these Design Guidelines may be proposed by the Board of Directors of the Community Association and/or the MC. Additionally, any Homeowner may submit to

the Board of Directors proposed changes to these Design Guidelines for review and consideration by the MC. Any MC recommendation to amend the Design Guidelines shall be approved by twothirds (2/3) of MC members and be forwarded to the Board of Directors for consideration. If the Board of Directors approves the proposed revision, it shall become an amendment to the Design Guidelines. All amendments shall become effective upon adoption by the Board of Directors. Such amendments shall not be retroactive to previous work or approved work in progress. Periodically, as the MC deems appropriate, a revised manual containing all the amendments since the issue of the previous volume shall be delivered to the Board along with a list of all the changes from the previous volume. Upon acceptance of the changes by the Board, a final replacement volume shall be posted in the manner designated for community communications by the Board of Directors and copies made available at the Community Association office. Any approved work completed prior to the revised guidelines or currently approved work in progress at the time of the guideline revision will be grandfathered in the Association records. In no way shall any amendment to the Sun City Carolina Lakes Design Guidelines change, alter or modify any provision of the Declaration, any Supplement to the Declaration, or the Bylaws of the Community Association.

XII. DECLARANT’S IMPROVEMENT As part of the planning and development of Sun City Carolina Lakes, the developer prepared a development plan and provided certain architectural designs, color palettes, landscaping design packages, parks, wetlands mitigation areas, streets, model home packages, a sales pavilion, and recreation center. Notwithstanding the current provisions of these Design Guidelines, the terms of the Design Guidelines may be amended in the future by the Board of Directors.

APPENDIX I. Fast Track Modifications

1. Fast track items are those modifications that do not have to go through the Committee. 2. Items that can be fast tracked are:  retractable awning over back patio  garage door window inserts  glass inserts for front door  storm/screen door, full view. Must be white or color of the front door only  handrail at front steps  front porch entry tile  shutters  exhaust vent for microwave, dryer, cooktop  attic fan  solar tubes  solar lights (Carriage Homes only)  low voltage lighting (Carriage Homes only)  satellite dish  irrigation systems  invisible dog fencing  tankless water heater vent  4-Track Windows (E-Z breeze style)  Front Door Color Change  Gutters, Downspouts, Gutter Screens  Hose holders attached to the side of house  Shingle Replacement

3. Fast track items specific(s):  Awning color and materials are to coordinate with the color of your home; color photo must be submitted.  Garage door window inserts must be selected from the preapproved options and the choice noted on the application.  Storm door must be selected from the pre-approved options and noted on the application. [Article V.B.2.h.]  Storm doors must have a white frame or match the front door. No etched glass is allowed.  Glass inserts for front door must be selected from the pre-approved options and choice noted on the application. [Article V.B.2.a]  Tile, paint or stamped concrete for entry must be neutral in color with a photo or sample of the color submitted.  Shutters style must match those on home (either panel or louver).  Shingles must be architectural style in either Driftwood or Weathered Wood color. APPENDIX J. Guidelines for Lightning Protection Systems Lightning protection systems have specific requirements that must be met for them to operate properly. None of these requirements shall be interpreted so as to prevent the installation of a properly designed lightning protection system by a licensed and certified installer. These requirements are intended to minimize the visibility of the external, above ground parts. Residents should instruct installers to install all external parts so that they are inconspicuous and not visible from the street (with the exception of the terminals on the roof). Lightning protection systems may be installed on a home subject to the following conditions and approval by the Modifications Committee: 1.

All exterior, above ground parts shall be installed in as inconspicuous a manner as possible. Wires along the roof should be run along the back side of the ridge vent. Wires should be run behind the gutters and downspouts or behind any other available structures so that installation is not visible from the front of the home or by neighbors.

2.

For all shingle roofs, except metal, copper wire is recommended to be used.

3.

The air terminals, i.e., the lightning rods on the top of the home, should be the standard, plain 12” or 18” rods so as to minimize their footprint. Decorative terminals/rods/finials will not be approved.

4. Limited number of terminals will be approved per the standard. 5. Systems installed must comply with the guidelines established by the National Fire Protection Association (NFPA). 6. Must be installed by a licensed installer and be approved by the Lightning Protection Institute (LPI). 7. Neighbor signatures must be obtained for acknowledgement of such project. If Homeowner is unable to secure the signature of all contiguous neighbors, the Homeowner must provide justification as to why signatures cannot be obtained satisfactory to the Modifications Committee.

APPENDIX K. Schemes. Schemes are collections of specific materials, finishes, and colors that will “work together” on an individual house that in turn contributes to the “look and feel”, the “Community Wide Standard” of Sun City Carolina Lakes. There are currently 35 different schemes. A complete digital set of schemes is available upon request to the Modifications Office. Below is an example:

APPENDIX L. Posters and Collection Bins in the Lodge and Lake House a)

Posters

Minimum sizes will be at least 20" X 28"and a maximum of 24" X 36". Location of posters to be coordinated with Lifestyle Event/Marketing Coordinator Staff who is responsible for making sure the posters are not a potential trip or access hazard. Posters will be displayed for a maximum of two weeks prior to and during a scheduled event or when ticket sales are being held. The maximum number of posters will correspond with the number of designated wall space at any one time. No glass will be used in framing of posters prepared by a Club or resident. Posters must remain in their dedicated wall space. Approval by the Lifestyle Event/Marketing Coordinator is needed to move the posters. A poster on an easel may be present when money collection or ticket sales are ongoing with residents present. Clubs are encouraged to bring their own easels for use during collection/sales periods. b)

Collection Bins

A maximum of two collection bins are allowed during specific collection times. The maximum collection timeframe is two weeks. Collection bins are to be located under existing tables in the lobby and out of the general walkways as agreed to by the Lifestyle Event/Marketing Coordinator. Bins are to be emptied twice per day during the collection period making reasonable efforts to keep bins from overflowing. The Club is to provide the front desk associates with contact phone numbers so that excess donations can be quickly removed from the Lobby when bins are full. Storage of collected item must be completed in a manner not to disturb other groups using the Card Room. Residents are to be discouraged from leaving donated items if collection bins are full. c)

Number and Schedule of Collection Events

In order to avoid duplication or conflicts for collection of donations and materials, each January groups planning to use the Lake House for the collection of donations, will submit a schedule requesting times for collections. Specific dates and times will be submitted to the Lifestyle Events/Marketing Coordinator for review and approval. To the maximum extent possible there will not be two donation and/or collection events scheduled at the same time.
