Important new regulations concerning objects consisting of/including ivory As a result of EU regulations, since 19.1.2022 only the trade in „antique“ ivory (worked before 1947) and musical instruments (before 1975) is permitted, but only within the EU and only on presentation of a valid Cites document. The Dorotheum will therefore only offer objects for which such a permission to sell at the Dorotheum has been granted (marked “ASI”). It is the buyer‘s responsibility to apply for a Cites document from his/her local species protection authority, if required for his/her own purposes. The re-export of ivory, i.e. an export to a non-EU country, is generally no longer permitted. Exemptions for buyers can be granted by the authority on a case-by-case basis only for pre-1947 objects of great cultural, artistic or historical importance purchased by to museums or for pre-1975 musical instruments purchased by performing musicians. Please also consider your national import regulations. Many countries no longer allow imports or only allow them in a very restricted way, for example USA, China or Hong Kong, etc. The granting of export or import licences is exclusively subject to the free decision of the competent authorities. Aus diesem Grund erfolgen Verkäufe von Werken der bildenden Kunst, welche im Katalog besonders mit * gekennzeichnet sind, unter Hinzurechnung einer nicht rückzahlbaren Folgerechtsumlage in Form eines Zuschlages zum Meistbot. Damit nimmt das Dorotheum als Vertreter der Verkäufer die Verrechnung mit den berechtigten Künstlern, deren Rechtsnachfolgern oder deren Interessensvertretungen vor. Dieser Zuschlag beläuft sich wie folgt: 4% von den ersten 50.000 EUR, (= – 50.000 EUR) 3% von den weiteren 150.000 EUR, (= 50.000,01 – 200.000 EUR) 1% von den weiteren 150.000 EUR, (= 200.000,01 – 350.000 EUR) 0,5% von den weiteren 150.000 EUR, (= 350.000,01 – 500.000 EUR) 0,25% von allen weiteren Beträgen (= über 500.000,01 EUR), jeweils vom Meistbot. Er beträgt insgesamt jedoch höchstens 12.500 EUR und entfällt bei Zuschlägen unter 2.500 EUR.

RESALE ROYALTIES In compliance with directive 2001/84/EC Austrian copyright legislation (Urheberrechtsgesetz-Novelle 2005 as amended) implemented Artist Resale right in Austria. As a result, sales of original works of art that are marked with an asterisk (*) in the catalogue will be subject to a non-refundable royalty payment in the form of a surcharge on the hammer price. This will be used by the Dorotheum to pay the royalty due to the artist, his legal successor or the artist‘s representatives. The surcharge is calculated as follows: 4% on the first 50.000 EUR, (= – 50.000 EUR) 3% on the next 150.000 EUR, (= 50.000,01 – 200.000 EUR) 1% on the next 150.000 EUR, (= 200.000,01 – 350.000 EUR) 0,5% on the next 150.000 EUR, (= 350.000,01 – 500.000 EUR) 0,25% on all subsequent amounts (= over 500.000,01 EUR), based on the hammer price. The surcharge may not exceed 12,500 EUR and does not apply to purchases under 2,500 EUR.
