Maternity Leave What do you need to know?

What is the length of the maternity leave?

What are the situations when the length of maternity leave can vary?

The length of the maternity leave depends on the number of children the employee already has: Length of prenatal leave

Actual birth date different than due date: - If the birth takes place before due date, the total duration of maternity leave remains unchanged. The duration of prenatal leave that has not been taken is added to the postnatal leave. - If the birth takes place after due date, the number of days between due date and the actual birthdate are postponed to the end of the maternity leave. Reduction of maternity leave: the mother can waive part of her leave, but it is imperative that she stops working for at least 8 weeks in total : six of which must be taken after giving birth Carrying over: possibility to shift up to 3 weeks of prenatal leave to postnatal leave, provided that the doctor in charge of the employee gives a favourable decision (Official letter from the doctor will be required)

Salary: the employee will receive the same salary as before leaving for maternity leave. Medical Visit : it concerns only employees with reinforced medical monitoring, i.e., those assigned to a risky position (night work, chemical risk…), which may have impacts on breastfeeding. The medical visit must be organised within the 8 days after maternity leave

You are authorized to be absent to attend seven compulsory prenatal and postnatal medical examinations, paid within the limit of half-day per exam (the employee should provide a proof and notify their manager at least one week before the appointment). These 14 days are considered like pre-natal leave. What if the employee wants to end their contract during the maternity leave? The employee can terminate the employment contract without notice and without having to pay termination indemnity.
