BASE PRIMERA.PROMOCIÓN.
OBJETO

PURPOSE

1.1. Objeto de la Promoción.
1.1. Purpose of the Promotion.
El objeto de esta promoción es premiar la mejor película rodada en las Islas Canarias cuya temática sean los deportes de viento y olas y que haya sido producida por los participantes en el concurso conforme a las presentes Bases.
The purpose of this promotion is to award a prize to the best film made in the Canary Islands with the theme of wind and wave sports, produced by participants in the contest in accordance with these Rules.
1.2. Requisitos de la Película.
1.2. Film Requirements.
La película será en versión original y, en aquellas cuya lengua original no sea el castellano, con subtítulos en este idioma o con un documento adjunto que incluya todos los diálogos de la película para su posterior traducción.
The film will be in the original version and where the original language is not Spanish, it will either have Spanish subtitles or the entry will be accompanied by a document including all the dialogues in the film so they can be translated.
La película no puede haber sido presentada en anteriores ediciones del “Canarias Surf Film Festival”.
The film must not have been entered in previous editions of “Canarias Surf Film Festival”.
La duración de la película no puede ser inferior a cinco (5) ni superior a cuarenta y cinco (45) minutos. El tema principal de la película es libre, siempre y cuando haya sido rodada en las Islas Canarias y vaya en relación a alguno de los deportes de viento y olas siguientes: - Surf - Bodyboard - Windsurf - Kitesurf La película debe tener calidad mínima HD1080 o equivalente.
The run time of the film must be at least (5) minutes and no more than forty five (45) minutes. The main topic of the film may be decided by contestants, but it must have been made in the Canary Islands and be associated with one of the following wind and wave sports: - Surfing - Bodyboarding - Windsurfing - Kitesurfing The film must have a minimum quality of HD 1080 or equivalent.

BASE SEGUNDA.ENTIDAD ORGANIZADORA, ÁMBITO TERRITORIAL Y TEMPORAL Y PARTICIPANTES. 2.1. Entidad Organizadora.
RULE TWO.- ORGANISING ENTITY, TERRITORIAL SCOPE, DURATION AND PARTICIPANTS.
La entidad organizadora de la presente promoción es PROMOTUR TURISMO CANARIAS, S.A., sociedad mercantil de capital público, con domicilio en la calle Víctor Hugo, 60, 35006 Las Palmas de Gran Canaria (España) y provista de CIF A35845593, (en adelante PROMOTUR), responsable de la promoción turística del destino Islas Canarias.

Podrán participar en la presente promoción todos los usuarios, personas físicas mayores de 18 años o personas jurídicas que accedan a la página web citadas en el punto 2.2. anterior y sean cesionarios de la propiedad intelectual de la película presentada a concurso.

BASE TERCERA.- ACEPTACIÓN DE BASES.

Los participantes, por el mero hecho de participar en la presente promoción, aceptan sus Bases y el criterio de PROMOTUR en cuanto la resolución de cualquier cuestión o controversia derivada de la misma.
By participating in this promotion, participants accept its Rules and the criterion of PROMOTUR in relation to rulings on any issue or controversy arising from the promotion.
BASE CUARTA.- PREMIO.
RULE FOUR.- PRIZE.
El premio, objeto de promoción, consiste en:

- Un (1) premio por importe de cincuenta mil euros (50.000€) mediante transferencia bancaria, a la cuenta que el ganador designe en momento de la aceptación del premio, tras la publicación del resultado del concurso. PROMOTUR se reserva la posibilidad de modificar el indicado premio por motivo de fuerza mayor o caso fortuito, sustituyéndolo por otro de características y valor semejante.
- One (1) prize for the amount of fifty thousand euros (€50,000) paid by bank transfer into the account that the winner designates when accepting the prize, after the publication of the contest result.
En ningún caso, el premio podrá ser objeto de cambio y/o alteración de ningún tipo ni compensación o cesión a terceros a petición del ganador o participante seleccionado.
Under no circumstances may the prize be exchanged and/or altered in any way or redeemed and neither may it be transferred to a third party at the request of the winner or participant chosen.
BASE QUINTA.PARTICIPACIÓN.

PROMOTUR reserves the right to modify the aforementioned prize due to force majeure or unforeseeable circumstances and to replace it with another prize of a similar nature and value.

nombre, apellidos, fecha de nacimiento, sexo, e-mail, teléfono, localidad, código postal y país de residencia, razón social, así como, los campos destinados a la descripción de la película: titulo, duración, sinopsis, fecha de realización, isla/s en las que ha sido rodada, cartel promocional, tráiler y la película.
post code and country of residence, corporate name, and the fields for the description of the film: title, run time, synopsis, date the film was made, island(s) where it was filmed, promotional poster, trailer and the film.
A estos efectos, el número de teléfono se utilizará exclusivamente en caso de resultar ganador del premio para su comunicación, sin posibilidad de uso promocional o publicitario.
The telephone number provided will be used exclusively to notify the winning participant and may not be used for promotional or advertising purposes.
5.2.- Validación.

Una vez cumplimentado el formulario y aceptadas las condiciones del mismo, el participante recibirá un correo electrónico para permitir su validación como tal, que le permitirá formar parte de la presente promoción.
Once the form has been filled in and the conditions have been accepted, participants will receive an e-mail to allow them to validate their entry and enable them to take part in the promotion.
Serán expresamente excluidos los participantes que no se hayan validado, conforme a lo expresado en el párrafo anterior.
Participants who have not validated their entry in accordance with the terms of the preceding paragraph will be disqualified from the contest.
5.3.- Causas de Exclusión de los participantes.

Solo se aceptará un alta por participante y un máximo de tres (3) películas por participante.
Only one registration and a maximum of three (3) films per participant will be accepted.
Resulta contrario a la buena fe, a las presentes Bases y a los principios de esta acción promocional, el que una misma persona física se identifique en la citada Web con más de un usuario y con cuentas de correo diferentes para poder participar más de una vez.
It shall be considered contrary to good faith and against these Rules and the principles of this promotion if a single individual identifies himself or herself on the Web page indicated using more than one user name and account in order to send more than one entry.
En el caso de detectar la participación de internautas con más de un alta serán excluidos del concurso la totalidad de los participantes identificados.
When entries by Internet users who have registered more than once are detected, all such participants identified will be disqualified.

PROMOTUR designará un Jurado compuesto por cinco (5) personas de reconocido prestigio y experiencia para valorar las películas presentadas, pudiéndose ser bien de PROMOTUR o de sus agencias de publicidad o pertenecientes al sector de la industria audiovisual y de la publicidad.
PROMOTUR will appoint a Jury of five (5) well known and experienced people to judge the films entered; they may be either from PROMOTUR or its advertising agencies or from the audiovisual and advertising sector.
El Jurado seleccionará la mejor película que, a su juicio, sea merecedora del premio atendiendo a su carácter real, su originalidad, su potencial cinematográfico y su capacidad para transmitir, los valores y atractivos de las Islas Canarias o alguna de ellas, como destino turístico de viento y olas.
The Jury will choose the best film which, in its opinion, deserves the prize in view of its veracity, originality, potential for filming and ability to transmit the values and attractions of the Canary Islands, or one of the islands, as a wind and wave tourism destination.
Adicionalmente, el jurado seleccionará cinco (5) películas más, siguiendo los mismos criterios que en el caso de la película ganadora, cuyos participantes tendrán la consideración de suplentes que sustituirán al primero para los casos establecidos en la base octava.
The jury will choose five (5) more films, following the same criteria as for the winning film, whose participants will be regarded as replacements for the author of the winning film for the circumstances laid down in rule eight.
Para ello, el Jurado establecerá un orden de preferencia, del 1 al 5, entre las cinco películas seleccionadas.
For this purpose, the Jury will establish an order of preference, from 1 to 5, among the five films chosen.
El jurado se reserva la potestad de no seleccionar ninguna película o la totalidad de los suplentes por no concurrir con los requisitos establecidos anteriormente y en la base primera, declarando desierta la presente promoción.
The jury reserves the right to not select any film or any of the replacement winners if the requirements established above and in rule one are not met and shall declare this promotion null and void.
6.2. Fallo del Jurado.
6.2. Decision of the Jury.
El Jurado emitirá su fallo el día 25 de septiembre de 2016 o fecha alternativa que se establezca por el Jurado de manera motivada.
The Jury will announce its decision on 25 September 2016 or an alternative date that may be established by the Jury with due cause.
El resultado del fallo se hará público en la citada Web.
The decision of the Jury will be posted on the Web page indicated.

BASE SEPTIMA.- ACEPTACIÓN DE PREMIO. 7.1.- Tras el fallo del Jurado, PROMOTUR comunicará al participante correspondiente su condición de ganador, vía correo electrónico y/o sms y publicación a través de la web.
RULE SEVEN.- PRIZE ACCEPTANCE.
El participante ganador deberá:

7.1.- Following the decision of the Jury, PROMOTUR will inform the corresponding participant of their win by e-mail and/or sms and by posting the decision on the Web page.
c) Issue an invoice for the amount of the prize, made out to PROMOTUR TURISMO CANARIAS, S.A., where the winner is in the situation described in the final paragraph of rule nine. d) Draw up a document granting authorisation for the recording of his or her name, voice and image in accordance with rule twelve and send it to PROMOTUR.
Todo ello, en el plazo improrrogable de 10 días naturales a contar desde la última fecha de comunicación recibida, incluida la publicación en la web de referencia.
This must be done within a non-extendable period of 10 calendar days from the date the last communication is received, including the posting of the decision on the corresponding Web page.
7.2.- Transcurrido dicho plazo sin aceptación y/o acreditación correcta de los extremos antes indicados, el participante perderá su condición de ganador del premio y se procederá a comunicar ésta condición al suplente (o, en su caso, suplentes sucesivos, en el orden establecido por el fallo del Jurado). En este caso, así como en los sucesivos, se seguirá el mismo procedimiento establecido anteriormente.
7.2.- Once this period has elapsed and the winner has not accepted the prize and/or adequately complied with the foregoing, the participant will no longer be considered the winner of the prize and notice will be sent to the replacement winner (or, where applicable, successive replacements, in the order established in the decision of the Jury). In this case and successive cases the same procedure established above shall be followed.
BASE OCTAVA.RÉGIMEN SUPLENCIA DEL GANADOR.
RULE EIGHT.PROCEDURE FOR NAMING A REPLACEMENT WINNER.

d) Renuncia del ganador al premio objeto de concurso.

e) Constatación de que la película presentada no concurre con lo establecido en la base primera 1.2. y 1.3.
e) If it is proven that the film entered in the contest does not comply with the terms of rule one 1.2. and 1.3.
f) Constatación de fraude o irregularidades por parte del ganador conforme a lo establecido en la base décima cuarta.
f) If it is proven that the winner used fraudulent or irregular means in accordance with the terms of rule fourteen.
En caso de que ninguno de los sucesivos suplentes concurriese con los requisitos establecidos para ser considerado como ganador, PROMOTUR declarará desierta la presente promoción.
If none of the successive replacement winners meets the requirements established to be considered a winner, PROMOTUR will declare the promotion null and void.
BASE NOVENA.- FISCALIDAD.
RULE NINE.- TAXATION.
Al premio de la presente promoción, le será de aplicación la legislación fiscal española (entre otras, la Ley 35/2006 de 28 de noviembre por la que se aprueba el Impuesto sobre la Renta de las Persona Físicas y de modificación parcial de las Leyes sobre los Impuestos de Sociedades, sobre la Renta de no residentes y sobre el patrimonio; el Real Decreto nº 439/2007, de 30 de marzo, por el que se aprueba su Reglamento y sus modificaciones posteriores; el Real Decreto Legislativo 5/2004, de 5 de marzo, por el que se aprueba el texto refundido de la Ley del Impuesto sobre la Renta de No Residentes, así como su

Para ello, PROMOTUR podrá solicitar al ganador documentación acreditativa de la residencia, incluido certificado de tal circunstancia o cualquier otra adicional que estime conveniente a estos efectos.
For this purpose, PROMOTUR will ask the winner for proof of address, including official certification or any other proof it considers appropriate to this end.
En caso de que el ganador resulte ser una productora/distribuidora o cualquier otro empresario, cuya actividad consista en la producción o distribución de películas, el premio satisfecho se calificará como renta de actividad económica, conforme a la legislación española de aplicación.
If the winner is a producer/distributor or any other business person whose economic activity is producing or distributing films, the prize paid will be classified as income from economic activity in accordance with the applicable Spanish legislation.
BASE DÉCIMA.- PROTECCIÓN DE DATOS. En cumplimiento de lo establecido en la Ley Orgánica 15/1999, de 13 de diciembre, de Protección de Datos de Carácter Personal y en la Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Información y Comercio Electrónico, el envío voluntario de los datos personales (incluido el correo electrónico) para participar en la presente promoción implica el consentimiento expreso del participante para que PROMOTUR TURISMO CANARIAS, S.A., por sí misma o a través de otras entidades que lleven a cabo la gestión o tramitación de los datos, a la inclusión de sus datos en un fichero del que es titular PROMOTUR TURISMO CANARIAS, S.A., y a que los mismos sean utilizados con la finalidad de la Promoción del Destino Turístico Islas Canarias, a través de comunicación directa.

PROMOTUR pone en conocimiento de los usuarios que el ejercicio de estos derechos es personalísimo, por lo que únicamente el propio usuario podrá ejercer dichos derechos respecto de los datos personales de los que es legítimo titular. BASE DÉCIMA PRIMERA.- EXENCIÓN DE RESPONSABILIDAD POR MAL FUNCIONAMIENTO DE LA RED.
RULE ELEVEN.- EXEMPTION FROM LIABILITY IN THE CASE OF INTERNET MALFUNCTION.
PROMOTUR queda exonerada de toda responsabilidad en caso de mal funcionamiento de la red Internet, o incorrecta transmisión de contenidos, que impida el normal desarrollo de la promoción por causas ajenas a la empresa y especialmente por actos externos de mala fe.
PROMOTUR shall be exempt from all liability in the case of malfunction of the Internet or incorrect transmission of contents that prevents the normal functioning of the promotion due to causes beyond the company’s control and in particular due to external malicious acts.
BASE DÉCIMA SEGUNDA.- DERECHO DE PROPIEDAD INTELECTUAL DE LAS PELICULAS Y UTILIZACIÓN DE LA IMAGEN DEL GANADOR.

El ganador de la presente promoción cede los derechos de propiedad intelectual sobre la película ganadora para su reproducción, distribución y comunicación pública con fines promocionales y publicitarios del destino Islas Canarias, sin exclusividad, sin limitación territorial alguna y para cualquier lugar del mundo y en cualquier tipo de soporte o medio, incluido internet y las redes sociales, a partir de la fecha de la aceptación y durante 15 años, todo ello, a título gratuito. La película ganadora deberá contener una referencia a la concesión del premio de la presente promoción y en todas y cada una de las copias de la película que se distribuya para su exhibición, así como, en el material promocional de ésta.
The winner of this promotion assigns the intellectual property rights pertaining to the winning film so that it may be reproduced, distributed and publicly communicated for the purposes of promoting and advertising the destination of the Canary Islands, on a non-exclusive basis, with no territorial limitation and for any place in the world and on any type of storage device or medium, including the Internet and social networks, from the date of acceptance for a period of 15 years, entirely free of charge. The winning film must contain a reference to the awarding of the prize for this promotion and this reference must appear on each and every copy of the film distributed for exhibition and on the promotional material for the exhibition.
El ganador autorizará a PROMOTUR a la captación de su nombre, voz e imagen, a resultas del premio concedido, bajo la premisa de una planificación previa comunicada a éste.
The winner authorises PROMOTUR to record their name, voice and image as a result of the prize awarded, based on a schedule previously communicated to the winner.
A estos efectos, el ganador se compromete a la formalización de la citada autorización y a su envío a PROMOTUR dentro del periodo establecido en la base séptima. Los participantes de la presente promoción ceden los derechos de propiedad intelectual sobre las películas presentadas a concurso para su reproducción durante la edición del “Canarias Surf Film Festival 2016”.

En el caso de que PROMOTUR, o cualquier entidad que esté ligada profesionalmente a la presente promoción, detecte cualquier anomalía o sospechen que la participación o la acción de un participante está impidiendo el normal desarrollo de la participación en la presente promoción, alterando de manera irregular o ilegal mediante cualquier procedimiento, técnico o informático, para así distorsione o falsear los resultados, podrá de forma unilateral eliminar su participación del mismo.
If PROMOTUR or any entity professionally associated with this promotion detects any anomaly or suspects that the participation or the action of a participant is preventing the normal running of this promotion by tampering with or illegally altering any technical or computer procedure in order to misrepresent or falsify the results, the participant will be unilaterally disqualified from participating in the promotion.
