THE NEW YORK CITY BOARD OF CORRECTION sent out an SOS last week in the form of a press release. Staff at the BOC, a nine-member board that provides oversight of correctional facilities across the city, found themselves suddenly cut off from accessing body cam videos and similar footage. These are the videos taken by small cameras attached to Department of Correction staffers while inside those facilities, including the notoriously dangerous Rikers Island. The department “forbade the recording and use of such video in our work,” the board wrote. It reminded in this release that its staff serves as the “Board’s ‘eyes and ears’ inside the jails, working to evaluate complaints, review incidents, and make recommendations for compliance with the Minimum Standards for confinement.” Without access to these videos, the board’s oversight will be greatly diminished. The department’s decision, likely prompted by recent reports that included video from inside Rikers, was certainly ill-advised. I don’t have to remind anyone of the benefits of greater transparency, especially when the department has so much to be accountable for with the ongoing problems at Rikers. A department spokesperson said it was “deeply committed to transparency,” and explained the shift in access as a protocol change that still leaves the board to watch all camera footage in “real time” at a designated location. That doesn’t sound like it’s making transparency any easier. The agency still needs to reverse its decision and let the board’s staff continue its much-needed work.

New York City Mayor Eric Adams visited the southern border to continue to call attention to the influx of migrants and asylum-seekers, and call for aid from the federal government to house, feed and serve people who end up in New York. Some 40,000 people have arrived in New York City since Adams has been mayor, a number he says has significantly strained many of the city’s resources. Adams said “Our cities are being undermined,” according to The New York Times, as he called for the federal government to foot the entire bill to care for migrants. City Comptroller Brad Lander criticized the trip and the rhetoric, saying it made immigrants seem like “a problem.” Several days after returning from the border, Adams set out again, this time to Washington, D.C., to urge them to act. He described the influx of asylum-seekers to cities like New York as one of the most consequential

ABORTION MEDICATION COMING TO MORE CLINICS

New York City will begin paying for abortion medications to be provided at four city clinics in the Bronx, Manhattan and Queens, the mayor announced last week

as part of an initiative to improve women’s health care. The medications are already available in the city’s 11 public hospitals. With an emphasis on breaking the silence around vaginas, periods, menopause and more, the mayor noted that women statistically are diagnosed with an illness later than men, and that vaginal conditions are misdiagnosed the majority of the time.

Does Clean Slate have a chance this year? Advocates and people who want to see old criminal records sealed are hopeful the Clean Slate bill will garner fresh support this legislative session, but the path to passing the bill may not be so easy. The bill, sponsored by state Sen. Zellnor Myrie and Assembly Member Catalina Cruz, would seal the criminal records of many people convicted of certain felonies or misdemeanors (not including sex offenses) once they became eligible – three years after the imposed sentencing for misdemeanor crimes and seven years for felonies – presuming they refrain from committing additional crimes. While the bill has been popular among progressive lawmakers since it was first introduced in 2020, it has never passed both chambers. Last year, there was optimism after Gov. Kathy Hochul explicitly mentioned the bill in her State of the State address. The state Senate passed the bill last session, but the bill did not progress in the Assembly. This year, after a bruising reelection battle, Hochul did not mention Clean Slate in her State of the State. And a change in the makeup of a key Assembly committee may not be favorable in getting the bill passed this time around. After Democrats lost a few Assembly seats to Republi-

cans in the last election, Republicans also gained a seat in the Codes Committee, which deals with criminal justice issues. Supporters said the bill will allow people who have served their time to be able to access job and housing opportunities; while critics argued a person’s criminal history should be on the record to prevent them from reoffending. In response to pushback last session, the bill’s sponsors have made some changes that would allow certain entities, such as some levels of law enforcement and the state Education Department to have access to a person’s sealed criminal records. Records would remain sealed from private employers, for example. Advocates, state lawmakers and formerly incarcerated people held a rally at the state Capitol and called for the passage of the latest version of the bill. In a statement to City & State, Cruz said, “We had significant support last year, that will only increase once we finalize amendments to the bill.” When asked whether the latest changes to the bill  would compromise the integrity of the legislation, Cruz said they were actively working with the state Education Department, business and law enforcement. – Shantel Destra

BY THE NUMBERS More than 4,300 vacant city positions were eliminated in the mayor’s latest financial plan.

With tens of thousands of unfilled government jobs and precarious economic headwinds, New York City directed its agencies to eliminate half of the vacant city-funded full-time positions in a bid to help find savings in the budget. Mayor Eric Adams’ administration and some fiscal watchdogs have characterized some of those vacawnt roles as unnecessary. Adams said taking them off the books would allow agencies to focus on hiring for the over 20,000 critical vacant positions still remaining. Adams’ preliminary fiscal year 2024 budget offered a look at how agencies went about making those reductions. Here’s a look at the numbers.

What is your headspace going into your first year as chair of the Assembly Health Committee? The committee has got a much larger volume of bills than any of my previous committees. The issues are ones that I’m familiar with – but not as familiar as I need to be. So it’s currently feeling a little overwhelming. But, at this point, I am just going day by day and learning as much as I can as quickly as possible. So hopefully that initial overwhelming feeling will go away. Former Assembly Member Richard Gottfried was chair of the Health Committee

for many years. Did Gottfried pass on any advice to you after you were appointed chair of the committee? I have Dick Gottfried on speed dial, so that the advice keeps coming. (The advice) is very specific when I need it to be and general when I need it to be. He’s just been a great ally and friend. He’s been very helpful during the transition, and I know he will continue to be. What are you hoping your legacy as chair of the Health Committee will be? Currently, I come in with some priorities that I want to address, such as maternal mortality,

passing my aid in dying bill and ensuring that during my tenure as health chair, I remain a protector of everyone’s right to have quality health care in whatever way that manifests. The New York Health Act (to provide universal health coverage) was a big priority for Gottfried. What is your perspective on the bill? Do you have plans to sponsor the bill? I am planning on sponsoring the New York Health Act. I’ve always been an advocate for it, and I hope that we can advance it at some point.

The bill has struggled to get passed in years prior, so how do you plan to do that? It has struggled in the past. There’s opposition to it. I pride myself on being someone that can bring all parties to the table. I know there’s opposition that needs to be resolved. I plan on trying to do that. You were chair of the Assembly Corporations, Authorities and Commissions Committee. Did your appointment to the Health Committee come as a surprise to you? It was something I was looking forward to. I asked the speaker to consider me as the chair. I loved the

corporations committee, and I would have been happy to continue doing that, but this is an opportunity that I didn’t want to pass up. What lessons or experiences from the corporations committee are you now going to lean on as you lead the health committee? I’ve always had an open door policy with all legislators to help them advance their legislation as corporations chair, as energy chair before that and as children and families chair before that – and I will have that same open door for this committee. – Shantel Destra

‘The nomination was lost’

The state Senate Judiciary Committee rejected Hector LaSalle, opening the door for a constitutional crisis.

has a constitutionally mandated obligation to perform a full vote on her nominees. Chaos briefly broke out immediately following the vote when ranking member state Sen. Anthony Palumbo, a Republican, attempted to make a motion to move LaSalle’s nomination to the floor of the state Senate. Hoylman-Sigal gavelled the hearing out before Palumbo could finish talking, drawing loud yells and boos from supporters of LaSalle in attendance. “How dare you?” one supporter yelled at the Democratic senators, while another specifically called on to state Sen. Jessica Ramos to “do the right thing.” The vote came after almost five hours of questioning LaSalle on his record and judicial philosophy to gauge his qualifi-

cations to lead the state’s highest court. “What looms over this hearing, though, isn’t just what we do here in Albany, it’s Washington, D.C.,” Hoylman-Sigal said at the start of the hearing. “Some people think we are applying an exacting standard at this hearing. We are, because we have to.” Legislative leaders and Hochul have vowed that New York would safeguard rights rolled back by the conservative U.S. Supreme Court, which included appointing judges who will uphold those rights in the state. LaSalle, a former prosecutor who currently sits on the Second Department Appellate Court, would be the first Latino judge to lead the Court of Appeals – and his nomination process has brought the

N A HISTORIC FIRST in New York, a panel of lawmakers rejected Gov. Kathy Hochul’s nominee to lead the state’s top court. By a narrow 10-9 margin, members of the state Senate Judiciary Committee voted not to advance Justice Hector LaSalle to the full Senate, opening the door for a potential legal challenge from Hochul. Ultimately, LaSalle received the goahead of all six Republicans on the Judiciary Committee, as well as Democrat state Sen. Jamaal Bailey, who all voted to advance without recommendation. State Sens. Luis Sepúlveda and Kevin Thomas gave their recommendation. Ten Democrats, including the chair of the committee, state Sen. Brad Hoylman-Sigal, voted against LaSalle. After the rejection, state Senate Majority Leader Andrea Stewart-Cousins confirmed that LaSalle’s nomination was dead and that she would not give him a floor vote. “The committee has spoken, the nomination was lost,” Stewart-Cousins told reporters. Even in the face of a potential lawsuit from the governor, she said she will respect the decision of the Judiciary Committee. “The Senate has rules about how things get to the floor,” Stewart-Cousins said. “And our rules dictate that we go through committees, and … if the committee does not advance something, it does not go to the floor.” Hochul expressed disappointment in the rejection of LaSalle, but did not yet say whether she would go through with a lawsuit to force a floor vote. She has already retained outside counsel for the expected legal battle over the nomination. “While this was a thorough hearing, it was not a fair one, because the outcome was predetermined,” Hochul said in a statement after the vote. “Several Senators stated how they were going to vote before the hearing even began – including those who were recently given seats on the newly expanded Judiciary Committee.” She reaffirmed that she believes that the Senate

Many prominent Latino elected leaders have cried foul as they have observed unprecedented opposition to the candidate. However, LaSalle faced intense backlash over a number of decisions he joined during his decade on the bench, many of which featured prominently in senators’ questions. Many senators focused on one case in particular in which LaSalle and his fellow appellate justices allowed a defamation lawsuit from Cablevision to move forward against individual union members – who are usually protected from legal action from their employers. “How can you expect union members to do their jobs if at any moment they could be sued in their personal capacity?” asked state Sen. Sean Ryan, a Buffalo-area moderate Democrat who was considered a swing vote

before the hearing. “Looking at law as policy, how does that not have a chilling effect on all unionization efforts in New York state?” Ryan, who shares a hometown with the governor, ultimately voted “no” on LaSalle. Throughout the hearing, LaSalle defended himself against what he called mischaracterizations and misinterpretations of his record. He explicitly stated his support for both unions and reproductive rights – another criticism he had faced due to a decision that limited the scope of a subpoena in an investigation into a crisis pregnancy center. “Like every judge, I know that not everyone agrees with every ruling,” LaSalle said in his opening remarks. “But I can promise you that in every case, I have sought and will continue to seek to give everyone their fair shake, to listen to arguments carefully, to work my best to apply the laws and facts before us and to work with my colleagues to reach a just and fair result.”

Back in a New York groove After a lackluster presidential bid, U.S. Sen. Kirsten Gillibrand just had her most productive session yet. By Sahalie Donaldson

T’S BEEN NEARLY a decade and a half since Kirsten Gillibrand vowed to lead the fight against gun violence after meeting with the parents and classmates of a Brooklyn high school student who had been shot and killed. It was a pivotal moment for the U.S. senator. Gillibrand, who had been in office for two weeks at that point and campaigned for the House in 2008 as a gun rights supporter, emerged from Nazareth Regional High School in 2009 promising to end illegal gun trafficking. Since then, Gillibrand has become a federal leader in the fight to curb gun violence. She has written op-eds, said she’s proud that her “A” rating from the National Rifle Association dropped to an “F,” rallied with families and introduced legislation to crack down on interstate gun trafficking. “I started working on that the day I was appointed,” Gillibrand said in an interview with City & State. “We’ve really kept a focus on if you

want to improve public safety, you need to get guns out of the hands of criminals.” Last summer, those efforts paid off. Her legislation was included in a major bipartisan gun control package that passed in June. Under the law, New York prosecutors for the first time charged four people in January with illegally selling guns in Brooklyn. Gillibrand’s recent successes didn’t end with the passage of the gun trafficking bill. In fact, she described the previous congressional session as the most productive of her career. She had several other successes that had been long in the making, including overhauling how the military responds to sexual assault and other crimes, additional benefits for veterans who’ve been exposed to toxic burn pits and ensuring that people who experience sexual harasment at work are allowed to seek legal recourse. “She’s a great partner for New York, and she’s always delivering and looking out on how she can help average New Yorkers,” U.S. Sen. Chuck Schumer said. “She understands the people who need help.” Several of her supporters attributed these policy wins to Gillibrand’s behind the scenes relentlessness, describing it as a testament to how she’s learned to skillfully navigate the Senate. New York’s junior senator has come a long way since she was selected to succeed Hillary Clinton in January 2009 as an upand-coming upstate representative. Now, Gillibrand is one of the leading voices fighting against sexual harassment and sexual assault in the military as well as a top advocate for women’s and family rights. Her leadership political action committee Off the Sidelines has raised around $11.1 million in support of hundreds of candidates. “A lot of times women are not recognized for kind of keeping their head down and doing the work behind the scenes, but what she is doing is building the bench for other women,” said Yvette Buckner, a political strategist and co-founder of Adams Buckner Advisors. “That’s so important because so many times, many governments don’t pass the torch to a woman, they pass it to another man or a protege.” Despite her clear national ambitions, as demonstrated by her failed 2020 presidential bid, Gillibrand said she was going to run for reelection on Jan. 12. It appears unlikely that she’ll be unseated since no clear challengers have emerged at this point, although

some political consultants have speculated whether a progressive challenger like Rep. Alexandria Ocasio-Cortez could win the seat. There’s no real track record to go on because she has never been seriously challenged to date – either in Democratic primaries or otherwise – as a senator. Others said Gillibrand was too focused on national issues and has, at times, seemed less connected with New Yorkers as a result – particularly when compared to U.S. Sen. Chuck Schumer. Still, it’s nearly impossible to out-New York Schumer on local issues, and he’s had almost 20 more years than Gillibrand to build his reputation. For him, there’s no Sunday press conference too small, and no county too far to visit. And that may mean some of her work has been overshadowed. form the military justice system date back a decade. She has long argued that permitting military officers to lead investigations into allegations of sexual assault and other felonies discouraged thousands of victims from reporting crimes. Recognizing that she’d need to get bipartisan support to change anything, Gillibrand worked with Republican U.S. Sen. Joni Ernst of Iowa, a combat veteran, and eventually got her support for the bill. She said going on a trip to Afghanistan with Ernst, for example, was vital to building trust with each other so they could tackle military sexual assault. After years of what Gillibrand described as gradually wearing down her opponents with data and information, Congress voted in December to pass legislation to make independent investigators responsible for looking into allegations of sexual harassment and assault, instead of military commanders. Gillibrand notched another big policy win last year when lawmakers approved a workplace reform that moves allegations of sexual harassment and sexual assault out of closed forced arbitration hearings and into court. Gillibrand partnered with Republican U.S. Sen. Lindsey Graham of South Carolina to first introduce the bill in the Senate during the rise of the #MeToo movement in 2017. The bill also works retroactively, freeing tens of millions of peo-

ple who may have been prevented from taking legal action in the past. “It didn’t get a lot of notice, but that is a seismic shift in the rights and privileges of survivors of sexual assault and sexual harassment,” Gillibrand said. President Joe Biden also signed the PACT Act, another military-related bill backed by Gillibrand, that expanded medical benefits for veterans who were exposed to toxins from burn pits while deployed at military bases. “You wouldn’t really think a young senator from New York would be pushing so hard for some of the things in the military, but she’s kind of chipped away at some of these big bucket issues, not just on women’s issues,” said Amelia Adams, a veteran political consultant and co-founder of Adams Buckner Advisors. While she’s perhaps most often associated with women’s rights, Gillibrand has championed a broad spectrum of issues. She co-sponsored the 9/11 first responders bill. She’s among a handful of lawmakers who’ve been at the forefront of supporting the crypto industry, working with Republican U.S. Sen. Cynthia Lummis of Wyoming to craft legislation that supporters believe will set the tone on how the federal government regulates the crypto industry. Pointing to her own experience as a work-

ing mother of two young sons, she made fighting for paid family and medical leave one of her keystone issues. In working with Republicans, it probably doesn’t hurt that early in her career Gillibrand represented a relatively conservative House district and espoused more moderate and conservative views. And she hasn’t shied away from talking about her ideological evolution. “I just think I was new and young and not as sophisticated as I needed to be,” she said. “And I’ve certainly shown my views and my values strongly over the past 15 years.” She also frequently attends bipartisan prayer breakfasts, Bible studies and is a member of the congressional softball team. “People love to see that evolution. I think it resonates because so many of us are always evolving,” Buckner said. “To be able to admit that maybe I didn’t have the right position or maybe it wasn’t something that I knew enough about, but now I’m going to change and become an advocate, that’s a really strong quality we want to see in our elected officials.” Gillibrand is also the first New Yorker to serve on the Senate Agriculture Committee in around 40 years. She’s currently involved in crafting the 2023 farm bill, in which she’s looking to establish better insurance programs for farmers and change dairy pricing. “I think that she has been willing to educate herself about a wide range of issues that impact people in New York state,” said Tracy Mitrano, a former upstate Democratic congressional candidate who was supported by Gillibrand. “The stereotype is that it’s all about New York City and I don’t see her like that.” Gillibrand backed Mitrano in 2018 and 2020 after they met at a state rural conference. Mitrano recalled being struck by the senator’s commitment to helping farmers despite many of them being unlikely to support her politically. “She cares about things that are not sexy and maybe don’t always give her the greatest advantage with donors,” Mitrano said. “Having said that, people who know her appreciate and support her.” A NATIONAL PROFILE When Gillibrand announced her run for president in 2019, she entered the crowded Democratic primary field with a hefty war chest. Her feminist messages were

initially met with a blitz of excitement. But what had at first seemed like a promising bid puttered to a lackluster end, after she dropped out eight months later having failed to make a dent in the polls. Patti Solis Doyle, a Democratic strategist, told Politico at the time, “I don’t think the fact that she was talking about equal pay, sexual assaults in the military, or reproductive rights turned off any Democratic voters. I just think no candidate can only be focused on one gender.” Gillibrand said her campaign also included platforms on health care, education and jobs, but the media largely honed in on women’s rights and the other topics didn’t get covered as much. Despite failing to gain much traction, Gillibrand speaks positively today about her presidential campaign, even though she said she has “no ambitions for another presidential run right now.” She said she emerged from the experience a more confident speaker, a better leader and with a more ambitious policy perspective. She even tied it to her string of recent successes in the Senate. “I think it’s one of the reasons why I’m being so prolific and so effective in getting things done,” she said. Political consultant Hank Sheinkopf said her mix of policy priorities has partly been crafted out of necessity from the projects and issues that Schumer doesn’t focus on. “She cut her own special place which could not be taken from her,” Sheinkopf said. “There will be those who will criticize her that her real intention was to run for president of the United States, which she did and failed miserably at, but nobody can take the #MeToo movement away from her nor her battle to change the universal military code of justice.” HER FUTURE Gillibrand said she’s confident she’ll be reelected. She has about $4.4 million in cash on hand. Whether she’ll need that money to fend off a progressive challenger or a competitive Republican candidate remains to be seen. Ocasio-Cortez just filed to run for reelection, Rep. Ritchie Torres said he won’t challenge Gillibrand and former GOP Rep. Lee Zeldin hasn’t indicated what post he might run for next. The money may also serve as a deterrent, in addition to some of the most powerful politicians in New York being in her corner. Gillibrand was one of the earliest sup-

porters of then-congressional candidate Kathy Hochul. Little did anyone know that the former Erie County clerk would become governor a decade later, and she’s now a powerful supporter in return. “Gillibrand is a champion for all New Yorkers, leading the charge for fairness and equality, and she is an incredible role model for women in leadership,” Hochul said in an emailed statement. “When I first ran for office, she was one of the first to step up and help. I’m proud to work with her and to count her as a true friend.” New York City Mayor Eric Adams also gave Gillibrand some credit, saying in an emailed statement that the senator has “shown up and fought on behalf” of New Yorkers time and again. He described her as a reliable advocate on a range of matters, including pushing for federal funding to help New York handle the influx of asylum-seekers. For Schumer, he has been a fan from the beginning. She in turn said he has been a mentor and supporter throughout her career. It’s not easy to carve out a political legacy beside someone like Schumer. The Senate majority leader casts a long shadow. While Gillibrand is perhaps best known for tackling national issues and Schumer is often praised for visiting the state’s 62 counties every year, Democratic strategist Camille Rivera strongly disagreed with any perceptions that Gillibrand isn’t entrenched in New York issues. She did acknowledge though that the senator is sometimes careful about diving into local political issues. “Given her unconventional path to becoming a senator, I think she’s definitely proven herself as someone who has done right by New York,” Rivera said. “I just don’t think she’s as noisy about it so to speak. … Everybody does their work differently.” WHAT’S HER LEGACY? Perhaps more than anything else, Gillibrand will likely be remembered for what she’s done for women – both in political circles and with voters. “If women in all stages of life don’t get involved and fight for what we want, plans will be made that we may not like, and it’ll be our own damned fault. I think about this everyday,” Gillibrand wrote in “Off the Sidelines: Raise Your Voice, Change the World,” her 2014 memoir. “It’s true at every level, from the Capitol to your city’s

town hall to your neighborhood school. We need to participate, and we need to be heard. Our lives, our communities, and our world will be better for it.” Gillibrand has built on that idea in the years since. She was an early supporter of the 21 in ’21 initiative, which was aimed at electing at least 21 women to the New York City Council by 2021. She has also boosted the election efforts of hundreds of other Democratic women across the country through her political action committee. Gillibrand said mentoring women and helping them stoke their own political ambitions has been one of her most rewarding endeavors. Assembly Member Sarah Clark, one of Gillibrand’s first Senate staff members of more than 10 years, remembered how the senator helped quell her fears about running for office when she considered running for Assembly District 136. “A lot of women don’t run for office be-

The two women entered Congress in the same year and quickly bonded over their similarities. Clarke’s mother, Una Clarke, and Gillibrand’s grandmother, Dorothea “Polly” Noonan, had helped inspire them to enter politics. Years ago, Noonan and Una Clarke had gravitated to each other and formed a bond “as women standing up in the political space,” according to Yvette Clarke. “I think her legacy is going to be one of women’s leadership – one that really fights for women’s rights and brings gender balance to the work that we do in a male-dominated profession,” Yvette Clarke said.

new york rypto The industry is trying to right itself after a price collapse and plenty of controversies in 2022. By Peter Sterne

E

ARLY LAST YEAR, the cryptocurrency industry was still flying high. A single bitcoin was worth about $40,000, major cryptocurrency companies like Coinbase, FTX and Crypto.com ran ads during the 2022 Super Bowl featuring major celebrities encouraging viewers to invest in crypto. New York City’s newly elected mayor took his first three paychecks in bitcoin and talked up the industry at every opportunity. And cryptocurrency mining companies lured by cheap electricity prices upstate were flocking to New York. A year later, things look very different. Bitcoin is worth about $20,000, and the mayor has mostly stopped talking about it. FTX filed for bankruptcy, and its charismatic founder (and major political donor) Sam Bankman-Fried is under federal indictment for allegedly defrauding customers. And the state Legislature has passed a new law limiting the ability of cryptocurrency mining companies to take over upstate power plants. The future of the cryptocurrency industry in New York has never been less certain. But to figure out where the industry is going, we first have to understand how it got here. MINING MORATORIUM By design, mining cryptocurrencies like bitcoin require an astronomical amount of computing power and consume large amounts of electricity. The high electricity consumption is not just a side effect of bitcoin’s protocol; it is the very source of bitcoin’s value. Bitcoin relies on a “proof-of-work” mining system, which means that new bitcoins are awarded to computers known as “miners” that solve impossible mathematical equations. The only way for the computer to solve them is through random guesses. When a miner does happen to randomly stumble upon the correct solution, they receive a small amount of bitcoin as a reward. For some time after bitcoin was initially introduced in 2009, it was possible for ordinary users to mine bitcoin using their home computers. But the equations have gotten increasingly difficult over the years, and it now requires entire data centers full of mining hardware to have any real shot at successfully mining bitcoin. Now, bitcoin mining is largely the domain of professional cryptocurrency mining companies, which raise millions of dollars to finance the construction of large data centers and to purchase the large quantities of electricity needed to power their mining rigs. The increasing consolidation of bitcoin mining, and the industry’s expanding need for more electricity, has led to a curious trend – cryptocurrency companies have started buying their own power plants.

The trend started with Greenidge Generation, which in 2020 turned an unprofitable upstate natural gas plant into a dedicated mining facility. More recently, the Canadian cryptocurrency mining company Digihost acquired a natural gas plant near Buffalo, and it has plans to turn it into a dedicated bitcoin mining facility. Environmental groups have sued the state Public Service Commission, which must approve the transfer of any power plant, to try to block the sale. In an attempt to prevent more bitcoin mining companies from taking over fossil fuel-based power plants, Assembly Member Anna Kelles sponsored a proof-of-work bitcoin mining moratorium bill that was signed into law last year. The bill will prohibit the state Department of Environmental Conservation from granting or renewing the Title V air permits of fossil fuel-based power plants that engage in proof-of-work cryptocurrency mining for two years. Since power plants cannot legally operate without valid Title V air permits, this will eventually prevent fossil fuel-based power plants from engaging in crypto mining when their current permits expire. Neither Greenidge nor Digihost will be affected by the moratorium, since they already have the necessary air permits, but the bill will prevent any more plants from pivoting to crypto – at least for the next two years. The moratorium only applies to cryptocurrency mining companies that own fossil fuel power plants; miners that just buy their electricity from the grid or own hydropower plants will not be affected. In addition to imposing the limited moratorium, the law requires the department

In 2015, the state Department of Financial Services issued new regulations requiring anyone engaged in “virtual currency business activity” to apply for and receive a special state license. This virtual currency license, known as a “BitLicense,” can be difficult to obtain. Over the past eight years, only 22 entities have received a BitLicense. The cryptocurrency industry has repeatedly criticized this virtual licensing regime. In 2021, for example, the cryptocurrency news site CoinDesk published an op-ed titled, “Kill the BitLicense,” which argued that the BitLicense had prevented innovative cryptocurrency startups from flourishing in Assembly Member New York. heat waves and cold snaps.” But Greenidge soon discovered a way to monetize its electricity generation all year long. BITCOIN MINING PRESENTS LUCRATIVE OPPORTUNITY In the years after the Dresden plant restarted operations, an increasing number of cryptocurrency mining companies set up opera-

tions in upstate New York, lured by relatively cheap electricity prices. Greenidge realized that it had access to a particularly cheap source of energy, since it owned its own power plant, and began investing in bitcoin mining. Starting in 2020, Greenidge began operating the Dresden plant nearly full-time, using most of the power generated to power its own bitcoin mining rigs rather than selling it

EMISSIONS CREATE A DOWNSIDE As the Dresden plant was now running full-time rather than part-time, its total greenhouse gas emissions spiked – jumping from about 40,000 tons of carbon dioxide in 2019 to more than 200,000 tons in 2020. Environmental advocates protested, arguing that the state Department of Environmental Conservation had only authorized the operation of a part-time power plant, not a full-time cryptocurrency mining facility. The department ultimately rejected this argument. But the agency was more receptive to advocates’ claim that Greenidge’s operation of the Dresden plant could violate the Climate Leadership and Community Protection Act, a landmark climate law that the state enacted in 2019. “That’s the big change between the 2016 permit and the 2021 application for the renewal is that groundbreaking climate law passed that does not allow for emissions increases to interfere or be inconsistent with the emissions reductions in New York state,” DeRoche said. After a monthslong public

comment hearing and repeated delays, the department ultimately denied Greenidge’s air permit renewal on June 30, 2022. “Based on the information in the Application as prepared and submitted by Greenidge, as well as public comments and other relevant information, the Department hereby determines that the Facility’s continued operation in its current manner would be inconsistent with or would interfere with the attainment of the Statewide GHG emission limits,” the agency wrote in a letter explaining its decision. UNCERTAIN FATE Greenidge immediately appealed the decision, and it is currently being reviewed by an administrative law judge. If the judge upholds the state Department of Environmental Conservation’s denial of the permit, then Greenidge would likely appeal the decision in state court. Until Greenidge exhausts all of its appeals – which could take a year or more – the Dresden plant will be allowed to continue using the expired air permit. But it’s possible mining operations at the Dresden plant could grind to a halt well before that. Like other crypto mining companies, Greenidge has been hit hard by the collapse in bitcoin’s price. On Dec. 20, the company agreed to sell most of its mining hardware to NYDIG, a creditor to whom it owes $74 million, and warned investors that it may soon have to file for voluntary bankruptcy protection. Greenidge did not respond to a request for comment on this article. The company’s stock, worth roughly $15 per share in early 2022, is now worth less than $1 per share, putting it at risk of being delisted from the Nasdaq. stock exchange.

Bankman-Fried claimed publicly that he was donating to candidates who shared his passion for preventing the next pandemic, though many recipients of his largesse also happened to sit on powerful committees that could influence the federal government’s approach to cryptocurrency regulation. In particular, Bankman-Fried advocated for the passage of a bill, co-sponsored by Gillibrand, that would have classified cryptocurrencies as commodities instead of securities. This would have ensured that cryptocurrencies were not subject to the

very strict regulations placed on investment securities and the Securities and Exchange Commission’s enforcement of those regulations. Instead, the crypto industry would be regulated by the comparatively more friendly Commodity Futures Trading Commission. The legislation would also have moved congressional oversight of the industry from the House and Senate financial services committees to the chambers’ respective agriculture committees. Torres, a member of the House Financial Services Committee, told City & State that he did not support Gillibrand’s bill, since it would have taken power away from his committee. Asked whether cryptocurrencies should be regulated as securities or commodities,

WHAT’S NEXT? After the major disruptions of the past year, the future of the cryptocurrency industry in New York is more uncertain than ever. The signing of Kelles’ bitcoin moratorium bill promises to reshape the upstate cryptocurrency mining landscape. Miners may have to embrace hydropower and other renewable energy sources to power their bitcoin mining operations. Another possibility is that the industry will increasingly abandon proof-of-work mining. While proof-of-work was the original method of mining cryptocurrency, alternatives do exist. A number of newer cryptocurrencies, including Solana, use an approach called “proof-of-stake,” which uses orders of magnitude less computing power and electricity. Ethereum, the second-largest cryptocurrency after bitcoin, switched from proof-of-work to proof-of-stake last year. “We put all this emphasis on (proof-ofwork) cryptocurrency mining, but it is the dinosaur,” Kelles said. “It was the first one created, but if you are looking at newer technologies, they are very nimble, and that is where a lot of the innovation is happening.” Kelles said that she would like to see bitcoin switch to proof-of-stake, though she doubts that it ever will. Torres is also a fan of proof-of-stake: “All cryptocurrency should transition to sustainable alternatives to proof of work for the sake of combating climate change.” Over the past eight years, New York state has proven that it is possible to comprehensively regulate the nascent crypto industry. But so far, the state’s approach has not been replicated by other states or the federal government. Last year, California’s governor vetoed a bill that would have introduced a virtual currency license modeled on New York’s BitLicense. On the federal level, cryptocurrency remains a largely unregulated sector, but it will not remain that way forever. And when Congress does finally take steps to seriously regulate the industry, it seems likely to look to New York’s approach as a model to emulate. The cryptocurrency industry is hopeful that the feds will take the right lesson from New York’s experience. “I would hope that the BitLicense is a ceiling rather than a floor for regulation,” said John Olsen, the New York state lead for the Blockchain Association. “In some respects, it’s worked very well, but enshrining in the country standards of that magnitude, I think, would force a lot of companies to rethink domiciling in the United States simply because of the costs required to actually operate legally.”

Has the collapse of FTX and other crypto exchanges changed your opinion on the industry? FTX is no more representative of crypto finance any more than Bernie Madoff is representative of conventional finance. You should never defame the whole industry based on the egregious misconduct of one actor or a few actors.

Every industry has actors good and bad, and crypto is no exception to the rule. There’s no question that the collapse of FTX adds a sense of urgency to the need for regulation. I think we in Congress have an obligation to translate the lessons learned from the collapse of FTX into a comprehensive framework for regulating crypto. The role of Congress is not to make crypto succeed or fail. The role of Congress is to make crypto safe for consumers and investors. Even as a supporter of blockchain technology, I am willing to concede that crypto has insufficient safety and soundness because we’re in a dangerously deregulated environment. What should that comprehensive framework include? There ought to be greater transparency and accountability around the reserves of both crypto exchanges and stablecoin issuers. Both crypto exchanges and stablecoin issuers should be required by law to prove both their

assets and their liabilities and to prove that their assets are sufficiently liquid to cover their liabilities. There ought to be laws requiring a strict separation of powers and segregation of duties. An exchange like FTX should never have its own hedge fund like Alameda, and a hedge fund should never have its own exchange. There ought to be a separation between the two. There should be a requirement that unlike a bank, a stablecoin issuer have reserves that are 100% cash or cash equivalent. I have real concerns about Tether because it has reserves that fall short of 100% cash or cash equivalent. Are you optimistic about the future of the cryptocurrency industry? I am skeptical that the crypto industry can succeed without a comprehensive regulatory framework at the federal level. I think if there is a regulatory framework that distinguishes the best actors from the worst actors, then the industry has a fighting chance of succeeding.

What benefits do you think cryptocurrency can bring to New Yorkers? I have no interest in the use of cryptocurrency for speculative trading. I have an interest in the use of the underlying technology for practical use cases. I represent the South Bronx, which is one of the poorest areas in the country. I represent a district that has been fundamentally failed by the traditional financial system. For me, the combination of crypto and blockchain, often referred to as Web3, has the potential to create a new layer of the internet and as the potential to create a better, cheaper and faster payment system.

What benefits does the cryptocurrency industry bring to New York state? I think that the industry has brought jobs. The industry has created many jobs in the financial sector downstate,

and they created a lot of opportunities in technology upstate. The industry can also help New Yorkers when it comes to potentially closing the financial gap and the wealth gap. It can potentially help in closing the digital divide for communities that have been traditionally underrepresented and left behind. How can cryptocurrency help close the financial gap? One time, I was working with a group of at-risk youth, and I saw they owned denominations of cryptocurrency. They were on their phones showing me how they were watching the markets and figuring out when to buy and sell. Back then, kids, or those same people that were buying and investing in cryptocurrency, could not participate with traditional investments. They had to have at least $10,000 to participate. Cryptocurrency doesn’t have that barrier of entry. You can invest with a dollar. And the muscles that these young people were using to watch the market –

to figure when to come in, when to go out, when to hold, when the lows were, when the highs were – are the same muscles that experienced investors use. And these guys and girls with little money were doing that. What would you say to critics who say it’s all just a pyramid scheme? It’s not a pyramid scheme. It’s obviously not a pyramid scheme because it’s been here for years. There are many people who think that investing is a Ponzi scheme. Why is real estate worth so much? Why is a stock worth anything? You can ask that for crypto. You can ask that for whatever stock in the world. It’s very important for people to invest and invest where you feel comfortable. Cryptocurrency is not the only option, but it is an avenue of investment. Whether you love it or not, whether you think it’s a scheme or not, it’s very important to be educated on it and have the best information that you can.

Why is it important for the state government to study cryptocurrencies? This is the first asset class born in our lifetime. It’s not going anywhere, so it’s important to figure out how best our state should position ourselves with the entire industry and its ecosystem, which is not only as a potential currency, not only as an asset form, but the businesses and industries that surround this thing that they call cryptocurrency. The world is still trying to figure it out. So we felt it was important for us to formalize a task force with all stakeholders, which includes academia, which includes investors, industry, community, environmentalists, policymakers and regulators to get together and figure this out and figure out what the way forward is.

Are you an opponent of cryptocurrency? I’m neutral about cryptocurrency. I am certainly very interested in the ongoing conversation. I am very interested in the underlying technology, blockchain technology, and I think that there’s some very fascinating uses for it. What about proof-of-work cryptocurrency mining? I do not feel that the cryptocurrency universe needs to continue with (proof-of-work) cryptocurrency mining. That is the only form of validation of cryptocurrency that uses a tremendous amount of energy. Ethereum converted from proof-of-work to proof-ofstake in mid-flight and did not have a crash, did not see any major technical difficulties, did not see a crash evaluation of the coin and overnight dropped their total global energy usage by almost 99%. Your bill imposes an immediate moratorium on certain forms of proofof-work cryptocurrency mining. Why is it so

important to impose a limited moratorium now? Because at the time of writing the bill, there were a total of 49 retired power plants in the state that had been retired because they could no longer compete on the market because they had antiquated technology, meaning they were less efficient, meaning that running them produced more (greenhouse gas) emissions per unit (of) fuel that was used because they’re less efficient. In the previous administration, the government phased out the use of coal-fired power plants. Seeing the trend beginning, not just in New York state but across the country, of power plants being purchased for the purpose of consolidated corporate cryptocurrency mining was the reason to combine the limited moratorium with the study. These could be converted very quickly right underneath us when we’ve just spent many years trying to clean up our grid, trying to decrease our greenhouse gases. So turning them right back on and doing

it for the sole purpose of mining crypto for corporations literally sends us in the absolute wrong direction as a state. And because the trend was happening, the bill was designed to put a pause on that until we could just wrap our minds around the impact before the trends move through the state. How would you respond to critics who say the state’s moratorium on certain forms of proof-ofwork mining will harm the cryptocurrency industry? It is a very narrow bill exclusively focused on the purchase of retired fossil fuel power plants in the state. There’s no other form of cryptocurrency mining that is subject to this legislation. In fact, because it only puts a limited moratorium on the purchasing of power plants, it is really only a limitation on the large-scale corporations. So if you are truly unemotionally looking at the bill, it actually could balance the playing field in a way that could increase the ability for boutique miners to compete.

Is bitcoin really a good long-term investment when it goes from being worth over $60,000 toward

the end of 2021 to about $20,000 this year? I think the last year has demonstrated that the cryptocurrency market at this point, while it’s still very new, is highly speculative. There’s no question about that. If you invested in bitcoin at the height of it, then you likely lost a significant amount of money. But that is the nature of the speculative markets. I think you’d find that if you bought Netflix and a number of tech stocks, you’d be equally in the red. It was just a bad year for markets in general. It’s been a very difficult time for the industry, but it’s also been an opportunity to weed out the bad actors like the ones we saw last year, and it’s an opportunity to educate policymakers on the breadth and diversity of the industry as opposed to just talking about bitcoin or bitcoin mining.

Speaking of bitcoin mining, did you support Assembly Member Anna Kelles’ bitcoin mining moratorium bill? No, we were very much opposed to that bill. From the perspective of policy, the bill appeared to be a solution in search of a problem. But more specifically, it was a bill that only targeted cryptocurrency when it considered the use of energy. Proponents will say, well, this is our attempt to prevent the refiring of old peaker plants in New York state. However, it didn’t appear that that was a business model that was going to be repeated. There wasn’t any sense that the model that Greenidge was adopting was something that was just going to be embraced wholesale. And there have been proponents, even legislators, who are saying, don’t be surprised if we now go and try and ban all cryptocurrency mining in

New York. If you were to just outright ban bitcoin mining in New York, that I think would be way, way overboard in terms of addressing some of the challenges that come with this new industry. It’s bad policy to pick winners and losers when it comes to energy use. Do you think politicians have become more hostile to the cryptocurrency industry over the past year? It’s hard to tell how much folks were paying attention to anything beyond the headlines, you know, with FTX. So is there an increased stigma? It’s possible. I think you’ve only just reinforced the opinions of the opponents in general. But what I have found in speaking with new members and younger members is there is more of an embrace of the underlying technology and the potential applications for that.

Cryptocurrency and blockchain have started to open new doors to financial wealth and provided alternatives to traditional financial services for the unbanked and underbanked. As an industry, we’re really trying to push a general financial literacy and financial education program to educate folks on the ability for cryptocurrency and blockchain to help them navigate a different financial path than going through traditional banking and financial institutions. Despite the challenges in New York, I think we’ve seen more people embrace cryptocurrency as a digital asset and as something to look to as an investment, a long-term investment.
