REGISTRATION FOR THE SCHOOL MEALS

Registration for the school meals service takes place by making an application when the child is registered at the school secretarial office for the first year of school. It will remain valid for the child’s whole period of schooling at the state or council-run nursery, primary and lower secondary school. For the council-run nursery schools, all the personal details relating to the children registering for the first time as well as those already registered for school meals (confirmed) are dealt with directly by the local centres’ (Poli Territoriali) secretarial offices. It is possible to consult the list of local centres in the Forms (Moduli) section of the www.milanoristorazione.it web site or on the www.comune.milano.it web site. For the state nursery, primary and lower secondary schools and the two civic schools (primary in Via San Giusto 65 and secondary in Piazza XXV Aprile 8), all the personal details relating to those registered with the school meals service are dealt with directly by the state school secretarial offices through the School Registry Service (AnaSco). When registering for the 2012-2013 school year (during January-February 2012), the families of the pupils already attending school (confirmed) and of the new registrants must check and if necessary update their personal details. The meal service charge is issued under the name of the parent/guardian indicated by the school secretarial office during the registration stage and cannot be changed during the year except in cases of variations in the members of the family attested by the records at the municipality of Milan’s Civic Registry Office. The information relating to the number of family members for the right to the 50% discount on the annual charge in the event of more than one child using the service is provided directly by the municipality of Milan’s Civic Registry Office. Upon presenting valid ISEE (means testing) certification relating to income for 2011, the families of pupils resident in the municipality of Milan can benefit from reduced rates on the basis of their family income. The ISEE certification relating to income for 2011 must be handed in to Milano Ristorazione’s Meal Service Charges Office in Via Carlo Matteucci, 1 Milan.

CHARGES FOR THE SCHOOL MEALS SERVICE

Divided by ISEE income brackets: The annual charge for the school meals service, is established by the Milan City Council. It is a contribution from families to part cover the overall cost of the service provided. The calculated charge already takes into accoun absences, suspension or reduction of the service due to exceptional events such as elections, strikes and/or trade union meetings. As a result, families must pay the whole annual charge which is not affected by variations in the pupil’s actual presence and attendance at school. The charge may be reimbursed in part due to lack of use of the service only if the child does not use the meals service for 30 consecutive calendar days or for multiples of 30 days only. In this case, the annual charge will be reduced by 12% for every 30-day period of absence. Pupils attending any of the schools who are not resident in the Municipality of Milan cannot benefit from the reduced school meal charges, or from any other reduction reserved for resident taxpaying families. Non-resident families must pay a charge for the school meals service equal to the cost of the meal that the Municipality of Milan pays to Milano Ristorazione. At present, this cost is € 5,63 for council-run nursery schools and € 4,43 for state nursery, primary and lower secondary schools. In the event of transfer of residence to the Municipality of Milan during the school year, families must present the change of residence procedure document issued by the municipality of Milan’s Civic Registry Office to the Meal Service Charges Office. It will be possible to gain access to the reduced rates reserved for resident citizens as of the month following the application. Reduced rates cannot be backdated.

REQUESTING REDUCED MEAL SERVICE RATES

PAYMENT METHODS

Entitlement to reduced rates is as follows:

Families will be informed of the amount of the charge owed for the service, including if it is free, by the following means:

1 For children in care living with other families, in communities and/or associations. The minimum charge is set at € 240,00 for pupils at the council-run nursery schools and € 236,00 for pupils at the nursery, primary and lower secondary schools. In order to make use of the minimum rate, the families and communities/associations must send special documentation to Milano Ristorazione certifying the care status issued by the competent body.

• sending post office account payment slips issued by Milano Ristorazione for payment; • sending a summary of the deadlines for direct debit payments. • sending a letter informing that the family will not be charged. Payments can be made exclusively: • • • •

2 Families with more than one child, at the nursery, primary and lower secondary schools using the school meals service during the same school year can benefit from a 50% reduction in the charge for all the children, except the youngest child, for whom the full rate must be paid. The information relating to the number of family members for the right to the 50% discount on the annual charge in the event of more than one child using the service is provided directly by the municipality of Milan’s Civic Registry Office. It is underlined that the 50% reduction only concerns pupils using the school meals service at the state and council-run nursery, primary and lower secondary schools. Brothers/sisters who attend the crèche cannot be counted. Furthermore, it is highlighted that pupils attending the last year of the lower secondary school during the school year 2011/2012 are not considered in terms of the 50% reduction for the school year 2012/2013.

Payments can be made in 4 instalments or in a single instalment. Payments by direct debit, however, can only be made in 4 instalments. The instalment deadlines will be shown on the post office account payment slips or on the direct debit letter, and they are: • single instalment: deadline 15/10/2012 • 4 instalments: deadlines 15/10/2012 - 15/12/2012 - 15/02/2013 - 15/04/2013

3 On the basis of I.S.E.E. means testing. Those who intend to use or already benefited from the reduced rates during the previous school year must present valid ISEE certification relating to income for 2011. I.S.E.E. certification (Equivalent Economic Situation Indicator) can be requested from CAF tax assistance centres, INPS national insurance offices and the municipality of Milan local council offices. It is the only valid documentation in order to obtain the reduced rates. The company Milano Ristorazione along with the Municipality of Milan may perform random checks on the certificates presented to obtain reductions.

For primary and lower secondary schools that are not full time (with the so-called module system) or that have less than 5 afternoon sessions a week, the annual charge will be divided into two instalments: • advance instalment (50%) to be paid by 15/01/2013 • settlement instalment (50%) to be paid by 15/04/2013

In the event of total payment of the annual charge there will be partial reimbursement of the instalment for the periods in which the meal service is not used. Should the family be entitled to a reimbursement, it must contact the Milano Ristorazione Meal Service Charges Office which will provide the necessary forms for the application. In the event that monies are owed by the family, the amount will be withheld so that the different amounts balance out. Said amount will also be withheld in the event that monies are owed for other children belonging to the same family. If the annual charge has been paid in part, following a letter from the school, the company shall issue the instalments again while taking into account the 12% reduction for each 30-day period of absence.

If the I.S.E.E. certification is presented after the deadline, the reduced rates can only be applied from the month following the application. Reduced rates cannot be backdated.

LACK OF PAYMENT

The failure to pay the meals service charge will result in Milano Ristorazione issuing a payment reminder. The amount for payment will also include the cost of the postal and administrative charges borne for the collection procedures, as well as legal interest and a 5% default charge on top of the due amount should the debt not have been paid within 30 days of the reminder and/or the payment expiry date.

NO CHARGE AND CHANGE OF RATE DURING THE YEAR

Should the debt persist, the case will be listed for the issue of a tax demand which shall include all the additional expenses set out in the regulations in force. Proof of payment of the charges for the school meals service should be preserved for at least five years. The company reserves the right to inform of any further integrations considered necessary during the school year.

No charge: Families under the municipality of Milan social services, in situations of particular economic hardship, can request to pay no charge for the service during the year underway. In addition to the documentation certifying economic hardship, it is necessary to attach an up-to-date ISEE certification to the application. In any case, the ISEE figure must not exceed € 2,000.00. In these cases, the no charge applications will be checked and appraised and then accepted or rejected by a special commission presided over by the Family Policies Department Manager. If the application is accepted, the charge will be cancelled from the month following presentation of the request. A social services case means a variation in the family's ability to pay the charge due to a sudden worsening in its socio-economic conditions due to permanent changes in professional activities (transitory variations in income deriving from temporary changes will not be taken into consideration) or due to work situations that do not permit the family to pay the allocated rate.

La cuota de contribución anual al servicio de comedor escolar, es establecida por el Ayuntamiento de Milán. Esta cuota representa una contribución, por parte de la familia, para cubrir parcialmente el coste total del servicio ofrecido. El cálculo de la contribución requerida ya tiene en cuenta las ausencias, suspensión o reducción del servicio por eventos excepcionales, como elecciones, huelgas y/o asambleas sindicales. Por consiguiente, la familia debe pagar por entero la cuota de contribución anual, no siendo relevante la variabilidad en la presencia y asistencia efectiva del alumno. Está previsto el reembolso parcial de la cuota de contribución, por falta de utilización del servicio, exclusivamente en el caso de que el niño no utilice el comedor durante 30 días consecutivos de calendario o múltiplos de 30 días. En este caso, la cuota anual se reduce un 12% por cada período de 30 días de ausencia. INSCRIPCIÓN AL SERVICIO DE COMEDOR ESCOLAR EN

La inscripción al servicio de comedor escolar se realiza mediante solicitud en el mismo momento de la inscripción del niño, el primer año de entrada, en la secretaría del colegio, y será válida durante todo el período de permanencia en el colegio de Educación Infantil, Primaria y Secundaria de 1er grado Municipal y Estatal. Toda la información de registro de los nuevos inscritos y de los confirmados al comedor escolar, en los Colegios de Educación Infantil Municipales, está gestionada directamente por las secretarías de los Institutos Territoriales, cuyo listado puede consultarse en el sitio web www.milanoristorazione.it, en la sección Módulos, o bien en el sitio web www.comune.milano.it. Toda la información de registro de los inscritos al comedor escolar en los Colegios de Educación Infantil – Primaria y Secundaria de primer grado Estatales y las dos Escuelas Cívicas (Primaria de Via San Giusto, núm. 65 y Secundaria de Piazza XXV Aprile, núm. 8) está gestionada directamente por las secretarías didácticas estatales, mediante el Registro Escolar. CUOTAS DE CONTRIBUCIÓN PARA LOS USUARIOS

Los alumnos que asistan a los Colegios de cualquier clase y grado no residentes en el Municipio de Milán no podrán beneficiarse de las cuotas de contribución subvencionadas, ni de ninguna otra subvención reservada a las familias residentes y contribuyentes. Las familias no residentes pagan una cuota de contribución al servicio de comedor escolar equivalente al coste de la comida pagado por el Ayuntamiento de Milán a Milano Ristorazione. Actualmente este coste es de 5,63 € para los Colegios de Educación Infantil Municipales y de 4,43 € para los Colegios de Educación Infantil, Primaria y Secundaria de 1er grado Estatales. En caso de traslado de la residencia al Ayuntamiento de Milán, durante el curso escolar, las familias, contra la presentación en la Oficina de Cuotas de Contribución del documento de apertura del expediente entregado por la Oficina del Registro Ciudadano del Ayuntamiento de Milán, podrán beneficiarse de las cuotas subvencionadas, reservadas a los ciudadanos residentes, a partir del mes siguiente a la solicitud, y no podrá tener efectos retroactivos.

Los vencimientos de los plazos se reflejarán en los recibos de cuenta corriente postal o en la comunicación RID (domiciliación bancaria), y son: • un solo plazo: vencimiento 15/10/2012 • 4 plazos: vencimientos 15/10/2012 - 15/12/2012 - 15/02/2013 - 15/04/2013 En el caso de los Colegios de Educación Primaria y Secundaria de 1er grado no a tiempo completo (llamadas por módulos), o sea, con utilización del servicio a la semana por menos de 5 días, la cuota contributiva anual se subdividirá en dos plazos: • plazo a cuenta (50%) a pagar no más tarde del 15/01/2013 • plazo resto del pago (50%) a efectuar no más tarde del 15/04/2013

MODALIDAD DE REEMBOLSO DE LAS CUOTAS En caso de pago total de la cuota anual está previsto el reembolso parcial de las cuotas correspondientes a los períodos no utilizados. En caso de que la familia tenga derecho al reembolso, deberá ponerse en contacto con la Oficina de Contribuciones de Milano Ristorazione, que le proporcionará los formularios necesarios para la solicitud. En caso de que se comprobaran impagos anteriores, el importe del reembolso quedará retenido hasta que se satisfagan las cantidades impagadas. Dicho importe también se retendrá en relación con los impagos anteriores que se comprueben por otros hijos pertenecientes al mismo núcleo familiar. En caso de pago parcial de la cuota anual, la Sociedad, después de la comunicación efectuada por la escuela, volverá a emitir las cuotas teniendo en cuenta la reducción del 12% por cada período de 30 días de ausencia.

La presentación del certificado I.S.E.E. pasado el plazo previsto implicará la aplicación de la cuota subvencionada exclusivamente desde el mes siguiente a la presentación, y no podrá tener efectos retroactivos.

SOLICITUD DE CUOTAS SUBVENCIONADAS

Existen cuotas subvencionadas para: 1 Los niños en régimen de tutela en otros núcleos familiares, Comunidades y/o Asociaciones. La cuota mínima prevista es de 240,00 € para los alumnos de los colegios municipales de Educación Infantil y de 236,00 € para los alumnos de los colegios de Educación Infantil, Primaria y Secundaria de 1er grado. Para poder beneficiarse de la cuota mínima, las familias y las Comunidades/Asociaciones deberán enviar a la sociedad Milano Ristorazione la correspondiente documentación comprobante del estado de tutela otorgada por el órgano competente.

GRATUIDAD Y VARIACIÓN DE LA CUOTA DEL AÑO EN CURSO

3 Sobre la base del certificado I.S.E.E. familiar. Quienes deseen beneficiarse o ya se hayan beneficiado durante el año escolar anterior de las cuotas subvencionadas, deben presentar obligatoriamente el certificado ISEE en vigor relativo a la renta del ejercicio 2011. El certificado I.S.E.E. Indicador de la Situación Económica Equivalente), que debe solicitarse en los Centros de Asistencia Fiscal (CAF), las sedes del I.N.P.S. y las ventanillas de las Áreas de Descentralización del Ayuntamiento de Milán presentes en el territorio, es el único documento válido para obtener la subvención de las cuotas. La sociedad Milano Ristorazione, en colaboración con el Ayuntamiento de Milán, podrá efectuar controles aleatorios a los certificados presentados para obtener beneficios de subvención.

2 Las familias con varios hijos, que utilicen durante el mismo curso escolar el servicio de comedor en los Colegios de Educación Infantil, Primaria y Secundaria de 1er grado, disfrutan de una reducción del 50% sobre la cuota de contribución de todos los hijos, excepto el más pequeño, por el cual deberán pagar el 100% de la cuota de contribución. La información relativa a la composición del núcleo familiar para el derecho al descuento del 50% de la cuota anual por varios hijos que utilizan el servicio se obtiene directamente del Registro Ciudadano del Ayuntamiento de Milán. Se precisa que la subvención del 50% se aplica sólo a los alumnos que utilizan el servicio de comedor en los Colegios de Educación Infantil, Primaria y Secundaria de 1er grado, Estatales y Municipales. No cuentan los hermanos/hermanas que vayan a la Guardería. Además se señala que los alumnos que durante el curso escolar 2011/2012 asistan al último curso de los Colegios Secundarios de 1er grado no se tienen en cuenta para la subvención del 50% para el curso escolar 2012/2013.

Gratuidad: Las familias a cargo de los servicios sociales del Ayuntamiento de Milán, con especiales dificultades económicas, pueden solicitar la gratuidad del servicio del año en curso, adjuntando a la misma, además de la documentación que justifica el estado de necesidad económica, el certificado I.S.E.E., actualizado a la fecha de presentación de la instancia, con un valor I.S.E.E. que en cualquier caso no deberá superar 2.000,00 €. En estos casos, la solicitud de gratuidad se comprobará y evaluará, con la consiguiente aceptación o denegación, por parte de la correspondiente Comisión presidida por el Responsable del Área de Políticas Sociales de la Concejalía de Familia. Si se acepta, la gratuidad empezará a computarse desde el mes siguiente a aquel en el que la solicitud se hubiera presentado. Por caso social se entiende la variación en la capacidad contributiva de la familia, debida a un repentino empeoramiento de las condiciones socio-económicas a causa de cambios permanentes en la actividad profesional (no se tendrán en cuenta las variaciones transitorias de la renta derivadas de modificaciones temporales) o de situaciones laborales tales que no permitan el pago de la cuota asignada. Variación de la cuota: La variación en el año en curso de la cuota de contribución asignada puede solicitarse: a por razones graves y justificadas documentalmente que hayan modificado la capacidad contributiva de la familia durante el año en curso; b por variación de los miembros del núcleo familiar (que resulte en el Registro del Ciudadano del Ayuntamiento de Milán) en caso de que incidiera en la variación del tramo del I.S.E.E; en los demás casos, confirmados por los Servicios Socio-Asistenciales y verificados por la Oficina de Planificación y Coordinación de Servicios Educativos de la Concejalía de Educación e Instrucción. Para solicitar la variación de la cuota y la gratuidad durante el año en curso, se debe: • presentar y entregar la solicitud firmando el formulario correspondiente en las ventanillas de Milano Ristorazione S.p.A. – Oficina de Contribuciones – Via Carlo Matteucci, núm. 1 – Milán, 20129. • Adjuntar a la solicitud los documentos que comprueben los cambios que se considera que justifican la solicitud de modificación, incluido el certificado I.S.E.E. actualizado a la fecha de presentación de la solicitud.

Las gratuidades y las solicitudes de variación de cuota podrán ser aplicadas solamente desde el mes siguiente a aquel en el que las familias hayan presentado la solicitud, y no podrán tener carácter retroactivo. Mientras espera el resultado de la solicitud que ha formulado, la familia está obligada al pago de la cuota que se le haya asignado mientras que la misma no sea evaluada por la Comisión anteriormente indicada, que, por norma, se convoca una vez al mes.

FALTA DE PAGO

La falta de pago de la cuota de contribución dará lugar a la emisión, por parte de Milano Ristorazione, de apremios de pago, gravados con el coste de los gastos de correo y administrativos que se deban sufragar en el proceso de cobro, además de la aplicación del interés legal y un interés de demora del 5% del importe debido, en caso de que en el plazo de 30 días desde el apremio y/o desde la fecha de vencimiento del pago –no se haya procedido a pagar la deuda. En caso de que se mantuviese la deuda, se procederá a su inscripción en el registro para la emisión de las notificaciones de cuotas a pagar, gravadas con todos los gastos añadidos previstos en las leyes vigentes. El certificado comprobante del pago realizado de las cuotas contributivas para el servicio de comedor debe conservarse durante cinco años como mínimo. La Sociedad se reserva el derecho de comunicar, durante el curso escolar, otras eventuales integraciones que se considerasen necesarias.
