Santos Avenue, Bicutan, Taguig City MEMORANDUM OF AGREEMENT FOR NRCP NSTEP SMALL R&D FUNDED RESEARCHES Project Title: “EXPANDED-LIMITED FACE-TO-FACE CLASSES: EXPERIENCES OF STAKEHOLDERS W, X, Y, AND Z” Kt^OW ALL MEN BY THESE PRESENTS: This Memorandum of Agreement made and entered into by and between: The NATIONAL RESEARCH COUNCIL OF THE PHILIPPINES (NRCP), hereinafter referred to as “Funding Agency”, a government entity and an attached agency to the Department of Science and Technology (DOST), duly existing and created under the laws of the Republic of the Philippines, with principal office address at General Santos Avenue, Bicutan, Taguig City, Metro Manila, represented herein by its Executive Director, DR. MARIETA BANEZ SUMAGAYSAY, for funding and monitoring of the Project; The DEPARTMENT OF SCIENCE AND TECHNOLOGY REGIONAL OFFICE NO. VI (DOST VI), Chair of the NSTEP Visayas, hereinafter referred to as “Monitoring Agency”, a government entity and an attached agency of DOST, duly existing and created under the laws of the Republic of the Philippines, with principal office address at Magsaysay Village, La Paz, Iloilo City, represented herein by its Regional Director, ENGR. ROWEN R. GELONGA, CESO n, for co-monitoring of the Project; and _______ The CEBU TECHNOLOGICAL UNIVERSITY - SAN FRANCISCO CAMPUS (CTU - San Francisco Campus), hereinafter referred to as “Implementing Agency”, a constituent university of the Republic of the Philippines, created by virtue of Act No. 9744, as amended, and re-organized and operating by virtue of RA 3500 and RA 1984, with office address at Northern Poblacion, San Francisco Cebu City, represented herein by its University President, DR. ROSEIN A. ANCHETA JR., for implementation of the Project.

W I T N E S S E T H : That WHEREAS, the CTU-San Francisco Campus provides assistance to its faculty members in pursuing its teaching, research extension and other programs; WHEREAS, the Project was proposed by MR. MARVIN D. GUINOCOR, an Associate Member of NRCP with good standing and who is presently connected with the CTU San Francisco Campus, as Principal Researcher, deemed to have the necessary expertise to conduct the research, hereinafter referred to as the “Project Leader”;

WHEREAS, the Project is one of the research projects lined up for implementation under the NRCP NSTEP Small R&D Grant, aligned with the National Integrated Basic Research Agenda on ATIN Program and is considered as a joint research initiative by the Project Leader, NRCP and DOST VI; WHEREAS, the CTU- San Francisco Campus, with the full agreement of the Project Leader, pledges to extend their full cooperation for the effective and efficient implementation of the Project; NOW, THEREFORE, for and in consideration of the above premises, and of the mutual covenants and stipulations hereinafter set forth, the parties hereto agree to enter into this Memorandum of Agreement under the following terms and conditions: I.

OBJECTIVES AND EXPECTED OUTPUTS OF THE PROJECT

The objectives and expected outputs of the Project shall be those as stated in the approved project proposal (made part hereof as Annex “A”): General Objective: jjjj g

The primary objective of this study is to determine the stakeholders’ experiences on the basic education expanded limited face-to-face classes in Camotes Islands.

OPERATION OF THE PROJECT

The Project shall be undertaken by the Implementing Agency in accordance with the approved project proposal (made part hereof as Annex “A”) and shall be monitored by the Monitoring Agency. HI.

FUNDING ASSISTANCE TO THE PROJECT

~> The Funding Agency shall provide a total grant in the amount of FIVE HUNDRED THOUSAND PESOS (Php 500,000.00) for eight (8) months, which shall be expended as allocated in the approved Project’s Line-Item Budget (made part hereof as Annex “B”). Guidelines on the DOST Grants-in-Aid Program as may be determined by the Funding Agency shall govern the implementation of the Project subject to applicable rules and regulations and availability of funds.

All income/interest derived from the Project, if any, and all unexpended balance shall be reported immediately and remitted to the Funding Agency by the Implementing Agency after the termination/completion of the Project. In case of failure to do so within the said period, the Funding Agency has the option to charge interests and other applicable fees.

The Funding and Monitoring Agencies reserve the right to discontinue the Project or its assistance at any time for cause as determined by the Funding Agency, to include but not limited to, violation of the Grant Agreements, fraud and falsity in the Implementing Agency’s warranties and representations as provided by the proponent or upon determining that the results which were obtained or reasonably expected do not justify further activity.

IV.

FUND RELEASE AND UTILIZATION

The financial grant shall be released by the Funding Agency to the Implementing Agency, subject to applicable rules and regulations and availability of funds. VExecutive Director III, NRCP

The activities, operation of books of accounts and records of the Project shall be subject to reasonable inspection by authorized representatives of the Funding and/or Monitoring Agencies.

V.

PROJECT DURATION

The Project shall be implemented for a period of 8 MONTHS covering August 1 2022March 31, 2023. The parties shall agree on the starting date of implementation, which shall not be later than the date of receipt of funds by the Implementing Agency. Extension of the Project term may, in a very meritorious case, be allowed but in under no circumstances shall request for additional funding be granted. Unapproved, unexplained and unjustified delays shall be a cause for legal action by the Funding Agency against the Project Leader and Implementing Agency as provided for by existing laws on Obligations and Contracts and other applicable laws.

VI.

PROJECT IMPLEMENTATION AND MANAGEMENT

The Implementing Agency shall exert all efforts (such as providing facilities and technical personnel with the required expertise) to attain the objectives stated in the proposal;

The Implementing Agency, through the assigned Project Leader, shall bind itself to implement the Project in accordance with the approved project proposal (Annex “A” hereof), and in conformance with the approved Financial Plan (Line-Item Budget) (Annex “B” hereof); ~^The Implementing Agency shall issue the appointments of the Project Leader, the Project Staff/s indicated in the approved research proposal and other project personnel hired on a contractual basis within the duration of the Project in accordance with the existing hiring policies of CTU and the approved Financial Plan (Line-Item Budget); The Implementing Agency, through the Project Leader, shall keep records of project preparation, implementation and evaluation activities. The Implementing Agency shall secure an approval from the Funding Agency for an interruption of the Project not exceeding thirty (30) calendar days and not more than once, except under circumstances of serious illness or force majeure.

MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS: This Memorandum of Agreement was made and entered into by and between: The Cebu Technological University-San Francisco Campus, a State University duly created by operation of law, with office address at Northern Poblacion, Cebu, Philippines, herein represented by its Campus Director, DR. JON1TA V. LITERATUS, hereinafter referred to as the CTU-San Francisco. - and The Municipality of San Francisco is a local government unit duly created by law in the Province of Cebu. Its seat of governmental power is located at Northern Poblacion, San Francisco, herein represented by its duly elected Mayor, HON. ALFREDO A. ARQUILLANO JR., hereinafter referred to as Municipality of San Francisco.

WITNESSETH THAT:

WHEREAS, the CTU-San Francisco is a premier university in Cebu Province which implements programs and projects on disaster risk reduction and management; WHEREAS, CTU-San Francisco implements the program entitled "Think Big, start small: An emotionally intelligent approach to 2030 Climate Change Deadline Campaign”. WHEREAS, CTU-San Francisco implements three projects under the program entitled “Think Big, start small: An emotionally intelligent approach to 2030 Climate Change Deadline Campaign” as reflected below. 1. Assessment of the Level of Community’s Perception Regarding Climate Change Agenda and Deadline 2. Evaluation of the applied strategies on Climate Change Agenda and Deadline 3. Solid Waste Management of San Francisco Business Establishment: An Assessment WHEREAS, the Municipality of San Francisco is a third class municipality duly created by law in the Province of Cebu. WHEREAS, the Municipality of San Francisco promotes the protection, conservation and management of the terrestrial biodiversity within its jurisdiction; WHEREAS, the Parties mutually agree and manifest their interest to jointly cooperate in the effective and efficient implementation of the Program;

NOW, THEREFORE, in consideration of the above premises and the agreements hereinafter set forth, the Parties agree as follows:

ARTICLE I PURPOSES AND DURATION 1. The purposes of this cooperation are: a. To implement jointly the program entitled “Think Big, start small: An emotionally intelligent approach to 2030 Climate Change Deadline Campaign”, particularly in the study sites within the jurisdiction of the Municipality of San Francisco; and, b. To ensure that the functions, responsibilities and deliverables of the Parties are done effectively and efficiently during the project term. 2. This Agreement is effective from the date of execution by the Parties and shall remain in effect until 31 March 2027. 3. This Agreement maybe renewed until the Project ends on 31st March, 2027.

ARTICLE 11 RESPONSIBILITIES OF THE CTU-San Francisco Campus

The CTU shall undertake the following functions and responsibilities: 1. Inform the Municipality of San Francisco about the priorities and objectives of the program as they may be relevant to the nature of program implementation and management; 2. Coordinate and collaborate with the Municipality of San Francisco and other stakeholders in all significant phases of the program and project implementation; 3. Conduct regular planning, monitoring, and assessment together with the program and project stakeholders; 4. Regularly participate in local stakeholders’ forum with concerns on disaster risk reduction and management; 5. Provide the resources and materials needed by project one under the program as indicated and agreed in the project implementation plan; 6. Provide the organizational guidelines and formats to be utilized by the projects; 7. Furnish and shares available data, reports, plans and other documentation pertinent to the communities and environment covered by the Program through the point person assigned by the CTU-San Francisco for each projects; 8. Acknowledge and recognize the participation of the Municipality of San Francisco for the program in all activities, forums and reports.

ARTICLE III RESPONSIBILITIES OF THE MUNICIPALITY OF SAN FRANCISCO The Municipality of San Francisco shall undertake the following functions and responsibilities:

1. Pledge commitment to and support the program activities for the attainment of program objectives, outcomes and deliverables. 2. Issue permits that allow onsite visits for disaster risk reduction and management assessments, including visitations to business establishments, conduct of outreach and community extension activities, and other related activities for disaster risk reduction and management awareness within its jurisdiction. 3. Appoint a focal person for efficient information dissemination for Program implementation; 4. Participate in regular and special multi-stakeholders’ fora and meetings; 5. Support and push for the implementation and attainment of the multi­ stakeholder approved plans and activities; 6. Participate in the regular partners meeting and assessment facilitated by the CTU-San Francisco; 7. Provide the resources and materials needed by projects 2 and 3 under the program as indicated and agreed in the project implementation plan; and, 8. Provide the profiles, data and information such as maps necessary for the effective and efficient implementation of the program.

ARTICLE IV TERMINATION AND AMENDMENT Any Party reserves the right to terminate this Agreement if it deems that the provisions herein are not satisfactorily performed. In such a case, the withdrawing Party shall notify the other Party at least fifteen (15) calendar days prior to the intended date of termination of this Agreement. Any changes in the schedule or the responsibilities of this Agreement will be mutually discussed and agreed upon by the Parties. No changes shall be made in the terms of this Agreement without the written approval of both Parties. WHEREAS, the CTU-San Francisco is a premier university in Cebu Province which implements programs and projects on aquatic and natural resources preservation, culture, and propagation; WHEREAS, CTU-San Francisco implements the program entitled “ Aquatic and Natural Resources Commodities’9. WHEREAS, CTU-San Francisco implements seven research projects under the program entitled "Aquatic and Natural Resources Commodities*9as reflected below. 1. Evaluation on the Effects of Psidium Guajava Leaves Extracts of Two Different Leaves as Immunostimulants and Growth Enhancer of Penaeus Monodon Post Larvae 2. Inland Polyculture of Best Tilapia and Giant Freshwater Prawn in Recirculating Aquaculture System (RAS) 3. The Effect of Water Exchange Rate on the Survival of the Larval Development of Mudcrab (Scylla Serrata) 4. Enahancing the Yield of the Fisheries Sector in San Francisco, Camotes, Islands, Cebu, Philippines: CAGE CULTURE-Polyculture of Milkflsh- Chanos-chanos; Rabbit Fish- Siganus Guttatus and Brackishwater Enhanced Selected Tilapia. 5. Spatial and Temporal Pattern on Gonodal Dispersal of Fish and Crustacean Species in Mangrove Area of San Francisco, Camotes Islands, Cebu, Philippines 6. WHEREAS, the Municipality of San Francisco promotes the protection, conservation and management of the terrestrial biodiversity within its jurisdiction; WHEREAS, the Parties mutually agree and manifest their interest to jointly cooperate in the effective and efficient implementation of the Program;

WHEREAS, th e Camotes National High School, a public high school institution in San

Francisco District, which envisions to be an institution th a t ensures the attain m en t of the interests of th e stu d en ts' well-being, academics, social and personal needs;

WHEREAS, the Camotes National High School believes th at for the effective operation of

the Aquaponics system, there is a need for school-industry p artnership th at will provide the school the necessary expertise and venue for technical assistance;

WHEREAS, the Camotes National High School will sta rt full im plem entation and

operation of the Aquaponics system in School Year 2021 - 2022;

WHEREAS, to achieve this objective, the Camotes National High School needs to en ter

into an Aquaponics System Partnership with th e Cebu Technological University - San Francisco Campus;

WHEREAS, the Cebu Technological University - San Francisco Campus operates in the

area w here the school is located and has offices, facilities, project sites, and expertise th at it can make available to th e SCHOOL for purposes of realizing the project;

WHEREAS, the Cebu Technological University - San Francisco Campus considers into a

partnership w ith th e School as p art of its mission to create a positive im pact on the community, especially w ith the enrichm ent and conservation of our biodiversity;

WHEREAS, the SCHOOL and the PARTNER INSTITUTION, h ereinafter collectively

referred to as "the PARTIES", undertake to collaborate for th e successful im plem entation of the Aquaponics System in San Francisco, Cebu cognizant of the need for special protection and w ith the best interest of th e entire institution;

DESCRIPTION OF THE AQUAPONICS SYSTEM

In accordance to the efficient and effective im plem entation of th e National Greening Program (NGP) p u rsu an t to Section 5.2 of Executive O rder (EO) No. 26, s. 2011 and DepEd M emorandum No. 58, s. 2011 entitled Creating the Task Force on National Greening Program, the DepEd was tasked to issue the guidelines to concretize directions in the

im plem entation of the National Greening Program (NGP);

The Camotes National High School, Southern Poblacion, San Francisco, Cebu, designed the im plem entation and operation of th e Aquaponics System to cultivate and grow plants in the w ater through p ro p er filtration and purification;

With the prem ise, the Camotes National High School seeks for various stakeholders to participate in the im plem entation and operation of the Aquaponics System through technical assistance and oth er su p p o rt from its partner;

The Aquaponics System is one of the best practices of the Camotes National High School. Through this, the SCHOOL is able to pursue oth er m eans of m onetary funding a n d /o r incom e-generating program w here generated products such as aquatic organism s and various vegetables may potentially be exported in the local m arket. Likewise, the realization of the Aquaponics System, w ith the technical assistance from the partners, can generally im m erse and inculcate the teachers of Camotes National High School on the benefits of such, and can be th ere m eans for teaching o th er stakeholders as well.

I.

OBJECTIVES OF THE AQUAPONICS SYSTEM PARTNERSHIP

The Aquaponics System Partnership has the following objectives: 1. To sustainably attain to the goals and objectives of th e National Greening Program (NGP) w ith special inputs and technical rem arks coming from the PARTNER INSTITUTION experts and practitioners in o rd er to align the institutional standards.

2. To develop the Gulayan sa Paaralan of the Camotes National High School, as one of the requirem ents and best practices of each public schools in the Philippines. 3. To provide oth er incom e-generating program (IGP) of the school w here products th at are generated through the system can be exported to the local m a rk e t 4. To form the Aquaponics System P artnership betw een the SCHOOL and the PARTNER INSTITUTION, allowing teachers, adm inistrators, oth er concerned beneficiaries to be inculcated with essential inform ation through technical assistance and expertise as p art of the goals of the National Greening Program.

RESPONSIBILITIES OF THE PARTIES A. loint Responsibilities

1. Create a joint w orking group th a t will p rep are the action plan to operationalize the partnership. 2. Form a joint steering com m ittee to m onitor the progress of the partnership and to make sure th at the provisions of this M em orandum of Agreem ent (MOA) are m e t 3. B. Responsibilities pf the SCHOOL

1. Lead the im plem entation and operation of the Aquaponics System, which will be the subject of the partnership. 2. Designate a person in charge of coordinating w ith the

INSTITUTION and supervising the oth er related activities. 3. Regularly m onitor the operation of the Aquaponics System. 4. Provide the PARTNER INSTITUTION a Certificate of Recognition for extending technical assistance and expertise. 5. Execute a deed of acceptance as a way of recognizing and acknowledging the d o n atio n /s received from the PARTNER INSTITUTION.

EFFECTIVITY

This agreem ent shall hold for the duration of 2021 - 2022 Academic School Year and is renew able every year. The PARTNER INSTITUTION and the SCHOOL shall subm it th eir intention for renew al of this agreem ent through formal notice w ithin thirty (30) days before the expiration of this A greem ent The PARTNER INSTITUTION and the SCHOOL reserve th eir respective rights to term inate th eir participation in the agreem ent after the duration of this A greem ent through formal w ritten notice within thirty (30) days before the effectivity of the term ination. Both parties shall turn o v er all deliverables agreed thereto in the said program. Term ination shall be subject to the mutual agreem ent betw een the parties. A m aterial breach of his MOA shall constitute a ground for term ination, in whole or in part, by the aggrieved party, w ithout prejudice to oth er legal rem edies.

IV.

OTHER PROVISIONS

It is expressly understood by the PARTIES th a t the PARTNER INSTITUTION is not obliged to pay wage or any m onetary allow ances since no em ployer-em ployee relationship exists betw een them. However, the PARTNER INSTITUTION is not precluded from providing the beneficiaries w ith any kind of assistance in a form of transportation fee, oth er allowances, etc.

WHpREAS, the Municipality of San Francisco exercises political and adij linistrative jurisdiction over the forest patches identified as Key Biodiversity Arejj&s in this project; the Municipality of San Francisco promotes the protection, ;rvation and management of the terrestrial biodiversity within its jbdiction;

Wlfl&REAS, the Parties mutually agree and manifest their interest to jointly cooperate in the effective and efficient implementation of the Project;

NOW, THEREFORE, in consideration of the above premises and the agrisements hereinafter set forth, the Parties agree as follows:

ARTICLE I PURPOSES AND DURATION I. The purposes of this cooperation are: c. To implement jointly the project entitled ®CTU-DOST-NICBR Project 2: Biodiversity Conservation and Sustainable Utilization o f Mangroves in Caxnotes Island, Cebu* “CTUDOST-NICER Project 3: Biodiversity Conservation and Sustainable Utilization o f Seagrasses in Camotes Island, Cebu, Philippines9, particularly in the study sites within the jurisdiction of the Municipality of San Francisco; and, d. To ensure that the functions, responsibilities and deliverables of the Parties are done effectively and efficiently during the project term. 5. This Agreement is effective from the date of execution by the Parties and shall remain in effect until 31 December 2021. y. This Agreement maybe renewed until the Project ends on 31st December, 2021.

ARTICLE n RESPONSIBILITIES OF THE CTU

The CTU shall undertake the following functions and responsibilities: 9. Inform the Municipality of San Francisco about the priorities and objectives )f the project as they may be relevant to the nature of project mplementation and management; 10. Coordinate and collaborate with the Municipality of San Francisco, and |other stakeholders in all significant phases of the project implementation; 11. Conduct a regular planning, monitoring and assessment together with tie project stakeholders; 12 Regularly participate in local stakeholders* forum with concerns on biodiversity conservation and management; 13.j Provide the resources and materials needed by the project as indicated ^nd agreed in the project implementation plan; 14. Provide the organizational guidelines and formats to be utilized by the )roject; 15. Furnish and shares available data, reports, plans and other documentation jertinent to the communities and environment covered by the Project ihrough the point person assigned by the CTU for the Project; 16. Acknowledge and recognize the participation of the Municipality of San francisco for the Project in all activities, forums and reports.

ARTICLE m RESPONSIBILITIES OP THE MUNICIPALITY OF SAN FRANCISCO

The Municipality of San Francisco shall undertake the following functions and responsibilities: 8. Hedge commitment to and support the project activities for the attainment f project objectives, outcomes and deliverables. 9. |ssue permits that allow onsite visits for biodiversity assessments including Specimen collection of samples of the Key Biodiversity Areas within its jurisdiction. 10.1 Appoint a focal person for efficient information dissemination for Project i mplementation; 11. Participate in regular and special multi-stakeholders’ fora and meetings; 12. | Support and push for the implementation and attainment of the multii itakeholder approved plans and activities; 13. Participate in the regular partners meeting and assessment facilitated by the CTU; and, 14J; Provide the profiles, data and information such as maps necessaiy for Ihe effective and efficient implementation of the project.

ARTICLE IV TERMINATION AND AMENDMENT Any Party reserves the right to terminate this Agreement if it deems that the j provisions herein are not satisfactorily performed. In such a case, the withdrawing Party shall notify the other Party at least fifteen (15) calendar days pricjjr to the intended date of termination of this Agreement. Any changes in the schedule or the responsibilities of this Agreement will be inutually discussed and agreed upon by the Parties. No changes shall be mat le in the terms of this Agreement without the written approval of both Parlies.

Monitor and evaluate the project implemented with the participation of the Second Party; and 7. Issue Certificate of Recognition/Participation to the Second Party after the implementation of the community extension project.

It. Duties and Responsibilities of the SECOND PARTY 1. Responsible in the endorsement/identification of the particijants and ensure its complete attendance in the said community extension project; 2. Provide pertinent documents, safe venue, sound system , table:.*: and chairs and other related materials as agreed by both parties to be used in the entire implementation of the project; 3. Participate in the monitoring and evaluation of the project implemented by the First Party; and 4. Issue Certificate of Recognition to the First Party after the implementation of the community extension project.

Ensure the collaborative conduct of the community extension project and the attainment of the project outcome/s as stated in the approved community extension project proposal; and 2. Recognize and respect each other's respective rights, duties and responsibilities.
