Appeal for the International Convention for the Protection of all Persons from Enforced Disappearances Enforced disappearance is one of the most serious violations of human rights. The disappeared person is deprived of all his or her rights and he or she remains totally defenceless, in the hands of his or her torturers, outside the protection of the law. Enforced disappearance means by itself the denial of being human. The practice of enforced disappearance causes severe sufferings to the relatives and to the friends of the disappeared: the eternal wait for his or her return and the constant uncertainty about the fate and whereabouts of the loved one amount to a form of ongoing torture. The wrongful removal of children born during the captivity of a mother subjected to enforced disappearance is a particularly heinous crime, contrary to any basic principle of humanity. The practice of enforced disappearance violates the fundamental values of humanity and the basic principles of the rule of law and, in general, of international law. Enforced disappearance challenges the very concept of human rights: it amounts to the denial of the right of all persons to exist. Enforced disappearance turns a human being into a non-being. It is the ultimate corruption, the abuse of power that allows the perpetrators, while committing abominable crimes, to reduce law and order to something insignificant. Unfortunately, enforced disappearance is not a practice of the past nor it is limited to a few regions of the world. All the continents have experienced or are experiencing this criminal practice. People are disappearing in many parts of the world. The practice intermittently appears and reappears, always determining the denial of the fundaments of human dignity. Enforced disappearance does not only manifest itself as criminal activities of public authorities: its practice is related to forms of clandestine repression and, in many countries, it has been or it is an integral part of strategies aiming at spreading terror within the society. The feeling of insecurity generated by this practice, is not limited to the close relatives of the disappeared, but it also reaches the communities to which the disappeared person belongs and the society as a whole. To effectively struggle against and to eradicate enforced disappearances and impunity which is the principal factor that encourages the existence of the practice - an international convention is needed as well as the mobilization of all human energies against this scourge. Since 1981, associations of relatives of disappeared people, non governmental organizations, governments and international organizations have deployed huge efforts against this heinous and inhuman practice, in order to obtain the adoption by the United Nations of a treaty against enforced disappearance. Finally, on 20 December 2006, the General Assembly of the United Nations adopted by consensus the International Convention for the Protection of All Persons from Enforced Disappearance. The Convention fills an immense and intolerable gap: the lack of an international treaty to prevent and suppress this international crime and most serious violation of human rights. The Convention provides for the right not to be subjected to enforced disappearance as well as the right for the relatives of the disappeared person to know the truth. The Convention contains several provisions concerning prevention, investigation and
sanctioning of this crime, as well as the rights of victims and their relatives and the wrongful removal of children born during their captivity. The Convention further sets forth the obligation of international cooperation, both in the suppression of the practice and in dealing with humanitarian aspects related to the crime. The Convention establishes a Committee on Enforced Disappearances, which will be charged with important and innovative functions of monitoring and protection at the international level. This Convention will not only become an effective tool for the international community in its struggle against enforced disappearances, but it also represents a political message that this odious practice will no longer be tolerated and must be suppressed. All the States of the world must assume as a priority the prompt entry into force of the Convention and its effective implementation. Indeed, the full implementation of its provisions will constitute a critical development in the strengthening of human rights and the rule of law, both internationally and in any country Finally, the time has come to translate all the declarations by the international community condemning this heinous scourge into actions and eradication of enforced disappearance. For this reason, the International Coalition against Enforced Disappearances calls on all the States of the world to: - Sign and ratify the International Convention for the Protection of All Persons from Enforced Disappearance without delay and as a priority matter; - Refrain from reservations that may result incompatible with the object and purpose of the International Convention for the Protection of All Persons from Enforced Disappearance; - Recognize the competence of the new Committee on Enforced Disappearances to receive and consider individual complaints; and - Enact without delay the domestic legislation which is necessary to fully implement the International Convention for the Protection of All Persons from Enforced Disappearance.

Appel pour la Convention Internationale Pour la Protection de Toutes les Personnes Contre les Disparitions Forcées La disparition forcée est l'une des violations les plus graves des droits de l'homme. La personne disparue est privée de tous ses droits et elle est placée hors de toute protection de la loi, entre les mains de ses tortionnaires. La disparition forcée est en elle-même la négation de la dignité humaine. La pratique de la disparition forcée engendre de graves souffrances pour la famille et les proches des disparu(e)s: une éternelle attente du retour de la personne aimée et une incertitude constante quant à son sort constituent une forme de torture. L'enlèvement illicite d'enfants nés pendant la captivité d'une mère victime d'une disparition forcée est un crime particulièrement odieux, qui s’oppose à chaque principe fondamental de l'humanité. La pratique de la disparition forcée bafoue les valeurs fondamentales de l'humanité et les principes de base de l’état de droit, et plus généralement, du droit international. La disparition forcée remet en cause la notion même de droits de l'homme: elle nie le droit de toute personne à exister. La disparition forcée annihile la personne. C’est la pire des faillites de l’Etat, c’est un abus de pouvoir qui permet aux malfaiteurs, tout en commettant des crimes abominables, de piétiner l’ordre public et ses règles. Malheureusement, la disparition forcée n'est pas une pratique du passé, elle s’étend à toutes les régions du monde. Tous les continents ont connu ou connaissent ce crime. Des individus disparaissent actuellement partout dans le monde. La pratique apparaît et réapparaît de manière intermittente, en conduisant toujours à la négation des fondements de la dignité humaine. La disparition forcée n’est pas seulement un acte criminel commis par des autorités publiques mais elle est également une forme de répression pernicieuse. Dans de nombreux pays, la disparition est une pratique intégrée aux politiques de terreur de la société. Le sentiment d'insécurité généré par cette pratique ne se limite pas aux proches des disparus, mais il affecte également la communauté à laquelle appartient la personne disparue et la société dans son ensemble. Pour mettre fin aux disparitions forcées et lutter efficacement contre l'impunité – cause principale du maintien de la pratique – la ratification de la convention internationale ainsi que la mobilisation de toutes les énergies contre ce fléau sont tout autant nécessaires. Depuis 1981, les associations de parents de personnes disparues, des organisations non gouvernementales, des gouvernements et des organisations internationales ont déployé des efforts considérables contre cette pratique honteuse et inhumaine, afin d'obtenir l'adoption d'un traité contre la disparition forcée par les Nations unies. Le 20 décembre 2006, l'Assemblée générale des Nations unies a enfin adopté par consensus la convention internationale pour la protection de toutes les personnes contre les disparitions forcées.
La convention comble un vide immense et intolérable: l’absence d’un traité international pour empêcher et supprimer ce crime international et cette violation grave des droits de l'homme. La convention prévoit le droit de ne pas être soumis à une disparition forcée et le droit de la famille du disparu de connaître la vérité. La convention comporte plusieurs
dispositions relatives aux mesures de prévention, d’enquête et de sanction à prendre par les Etats parties ; aux droits des victimes et de leurs proches et à l’enlèvement illégal d’enfants nés en captivité. La convention contient une disposition sur les obligations de coopération internationale s’agissant de la répression de la pratique et des aspects humanitaires liés à ce crime. La convention établit un Comité sur les Disparitions Forcées, qui aura des fonctions importantes et nouvelles de surveillance et de protection au niveau international. Cette convention, une fois en vigueur, deviendra un outil efficace pour la communauté internationale dans sa lutte contre les disparitions forcées, et enverra également un message politique fort signifiant que cette pratique odieuse ne peut plus être tolérée et doit être supprimée. Tous les États du monde doivent avoir comme priorité l'entrée en vigueur de la convention et sa mise en œuvre effective. En effet, l’application pleine et entière de ses dispositions constituera une avancée majeure en faveur du renforcement des droits de l'homme et de l’État de droit, au niveau national et international. En conclusion, le temps est venu pour traduire toutes les déclarations d’intention condamnant ce fléau en actes contre les disparitions forcées. Llamamiento por la Convención Internacional para la protección de todas las personas contra las desapariciones forzadas La desaparición forzada de personas es una de las más odiosas violaciones de derechos humanos. El desaparecido es despojado de todos sus derechos y colocado en situación de total indefensión a la merced de sus victimarios, sin ninguna protección de la ley. La desaparición forzada constituye en sí misma la negación del ser humano. Su práctica causa hondos sufrimientos en los familiares y amigos del desaparecido: la eterna espera de su regreso y la total incertidumbre de su suerte y paradero constituyen una forma de tortura. El robo de niños nacidos durante el cautiverio de sus padres desaparecidos es una de las prácticas más repugnantes y contraria a todo principio básico de humanidad. La práctica de la desaparición forzada vulnera los dictados más elementales de humanidad y los principios básicos del estado de derecho y del derecho internacional. La desaparición forzada constituye un desafío al concepto mismo de los derechos humanos: es la negación del derecho para el ser humano a tener una existencia. La desaparición forzada transforma al ser en un no-ser. Es la corrupción última, el abuso de poder que permite a los responsables transformar la ley y el orden en algo irrisorio y cometer crímenes infames. La desaparición forzada de personas no es, lamentablemente, una práctica del pasado o de ciertas regiones en el mundo. Todos los continentes han conocido o conocen esta criminal práctica. Hoy día se sigue desapareciendo en numerosos países del mundo. Su práctica aparece y reaparece intermitentemente negando los fundamentos mismos de la dignidad humana. La desaparición forzada es no sólo la expresión de formas criminales de proceder de la autoridad pública: su práctica esta asociada a formas clandestinas de represión y, en muchos países, ha sido o es parte integrante de estrategias destinadas a crear el terror en la sociedad. El sentimiento de inseguridad que genera esta práctica, no sólo entre familiares y allegados del desaparecido, se extiende a las comunidades o colectividades a las que pertenece el desaparecido y a la sociedad misma. Hoy, para combatir eficazmente y erradicar las desapariciones forzadas y su impunidad, principal factor que alienta la persistencia de esta práctica, se requiere de una convención así como la movilización de todas las energías humanas contra este flagelo. Frente a esta práctica odiosa e inhumana, un inmenso y sostenido esfuerzo ha sido desplegado desde 1981 por asociaciones de familiares de desaparecidos, organizaciones no gubernamentales, gobiernos e instancias internacionales para lograr que un tratado contra la desaparición forzada sea adoptado por las Naciones Unidas. Finalmente, el 20 de diciembre de 2006, la Asamblea General de las Naciones Unidas adoptó por consenso la Convención Internacional para la Protección de Todas las Personas contra las Desapariciones Forzadas. La Convención viene a llenar un vacío inmenso e intolerable: la ausencia de un tratado internacional para luchar contra de este crimen internacional y grave violación de los derechos humanos. La Convención consagra el derecho a no ser sometido a desaparición forzada así como el derecho de los familiares del desaparecido a conocer a la verdad. La
Convención contiene numerosas disposiciones en materia de prevención, investigación y castigo de este crimen, así como en lo que atiene a los derechos de las víctimas y sus familiares, el robo de niños nacidos durante el cautiverio de sus padres desaparecidos y la cooperación internacional, tanto en materia de represión como humanitaria. La Convención establece un Comité contra la Desaparición Forzada, dotado de importantes y novadores procedimientos de vigilancia y protección internacionales. Esta Convención no solamente dotará a la comunidad internacional de una herramienta jurídica para luchar efectivamente contra la desaparición forzada, sino que constituye un mensaje político fundamental de que esta práctica odiosa no puede ser tolerada y debe ser erradicada. La pronta entrada en vigor de la Convención y su implementación deben ser asumidas como una prioridad por los Estados del mundo. El respeto y la implementación de sus disposiciones representarán un desarrollo fundamental en el fortalecimiento de los derechos humanos y del estado de derecho, tanto a nivel nacional como internacional. Ha llegado la hora de traducir las declaraciones de la Comunidad internacional, condenando esta odiosa práctica, en acción de lucha y erradicación de la desaparición forzada. Por ello, la Coalición Internacional contra Desapariciones Forzadas hace un llamado a todos los Estados del mundo a: -

firmar y ratificar, sin demora y como asunto prioritario, la Convención Internacional para la Protección de Todas las Personas contra las Desapariciones Forzadas; abstenerse de formular reservas incompatibles con el objeto y el propósito de la Convención Internacional para la Protección de Todas las Personas contra las Desapariciones Forzadas; reconocer la competencia del nuevo Comité contra la Desaparición Forzada para recibir y examinar comunicaciones individuales; y adoptar sin demora las disposiciones de derecho interno que resulten necesarias para la implementación de la Convención Internacional para la Protección de Todas las Personas contra las Desapariciones Forzadas.
