uring the social unrest following the deaths of George Floyd and Breonna Taylor, the concept of diversity, equity, and inclusion (DEI) gained the attention of many businesses. Employers turned their attention to ways they could effect change in their workplace. Many organizations rushed to make statements about race and social injustice. They established DEI committees to address their own diversity (or lack thereof) and inclusivity. However, some employers quickly discovered that promoting DEI in the workplace, while aspirational, was not an easy task. 2023 MARKET REPORT ISSUE

BEGINNING IN 2020, MORE VIRGINIA EMPLOYERS THAN EVER SOUGHT LEGAL ADVICE AND GUIDANCE ON HOW TO DISCUSS AND PROMOTE DEI IN THE WORKPLACE. MANY LAWYERS WERE— AND STILL ARE —UNSURE OF HOW TO ADVISE CLIENTS ON HOW TO PROMOTE DIVERSITY AND INCLUSIVITY IN THE WORKPLACE. IS THE CONCEPT OF DEI EVEN A LEGAL ISSUE? Lawyers are clear on their duty to advise clients of the law. At a minimum, they must

Lawyers also should make sure their firm or practice has a DEI checklist which must include the following: (1) EEO and anti-discriminatory written policies; (2) A commitment to conduct regular workplace trainings on issues of harassment, discrimination, and DEI; and (3) Creation of a DEI committee, team, or task force consisting of employees of diverse backgrounds and cultures. If company leadership does not feel qualified to lead the program, they should consider investing in an outside facilitator to assist them.

DataJoe checked and confirmed that each published winner had, at time of review, a current, active license status with the appropriate state regulatory board. If we were not able to find evidence of a lawyer's current, active registration with the state regulatory board, that lawyer was excluded from the list. In addition, we checked available public sources to identify lawyers disciplined for an infraction by the state regulatory board. These entities were excluded from the list. Finally, DataJoe presented the tallied result to Lynchburg Business for its final review and adjustments. Final note.
